Programs shall staff infant and toddler programs in accordance with the following: (1) For children ages 6 weeks to 12 months, the maximum group size shall be 12 with the following minimum staffing levels: a. One associate teacher with up to 4 children; b. One associate teacher and one assistant teacher with 5 to 8 children; and c. One lead teacher and 2 assistant teachers with 9 to 12 children; (2) For children ages 13 to 24 months, the maximum group size shall be 15 with the following minimum staffing levels: a. One associate teacher with up to 5 children; b. One associate teacher and one assistant teacher with 6 to 10 children; and c. One lead teacher and 2 assistant teachers with 11 to 15 children; (3) For children ages 25 to 35 months, the maximum group size shall be 18 with the following minimum staffing levels; a. One associate teacher with up to 6 children; b. One associate teacher and one assistant teacher with 7 to 12 children; and c. One lead teacher and 2 assistant teachers with 13 to 18 children.

The licensing coordinator’s review of the daily child and staff attendance records from the Toddler B Classroom on May 8, 2025, revealed that there were 11 children present with two staff members. The average age of the children was 24 months, requiring a ratio of one staff member per five children. Corrective action: The toddler B classroom normally has 10 children with 2 teachers meeting the 1:5 ratio. This day, we had to add another child due to staff absence. We calculated incorrectly and although the average was over 24 months, it was shy of 25 months. All staff was trained on 5/29 in how to calculate average age and reminded that the average age has to be one month more than the age. We are also having 2 staff calculate average age to make sure of accuracy if this situation arises again.

Programs serving diapered children and children who are not toilet trained shall have a designated diaper changing area, which shall: (1) Be located adjacent to or in close proximity to a designated hand washing sink to allow access for hand washing without having to open doors or gates or have physical contact with other children; (2) Have a non-porous, washable surface, which shall be used exclusively for diaper changing and sanitized after each diaper change; (3) Contain a covered, hand-free receptacle, lined with a plastic bag, and located within reach of the diaper changing area for disposal of soiled disposable diapers and cleansing articles; and (4) Not be located in kitchens or in food preparation or food service areas, or on surfaces where food is prepared or served.

The licensing coordinator observed, in the Toddler C Classroom, the designated diaper change area was not in close proximity to a designated hand washing sink. Corrective action: We stopped using this diaper changing table. We are now using the one that is closer to the sink.

Garbage shall be disposed of in a lined and covered container and staff shall empty trash containers daily or sooner if contents create an odor or a health risk.

The licensing coordinator observed uncovered trash containers in the Infant D, Toddler A, Toddler D, Multi Age A, Multi Age B, Multi Age C, and Multi Age D Classrooms. Corrective action: The trash cans without lids were only used for non food items but we have ordered lids for all trash cans whether used for food or not.

Child care staff shall not allow children younger than 3 years of age to have access to toys, toy parts, and other materials that pose a suffocation or choking risk or are small enough to be swallowed, including, but not limited to, coins, balloons, exposed foam padding, or empty plastic bags.

When child care staff place infants in their crib or play pen for sleep, they shall check to ensure that the temperature in the room is comfortable for a lightly clothed adult, check the infants to ensure that they are comfortably clothed and not overheated or sweaty, and that bibs and garments with ties or hoods are removed.

The complainant stated the temperature in the Infant C Classroom was 86 degrees when they picked their child up on June 19, 2024. Staff A stated the temperature in the Infant C Classroom was 86 degrees June 18-21, 2024, which resulted in Staff A feeling uncomfortable and light-headed and the children appeared uncomfortable and were sweating. Staff B stated the Infant C Classroom was the hottest room in the building during the heatwave and they observed that the children were uncomfortable, irritable, and sweating. Staff B observed a child wake up from rest soaked in sweat. Staff C stated the highest temperature they observed in the Infant C Classroom June 18-21, 2024, was 86 degrees. Corrective action: Management will close the building or classroom when the air conditioning system fails or can't keep up in a heat wave and reaches a temperature where infants are sweating. This may leave families without care for their children as mechanical systems do fail unexpectedly. Additional temporary and portable units were added before this complaint (and will be added in the future if necessary) to keep the classrooms at a more comfortable temperature until a permanent solution is completed. A new HVAC system has been approved, ordered and scheduled to be installed as soon as equipment arrives. I feel it is important to note that: 1) HVAC technicians were on site and had been on site for several days that week and solutions to fix the issue were being planned. 2) Classrooms were equipped with large portable air conditioning units and fans, so air was moving, humidity levels were low, and the classrooms were at a comfortable temperature for a large part of the day. 3) The Director was never informed that any staff member was feeling lightheaded.
