On 05/02/17, the staff person called DRCC surveyor and stated that the files were actually on site but just in another cabinet. The files were not accessible on the day of the investigation. General: Based on Review of Documentation, it was found that a staff person with a hire date of 09/19/2016 did not have evidence of a child abuse and neglect check or evidence that an application for one had been completed. It was also found that a staff person with an unknown date of hire did not have evidence of a child abuse and neglect check or evidence that an application for one had been completed. These two staff were not working alone. It was also found that a staff person with a hire date of 09/19/2016 did not receive a completed child abuse and neglect check until10/17/2016. It was found that an employee with a hire date of 09/26/2016 who previously lived in a different state had no evidence of a criminal records check or evidence that one had been applied for. These instances are not in accordance with 922 KAR 1:470 which states that a request for a central registry check must be submitted within five (5) working days after the date of employment of an individual and in accordance with KRS 17.165 which requires that application for the criminal record of a probationary employee be made no later than the date probationary employment begins.
