General: Based on interview and review of documentation, one staff member with an unknown date of hire did not have a personnel file available for review. The staff person stated that she believes that her file is kept at the YMCA Central office. The following documents were not maintained at the facility for this individual: date of employment, proof of educational qualifications, documentation of compliance with tuberculosis screening, and results of National background check. The surveyor searched this individual on the KARES portal and noted that the application was withdrawn on 12/11/2019, after clearing the Kentucky and National Sex Offender search as well as the Kentucky Child Abuse Network Registry. The surveyor did not see any evidence that the staff member’s fingerprints had been submitted to the National Background Check Service for analysis. The surveyor did not observe this staff member to be working alone.

General: Based on review of documentation and interview, the surveyor found that a staff person was hired 10/2/14 but left employment months later. The staff person stated that she was re-hired but could not remember the date of re-hire. File review found that this staff person has lived out of state within the past five (5) years. New background checks were completed (CRC-9/2/15 and CA/N- 8/26/15);however, a new out of state background check was not completed. The out of state background check that was on file was dated 9/24/14. It is important to note that this staff person was not working alone during the inspection.

General: Based on Observation, the facility failed to ensure that a child not be required to stand or sit for a prolonged period of time during an activity or while waiting for and activity to start. At the time of survey, thirty-six (36) children were required to sit at tables from approximately 2:50 p.m. until 4:00 p.m. while waiting for activities or afternoon snack. The surveyor did not observe any planned programming during this time frame. The surveyor did observe bowls of grapes and several bags of pretzels on a table behind the groups of children. The staff member in charge stated that the children would work on homework, and then wash their hands before snack. The surveyor observed groups of ten (10) to eleven (11) children walk to the toilet room to wash their hands. The surveyor observed that the groups of children were escorted to the toilet room individually, and then escorted back to the tables located in the space used for child care. The surveyor did not observe any type of activity provided to the children while waiting to wash their hands, or while waiting for the designated homework time to end. The surveyor only observed one (1) child in a group of thirty-six (36) work on homework. The surveyor observed children hitting one another, crawling under the tables, and yelling. The surveyor did not observe the afternoon snack being served to the children during the time frame of 2:50 p.m. and 4:00 p.m. Premises
General: Based on Observation, the facility failed to maintain a minimum of thirty-five (35) square feet of space per child. At the time of survey, thirty-six (36) children were confined to a hallway space of approximately 432 square feet. The minimum square footage of space needed for thirty-six (36) children would be 1,260 square feet. The space used for child care measured twelve (12) feet in width and thirty-six (36) feet in length. In this space were three (3) rectangle spaced table with attached seating. Thirty-two (32) of the children in care were required to sit at the rectangular shaped tables, while four (4) of the children in care sat in the floor behind the tables. In the area where the tables met directly across from each other, there was only approximately six (6) inches of walking space between the two (2) tables. Children and staff were observed climbing across the chairs of the tables to access space behind the tables. General: Based on Review of Documentation, it was found that the file for an employee hired on 1-31-17 contained evidence of submission for a central registry check, however, the results had reportedly not yet been received. In addition, this employee reported that she lived in California as recently as June 2016. Her file did not contain evidence of submission for or a completed background check from California. This employee reportedly does not work alone with children. She has been employed at the facility for more than ninety (90) days. The file for an employee hired on 7-1-16 contained evidence of a criminal records check being completed, however, the second page of the report was missing, therefore the results could not be reviewed. General: Based on review of documentation and interview, two (2) staff (hire dates: 3/19/16 and 8/25/15) did not have proof of education on file at the time of the investigation. The staff person in charge indicated that the documentation may be on file at the YMCA central office.
General: Based on review of documentation, three (3) staff (hire dates: 11/9/15, 1/8/16, and 2/11/16) did not have TB skin documentation on file; therefore, the surveyor could not verify if the staff were free of active tuberculosis. (2) A staff person hired on 9/22/15 had TB skin documenation oon file that was dated 10/5/15. The TB skin test was not completed prior to hire.
General: Based on Observation, the facility failed to provide a daily planned program that offers a variety of creative activities including art, music, dramatic play, stories and books, science, block building, tactile activity, and culture. At the time of survey, thirty-six (36) children were observed playing with one (1) spider man puzzle, three (3) toy wrestling figurines, and two (2) Ninja Turtle figurines. Several children were observed without any offering of activity from approximately 2:50 p.m. until 4:00 p.m. The staff member in charge reported that the programming materials had been placed into storage by James Lane Allen Elementary personnel, and that the programming materials were inaccessible to the child care program.
General: Based on Interview, the facility failed to make necessary provisions within Kentucky Child Care Regulations to avoid interference with the child care program. At the time of survey, the cafeteria area of James Lane Allen Elementary school, used for licensed child care space was inaccessible to the child care program. The staff member in charge reported that the James Lane Allen Elementary school was utilizing the cafeteria area for a family event held after school hours, but during child care operation hours. The cafeteria area had been inaccessible to the child care program on 04/09/2014 as well. The staff member in charge reported that the cafeteria area would remain inaccessible to the child care program until 04/17/2014 or 04/18/2014. The reporting staff stated that the James Lane Allen Elementary school informed the program that the cafeteria area would be inaccessible to the child care program on 04/07/2014. At the time of survey, the child care program had been operating in a hallway space outside of the cafeteria area. The space in use by the child care program failed to meet the minimum square footage requirements for the number of children present. The staff member in charge also reported that the programming materials used for the child care program had been placed into storage by the James Lane Allen Elementary school and were inaccessible to the child care program.
General: Based on Observation, the facility failed to follow a program of activities. During the time of survey, the surveyor observed the children were provided with an assortment of books for approximately thirty (30) minutes. The books were the only activity provided to the children. The surveyor observed that the majority of the children were not reading the books. The surveyor observed children running around tables, sitting on tables, hitting one another, and yelling. The surveyor observed that from 2:35 p.m. until 5:00 p.m. the following activities were not provided to the children of the younger group: art, music, dramatic play, science, block building, tactile activity, culture, or quiet activity. The surveyor observed that from 2:35 p.m. until 5:00 p.m., the following activities were not provided to the children of the older group: art, music, dramatic play, block building, tactile activity, culture, or quiet play.
General: Based on Observation, the facility failed to post information on the Kentucky Consumer Product Safety Program and the program's website.
TYPE B CITATION: Based on Observation, the facility failed to provide supervision at all times. The surveyor observed one (1) child flip over a chair and leave the cafeteria area. The child was unsupervised for approximately one (1) minute. The staff members did not observe the child leave the space. The surveyor informed the staff member in charge that a child had left the cafeteria. Once the child left the cafeteria, the child was no longer within scope of vision or range of voice.
General: Based on Observation, the facility failed to ensure that the outdoor play area shall be safe from foreseeable hazard. At the time of survey, the surveyor observed an orange construction fence separating the playground from a construction area on the school property. The fence had fallen, leaving the construction area accessible to children using the outdoor play area. The fence had been posted by approximately twelve (12) metal dowels sticking out from the ground. The dowels were posted in the ground along the proximity of the outdoor play area and presented a potential hazard to the children. The following items were located near the outdoor play area: rusted, metal wire fencing, plastic debris, and pieces of metal pipes. These items were located on the construction site, however, were accessible to children using the outdoor play area.
General: Based on Observation, the facility failed to ensure that a child shall not be required to sit for a prolonged period of time while waiting for an activity to start. The surveyor observed children in the younger age group were required to wait for approximately ten (10) minutes between afternoon snack and transition outside. The children were not given an activity while waiting. The surveyor observed children in the older group were required to wait approximately ten (10) to fourteen (14) minutes in between afternoon snack and a planned activity to begin. The children were not given an activity while they waited. The children were observed running around tables, sitting on tables and hitting one another.
General: Based on Observation, the facility failed to ensure that the following items were inaccessible to children enrolled in the program: one (1) pressure washer machine was located along the cafeteria wall, two (2) floor buffer machines were located along the cafeteria wall, one (1) roll of green trash bags located on the top of a cooler, two (2) staff purses located on a stack of black mats, one (1) bottle of PortionPac Gemicidal Detergent with a manufactory label that read “Keep out of reach of children” was located on a rolling cart in the middle of the cafeteria, two (2)bottles of SFSPac Sanitizer wth a manufactory label that read “Keep out of reach of children” located behind the podium at the back of the cafeteria, four (4) used mop heads with debris within the fabric, one (1) bottle of GermX Hand sanitizer with a manufactory label that read “Keep out of reach of children” was located on a short file cabinet in the stage area, two (2) paper cutting tools located on the stage area, one (1) die cut machine located on the stage area. At the time of survey, the surveyor observed approximately three (3) children access the stage area. At the time of survey, the surveyor observed two (2) children playing with one (1) of the floor cleaner machines. General: Based on Observation, the facility failed to ensure the premises of the cafeteria and stage area were clean. At the time of survey, the surveyor observed a thin layer of dirt accumulated on the top of equipment and furnishings. These furnishings include: one (1) piano, one (1) cooler, one (1) filing cabinet, a stack of black mats, and one (1) table located at the back of the cafeteria.
General: Based on Observation, the facility failed to ensure that the walls of the cafeteria area were smooth and in good repair. The surveyor observed two (2) pieces of plywood, nailed to the side wall of the cafeteria. The wall was located near the front exit. The surveyor observed that the top section of plywood had broken at the bottom, left corner. The break had caused sharp pieces of plywood to be exposed. Also, the surveyor observed four (4) holes on the side of the bottom concrete step of the stage. The holes were approximately six (6) inches by five (5) inches in size. The holes contained exposed pipes and wires.
General: Based on Review of Documentation, the facility failed to maintain a current immunization certificate for a child enrolled on 08/18/2013. The child's immunization certificate expired on 01/17/2014.
General: Based on Observation, the facility failed to post a schedule of daily activities that include dates the activities were to be conducted with the children in the program. The facility did post a program of daily activities, however, it was not dated. 1170 - Diapering/Handwashing Not Applicable 922 KAR 2:120. Section 10. Toilet, Diapering, and Toiletry Requirements. (9) The proper methods of diapering and hand-washing shall be posted at each diaper changing area. Animals
