General: Based on observation and review of documentation, the center failed to maintain current and accurate attendance records to reflect the time of arrival of each child who was present. Forty-one (41) children were observed at the child care center; however, the time of arrival for only twenty-two (22) children was documented.
General: Based on observation, the outdoor play area was not free from foreseeable hazards. There were hand-size pieces of broken glass lying inconspicuously in the grass near the wooden fence line of the outdoor play area, on the outside of the enclosed area.
General: Upon the DRCC representatives' arrival, one (1) unqualified staff member was the sole caregiver of sixteen (16) children, ranging in age from five (5)-years-old to ten (10)- years-old. The surveyor observed the rolls of paper towels that the staff and children use in the two (2) - three (3) year old classroom and the toddler classroom areas were stored in an unsanitary manner, sitting on the side of the sink. This method of storage promotes germs due to each person handling the roll to obtain a paper towel. General: Based on Observation, during a tour of the school age area a ladder was leaned against the wall at the back of the room near a door with the word exit. The ladder was accessible to the children. Upon arrival at the facility at approximatley 9:10 a.m., a two (2) month old child was observed sitting in a bouncy seat that had been placed inside the child's crib. The surveyor went back into the room a few minutes later and the child had been removed but was then placed back in the bouncy seat which was still sitting in the infant's crib. General: Based on Observation, upon arrival at the facility at approximately 9:10 a.m. all of the children were eating breakfast in the eating area. The kitchen is located off of the eating area and the surveyor observed that the kitchen door was propped open while the children were eating. The kitchen door remained propped open after the children left the area. The surveyor entered the kitchen and found an unlocked cabinet under the sink. Inside the cabinet there was a can of WD 40, a can of Comet cleaner, a bottle of Clorox bleach, a bottle of Magic Power Cleaner with bleach, three (3) gallons of paint, three (3) cans of spray paint, a bottle of soap scum remover, four (4) small cans of paint, a bottle of Totally Awesome All Purpose cleaner, a bottle of carpet cleaner, a bottle of Mr. Clean and a bottle of Fabuloso Cleaner. Based on observation and interview, the facility failed to provide adequate supervision. On 3/7/16 at 2:48PM the surveyor observed eight (8) school age children enter the front door of the facility with a male staff person. The surveyor entered the facility at 2:50PM, walked through the preschool classroom and into the hallway where the girls' and boys' restrooms are located. The male staff person was observed caring for six (6) school age children that were putting their personal belongings away, using the restroom and washing their hands. The surveyor proceeded down the hallway, walked through the infant/toddler classroom and into a small room used as an eating area that is adjacent to the infant/toddler classroom and the kitchen. The surveyor observed two (2)boys sitting at a table with no staff person present. This HSS looked in the kitchen for a staff person; however, did not see anyone. This HSS alerted the staff person working in a nearby two (2) year old classroom to the situation. The staff person identified the two (2) boys as school age children and stated that they were supposed to be with the male staff person. The two (2) boys got up at that time, ran through the empty infant/toddler classroom and down the hallway to re-join their group. The staff person in charge stated that the boys must have ran into the eating area after they finished going to the bathroom instead of staying with their group. The boys were separated from their group and unsupervised approximately one (1) - two (2) minutes. General: Based on Review of Documentation and interview, this regulatory requirement was not met. During the visit, the surveyor requested written staff schedules for the current week (2/29/16 - 3/4/16) and the previous week (2/22/16 - 2/26/16) due to the allegations listed in the complaint. The staff person in charge was not able to provide this information to the surveyor during the visit and stated, "My staff do not clock-in and out. I just know what hours they work and key it in for them when it's time to do payroll".

General: Based on Observation of the two (2) year old room there was areas of chipping/peeling paint on the wall in the dramatic play area and divider wall. There was also peeling paint on the ceiling in the back hallway. In the diaper changing area the caulking on the wall behind the sink was cracked. In the girls' bathroom the linoleum was coming up from the floor in areas where the caulking at the edges had cracked. Also, in the girls' bathroom the cauliking behind the sink was not smooth and had dirt built up in the crevices. In the boys' bathroom the wall behind the working unrinal was damaged. The paint was flaking and there was a brown stain.
General: Based on Observation and interview, the two (2) year old room was over ratio by two (2) children. There were eight (8) children and one (1) staff person in the group. There was one (1) child in the group who was one (1) year old. The staff person in charge stated that the toddler was combined with the two (2) year olds because she was the only toddler present.
General: Based on Observation, the toddler room did not have art or science materials available. The daily activity plan posted for that week had art activities listed for three (3) days.
General: Based on Observation and interview, there was one (1) toddler included in the two (2) year old class. The toddler was fourteen (14) months old. The director stated that there is usually a toddler room open but she was in that group because there were no other toddlers present and a staff person was out the morning of the inspection.
General: Based on Interview, on 01/09/15, the preschool staff person was in the kitchen cleaning up while the children laid down for nap. The staff person stated that a four (4) year old child was running around with other children and fell hitting the back of her head. The staff person did not see the incident occur but when she went back into the classroom the child was crying and had blood on her hands. The child had a large gash to the back of her head. The staff person did not know what caused the gash to her head. The kitchen is approximately nine (9) feet away from the preschool classroom. The classroom is not visible from the kitchen. General: Based on Interview, on 01/09/15, the preschool staff person was in the kitchen cleaning up while the children laid down for nap. The staff person stated that a four (4) year old child was running around with other children and fell hitting the back of her head. The staff person did not see the incident occur but when she went back into the classroom the child was crying and had blood on her hands. The child had a large gash to the back of her head. The staff person did not know what caused the gash to her head. The kitchen is approximately nine (9) feet away from the preschool classroom. The classroom is not visible from the kitchen.
General: Based on Review of Documentation, it was found that the file for a substitute employee did not contain evidence of an annual professional development plan being completed.
General: Based on Observation, it was found that a smoke detector was beeping in the back hallway, indicating a low battery. It was also found that the blue paint was peeling away from the window panes of the windows in the school age classroom. The dark blue paint on the bottom two (2) feet of the outside of the building was found to be peeling in multiple places. The outside walls of the building form two (2) sides of the boundary for the playground used by the younger children.
General: Based on Review of Documentation, it was found that the file for a substitute employee did not contain evidence of an annual evaluation being conducted.

General: Based on interview and review of documentation, four (4) children and one (1) staff person left Champs Skating Rink on 6/17/14 because one of the children had injured her wrist. The staff person did not take the other three (3) children back to day care but instead took them with her to the hospital where they remained for approximately two (2) hours. The children did not have permission trip forms signed by their parents permitting them to go to the hospital.
General: Based on interview and record review, four (4) children and one (1) staff person left Champs Skating Rink on 6/17/14 because one of the children had injured her wrist. The staff person stated that instead of taking the other three (3) children back to the day care, they all accompanied her to the hospital. She stated they arrived at the hospital at approximately 2:15 p.m. and left the hospital at approximately 4:15 p.m. She stated the child's mother arrived at the hospital at 4:15 p.m. The children had to wait approximately two (2) hours at the hospital which is not developmentally appropriate. General: Based on Review of Documentation, and interview, the surveyor found that a staff person who had been rehired on 5/31/13 did not have a current criminal records check on file. The criminal records check on file was dated 10/21/11. The staff person in charge was unaware that a new criminal records check was required to be processed if a staff person has been rehired.

During the relicensure survey it was found that the facility license, the statement of deficiencies/plan of correction from the 8/31/17 relicensure inspection, information on the Kentucky Consumer Product Safety Program and the staff-to-child rations were posted in a room labeled "Teacher's Break Room". There was an additional sign posted that stated, "Teachers Only Beyond This Point" and a curtain was hanging in the doorway which blocked access to the area. Therefore, these documents were not posted in a conspicuous place for public inspection.
General: Based on Review of Documentation and interview, this regulatory requirement was not met. On 4/10/18 the surveyor arrived at the facility at 9:00AM to investigate allegations regarding understaffing at the facility on 3/5/18. Staff-to-child ratios were found to be in compliance during the investigation; however, an interview with the staff person in charge revealed that there were a couple of incidents on 3/5/18 which caused brief non-compliance with regulatory requirements. The staff person in charge stated that two (2) staff and nine (9) children were present in the toddler classroom on 3/5/18. Sometime between 9:00AM - 12:00PM, one (1) of the teachers exited the classroom to get a roll of paper towels, which left one (1) staff person with all nine (9) children. The youngest child in the group was a one (1) year old, making the minimum staff to child ratio one staff person for six (6) children. The facility exceeded the staff/child ratio by three (3) children while the second staff person was out of the classroom. The staff person in charge explained the second incident by stating, "Two (2) staff and six (6) infants were present in the infant classroom on 3/5/18. I was told that one (1) of the staff left the room to get supplies but I don't know specifics. I was in the kitchen cooking that day and everybody was just so nervous, it threw me off. Staff know not to leave their rooms; I don't know why they did that". General: Based on Review of Documentation, there was one (1) staff person with a hire date of 8/22/11 and another staff person with a hire date of 8/15/11 who had the results of a T.B. test dated 8/18/14. This exceeds the two (2) year time frame for a T.B. skin test. In addition there was a staff person with a hire date of 1/11/16 who had the results of a T.B. skin test dated 2/3/16. This does not meet the requirement that the results of a negative T.B. skin test or a statement from a health professional indicating the individual is free from the symptoms of T.B. should be obtained prior to employment. During an interview with the staff person in charge found that this staff person had a current T.B. test when the staff person was hired. However, the staff person's previous employer would not give the staff person a copy of the T.B. test.
General: Based on Interview, it was found that the parents provide the formula for their child. Further interview found that the parents bring in a premeasured container of formula but staff measure the amount of water needed to prepare the bottle. General: Based on Observation during an inspection of the outdoor play area, the area smelled of moth balls. Further inspection of the outdoor play area found ninety-one (91) moth balls scatterd in various areas around the playground. During an interview with staff person in charge it was found that there was some type of bug observed on the playground and she contacted an exterminator and was told to place moth balls in the area. However, the moth balls had been placed on the playground on Tuesday of that week and the children had not been taken outside to play since that day. Based on observation and interview, the facility failed to maintain staff-to-child ratios. On 3/7/16 at 2:50PM the surveyor toured the facility and observed one (1) staff person caring for eight (8) children in the two (2) year old classroom. The staff person identified the youngest child in her group as a five (5) month old; therefore, was not in compliance. The staff person stated that an infant and a one (1) year old child was added to her group "about an hour ago". The director arrived at the facility during the visit and stated that the understaffing occurred because one (1) staff person left at 1:00PM on her lunch break and did not return to the facility or call.
