Applicants, licensees, permittees, and all child care staff shall keep confidential all records required by the department pertaining to the admission, progress, health, and discharge of children under their care and all facts learned about children and their families with the following exceptions: child care staff shall release information regarding a specific child only as directed by a parent of that child, or upon receipt of written authorization to release such information, signed by that child’s parent.

The complainant reported that they observed a video and photos of Child A on the program's public Facebook page, and stated the program did not have permission to post pictures of Child A on social media. Staff A confirmed that they posted a video and photos of Child A on the program's Facebook page, and they did not have permission from Child A’s guardians to do so. Corrective action: The photos and videos posted were covering the child's face, although that was not a good judgement call, the director thought that it would suffice the parents verbal request not to put the child on social media. All photos and videos have been removed, and no child will be posted going forward without all parents' permission.

Cribs and play pens required under He-C 4002.26(c) above shall: (1) Not be stacked; (2) Be free of cracked or peeling paint, splinters, and rough edges; (3) Have no more than 2⅜ inches between slats; (4) Have no missing, loose, broken, or improperly installed parts, screws, brackets, baseboards, or other loose hardware, or damaged parts on the crib or mattress supports; (5) Not have corner posts that extend more than 1/16 of an inch above the end panels; (6) Not have holes or tears in the mesh walls or in the material that connects the walls to the bottom of the crib or play pen; (7) Have fitted sheets designed for the size mattress, including elastic corners so that there is no excess fabric with visible folds or bunching, and that do not compress the mattress; (8) Not have bumper pads, blankets, flat sheets, pillows, quilts, comforters, sleep positioners, or any soft items or toys with infants up to 12 months of age; and (9) Have mattresses which are in good repair, free of rips or tears, and fit the crib or playpen so that the space between the mattress and crib or playpen is not more than 2 adult fingers wide and does not create a suffocation hazard.

Any contaminated, expired, or discontinued medication, whether prescription or over-the-counter, and topical substances shall be returned to the child’s parents or, if belonging to the program, disposed of properly by authorized staff.

REPEAT CITATION PREVIOUSLY CITED ON JULY 5, 2023. The licensing coordinator observed that, in Toddler One and Preschool Classrooms, there were expired over the counter medications and creams that were not returned to each child's parent. This constitutes a repeat citation and failure to comply with one approved CAP regarding the disposal of expired medication. Corrective action: All classrooms have been purged of any over the counter expired medicines. Director will do walk-throughs of classrooms quarterly to check for expired medications.

He-C 4002.21(u) · Correction status not published

A written record of a health screening for all child care staff, household members and other individuals who have 5 or more hours per week of contact with children shall: (1) Be on file at the program and available for review by the department for all child care staff within 60 days of the date of hire or the date the household member or individual begins having daily contact with children; and (2) Include, at a minimum, the information on the “Child Care Personnel Health Form” (11/2017) provided by the department, or its equivalent.

REPEAT CITATION PREVIOUSLY CITED ON JULY 5, 2023. The licensing coordinator’s review of five staff records revealed that an updated health screening was not on file at the program for one staff. This constitutes the first repeat citation and failure to comply with one approved CAP regarding updating staff’s health screenings. Corrective action: Staff files will be reviewed quarterly to ensure that updated health screenings are on file.

He-C 4002.09(b) · Correction status not published

Child care staff shall supervise every child in care at all times.

The complainant reported that staff nap during rest time. The licensing coordinator observed that, during rest time in the Toddler 1 Classroom, the lights were off and Staff A was lying on a rest mat with their eyes closed facing the wall, and appeared to be sleeping. Staff B stated they have observed Staff A sleep during rest time. Corrective action: Immediately following our licensing coordinators visit, all staff were instructed to never lay down during rest time. A center wide review of appropriate rest time etiquette was reviewed and staff members were reminded about the importance of never closing their eyes or laying down during rest time. Staff were reminded that they will always be permitted to take a break should they need one. The center director will walk around throughout nap time to check on classroom teachers to ensure this important rule is being followed and asking if anyone needs a break, everyday. Staff are encouraged to work on curriculum planning, organizing their rooms or cleaning toys while the children are resting to ensure productivity during rest time.
