KinderFax (“the Service”) republishes public child care licensing and inspection records. The clauses below describe how we handle that information and the limits of our responsibility for it. Nature of the information
KinderFax aggregates and republishes child care licensing and inspection records obtained from government sources that are made available to the public by law. KinderFax is an independent service and is not affiliated with, endorsed by, or acting on behalf of any government agency. KinderFax does not license, inspect, accredit, rate, or regulate any child care facility, and does not independently investigate, verify, or endorse the underlying government findings it republishes.
Source accuracy and timeliness
The information on KinderFax originates with third-party government agencies. Those source records may contain errors, omissions, or delays, and may be updated, corrected, or removed by the originating agency at any time. KinderFax reflects the source records as it receives them and updates on a recurring but not real-time basis. Records shown on KinderFax may not reflect the most current status of a facility. Each facility page displays the date of our most recent update from the source. You should always verify any information that matters to you directly with the relevant state agency and with the facility.
No warranty
The KinderFax service and all information on it are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including without limitation any warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, or non-infringement. KinderFax does not warrant that the information is accurate, complete, or current, or that the service will be uninterrupted or error-free.
Not a safety guarantee or recommendation
Information on KinderFax is provided to help you conduct your own research. The absence of violations or complaints on a facility's page is not a guarantee that the facility is safe, and the presence of violations, complaints, or enforcement actions is not, by itself, a determination by KinderFax that a facility is unsafe or that you should not use it. KinderFax does not recommend, endorse, or advise for or against any facility. Any decision you make about child care is your own, and you are solely responsible for evaluating any facility, including by contacting the facility, visiting in person, and consulting the relevant state agency.
Not professional advice
KinderFax does not provide legal, safety, medical, or professional advice. Nothing on the Service constitutes such advice or creates any professional or advisory relationship.
Corrections
KinderFax maintains a corrections process described in our Corrections & Removal Policy. If you believe information is inaccurate, please use that process. Because KinderFax mirrors public government records, disputes about the accuracy of an underlying record generally must be resolved with the agency that created it.
Acceptable use
You agree not to:
- Use the Service to harass, threaten, stalk, defame, or harm any facility, owner, employee, or other person;
- Use any information from the Service to make decisions KinderFax does not permit (including, to the extent applicable, decisions governed by the Fair Credit Reporting Act — see below); or
- Scrape, harvest, or bulk-copy the Service except as expressly permitted in writing.
FCRA notice
KinderFax is not a consumer reporting agency, and the information on KinderFax is not a “consumer report” under the Fair Credit Reporting Act (FCRA). You may not use KinderFax, in whole or in part, to make decisions about employment, hiring, promotion, retention, or any other purpose covered by the FCRA.
Limitation of liability
To the maximum extent permitted by law, KinderFax and its operators, owners, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or reliance on, the service or any information on it, including without limitation any decision made about a child care facility. To the maximum extent permitted by law, KinderFax's total liability for any claim arising out of or relating to the service will not exceed $100.
