General: Based on Interviews with several staff, it was discovered that one staff used a ruler to hit children as form of punishment. One staff reported observing the staff person hit children on their arms "very forcibly" and named five (5) children who she observed to be hit. She also reported she observed the staff person take a child into the bathroom and then hearing what sounded like the child being struck four or five (4 or 5) times and the child screamed each time she was hit. Another staff person reported she also observed five (5) children being struck with a ruler and overheard the offending staff refer to the ruler as her "paddle". Four (4) children interviewed by the DCBS worker also reported observing this staff person striking children with a ruler. General: Based on Interview, a black Volvo that belonged to the director was used to transport a child to the center from Mary Todd Elementary. A minivan was also used for this school pick up but there were too many children to all fit in the minivan. The child's parent gave verbal permission for the child to be transported in the Volvo. However, the Volvo had not been approved for transportation by the Division of Regualted Child Care. The staff person in charge stated that the Volvo would not be added as an approved vehicle and would not be used again to transport for the center.
General: Based on Observation and interview, this regulatory requirement was not met. During a tour of the infant classroom, the surveyor observed several area rugs (approximately nine (9) or ten (10) rugs) rolled up and propped up against the back corner of the room. The surveyor also observed four (4) rotating fans sitting on the floor in the same area. The director acknowledged these items and stated, "I know I need to move them".

The surveyors pulled into the facility parking lot at 11:57AM and observed a female adult and a school age male child exit building #2, walk along the sidewalk to the front of building #1 and enter the main entrance of building #1. The female adult was observed carrying a large bowl. The surveyors then got out of their cars to enter the facility. Surveyor #1 entered the main entrance (building #1) while surveyor #2 entered building #2. Surveyor #2 entered building #2 and observed one (1) staff person (hire date: 5/21/15) caring for twenty (20) school age children (the youngest child was identified as a five (5) year old). A few seconds after Surveyor #2 entered building #2, the female adult and school age male child that were observed outside, entered building #2. The female adult identified herself as the second staff person working in building #2 with the school age children; therefore, staff-to-child ratios were not in compliance while the staff person was out of the classroom. Surveyor #2 noted during the visit that the distance the female adult and the male child walked from building #2 to building #1 was approximately eighty-five (85) - ninety-five (95) feet. General: Based on Observation, 1. At 9:37 a.m. four (4) infants were observed in cribs in the Infant classroom. None of the infants were sleeping at that time. The surveyor returned to the Infant classroom at 9:43 a.m. and 9:45 a.m. to find the same children in the cribs and still awake. At 9:45 a.m. a staff person removed one of the children from a crib but the other three (3) children remained in the cribs awake until 9:57 a.m. when the surveyor returned to the classroom. At 10:10 a.m. two (2) of the remaing children in the cribs had fallen asleep and the other child had been removed from the crib. 2. A six (6) month old child arrived in the Infant classroom at 9:57 a.m. The child was asleep in a car seat when he arrived. The child remained in the car seat asleep until 10:12 a.m. when a staff person moved the child to a crib. General: Based on Interview, a one (1) year old child was restrained in a high chair during nap time because he was difficult to get to sleep. General: Based on Observation, the surveyors observed fifteen (15) children and two (2) staff in the two (2) year old classroom. The staff stated they had three (3) one (1) year olds in their group and the oldest child in the group was four (4) years old. Therefore, the classroom was over group size by three (3) children. The surveyor asked if the three (3) one (1) year old children had been with them all day. The staff stated that one (1) of the children had been due to his size. They stated the two (2) other children came over from the toddler classroom at approximately 11:30 in order to maintain ratios in the toddler class. File review found that two (2) children were twenty two (22) months old and one (1) child was twenty one (21) months old. The staff person in charge stated the children had a transition plan on file. However, this documentation was not on file for any of the three (3) children. Furthrmore, no programming was taking place during the classroom observation. For example, the surveyors observed a two (2) year old boy climb up a two (2) tier shelving unit that was at least three (3) feet tall and balance himself on the shelf long enough to grab a CD from the VCR that was positioned on top of a televison. Next, the child ran over to some chairs that were stacked and started climbing on them. While this was occurring a two (2) year old girl attempted to climb on top of a high chair while another girl stood up on a table and grabbed at the surveyor's identifcation badge. Other children were observed running around the classroom. As this was occurring one (1) staff person was changing a diaper and the other staff person was going around getting the children off of furniture and trying to get them ready to line up to go outside. General: Based on Observation, and interview, on 3/31/15 at 8:00 a.m., the surveyor observed a staff person exit the facility. The staff person stood in front of the facility's door and started talking on her cell phone. At 8:02 a.m., the surveyor started walking toward the facility. As the surveyor approached, the staff person turned and immediately went back inside the facility. The surveyor followed the staff person to the pre-school classroom where thirteen (13) children and one (1) staff were observed. During interviews it was noted there were five (5) one year olds in the group; therefore, the staff person had been left alone, was out of ratio and was over group size. Two (2) additional children arrived at 7:59 a.m. Interviews with staff found that all of the children ages infant to school age are combined once they start arriving at 5:30 a.m. until the 8:00 a.m. staff arrive. An interivew with staff also found that from 5:30 a.m.- 7:30 a.m. there is only one (1) staff person present and at 7:30 a.m. an additional staff person arrives. A review of staff time cards found that on 2/2/15 the first staff person clocked in at 5:20 a.m. and another staff person did not clock in until 7:31 a.m. On 2/3/15 the first staff person clocked in at 5:16 a.m. and another staff person did not clock in until 7:37 a.m. A review of attendance sheets documenting the time of arrival and departure of the children found that on 2/2/15 from 5:30 a.m.-6:30 a.m. there were three (3) children ages twenty-three (23) months to ten (10) years old. By 8:00 a.m. there were twenty-four (24) children ages six (6) months to twelve (12) years old. Staff interviews confirmed that all age groups are combined from 5:30 a.m.-8:00 a.m. every morning.

General: Based on interview and review of documentation, children were dropped off on the front porch of Northern Elementary School and left without supervision to wait for the doors of the school to open. On 8/18/14 there were six (6) children dropped off and on 8/19/14 there were five (5) children dropped off. Both days the drop off time was 7:45 AM. There were school staff entering the building but the school does not accept children until 7:55 AM. Therefore, the children were not under the care of a designated adult for the ten (10) minutes they had to wait for the doors of the school to be unlocked.
General: Based on Review of Documentation and interview, this regulatory requirement was not met. A review of a child's medication form in the infant classroom found that the parent requested Tylenol be administered to their child on 6/27/14; however, the directions written by the parent did not include times for the medication to be administered. There was a space on the form labeled "time"; however, it was left blank. The staff person working in the infant classroom stated that the person dropping the child off on 6/27/14 instructed her to give the medication "every 4 hours" and the staff person stated that she administered Tylenol to the children two (2) times on 6/27/14; however, the staff person stated that she did not document when she administered the medication to the child.

General: Based on Interview, the facility failed to meet this regulatory requirement. An interview with staff during the investigation found that one (1) child was sent home with signs/symptoms of ringworm on 7/8/13 and a staff person was also found to have the same signs/symptoms. The child was sent home by the staff person in charge at 11:35AM; however, the staff person was allowed to remain at work. The staff person applied a prescription medication that belonged to another staff person to the infected area; however, the area was not properly covered as she continued to work in the infant classroom. Therefore, she was allowed to perform duties that may allow for the transmission of the disease. The child that was sent home on 7/8/13 returned to the facility on 7/9/13 with a doctor's note stating that the child did not have ringworm.

Based on Observation, interview, and review of documentation the facility was arranging transportation with another child care center even though the center was no longer licensed for the transportation service. The facility's transportation service was revoked effective 4/14/15. Transportation
General: Based on Observation, upon arrival at the facility on 2/3/15 at approximately 7:55 a.m. there were twenty (20) children ages six (6) months old to twelve (12) years old with two (2) staff in one (1) room. Two (2) additional children arrived at 7:59 a.m. At 8:00 a.m. two (2) staff arrived and staff began moving children to their individual classrooms as additional children arrive. Interviews with staff found that all of the children ages infant to school age are combined each day once they start arriving at 5:30 a.m. until the 8:00 a.m. staff arrive. An interivew with staff also found that from 5:30 a.m.- 7:30 a.m. there is only one (1) staff person present and at 7:30 a.m. an additional staff person arrives. A review of staff time cards found that on 2/2/15 the first staff person clocked in at 5:20 a.m. and another staff person did not clock in until 7:31 a.m. A review of attendance sheets documenting the time of arrival and departure of the children found that on 2/2/15 by 7:00 a.m. there were eleven (11) children ages six (6) months to ten (10) years old and only one (1) staff person. A review of the children's documented time of arrival and departure for 2/3/15 found that by 7:00 a.m. there were sixteen (16) children ages six (6) months to ten (10) years old with one (1) staff person. A review of staff time cards found that an additional staff person did not clock in until 7:37 a.m. on 2/3/15. Staff interviews also found that from 5:30 a.m. until 7:30 a.m. it is typical for one (1) staff person to have as many as ten (10) to twelve (12) children ranging from infants to preschool. Based on observation and staff interview it was found that the director failed to assure compliance with the regulations in assuring there is adequate staff to maintain minimum staff- to-child ratios in the morning hours. Interviews, observation and record review found that minimum staff-to-child ratios were not maintained on many occasions in the morning hours. General: Based on Observation, of the infant room there were three (3) infants not placed in cribs to sleep. Two (2) infants were observed sleeping in swings. The staff person in the room stated one of the infants was three (3) months old and one (1) was nine (9) months old and they had been asleep about fifteen (15) minutes. Also, there was a nine (9) month old asleep on the floor with his head on a soft pillow. The staff stated he had been asleep about twenty (20) minutes. Programming

General: Based on Observation, at the time of the visit the children in the two (2) year old room were watching a video on the televison. The video was not part of the planned programming and the staff person in the room did not know the title of the movie being played. Written Documentation
General: Based on interview and review of documentation, on 8/18/14 at 3:42 PM seven (7) children were picked up from Northern Elementary School in a Dodge Grand Caravan. This is a six (6) passenger minivan. The second row of seats has two (2) seat belts. Three (3) children were seated in this row. Two (2) children did not have an individual seat or seat belt but had to share.

General: Based on interview and review of documentation, children were dropped off on the front porch of Northern Elementary School and left without supervision to wait for the doors of the school to open. On 8/18/14 there were six (6) children dropped off and on 8/19/14 there were five (5) children dropped off. Both days the drop off time was 7:45 AM as recorded by the driver. The children then had to wait for ten (10) minutes for the doors of the school to open at 7:55 AM. The van driver stated that there were people entering the building so he assumed the children could also enter the building. He did not wait for the children to be inside the building before driving away. Interview with Northern Elementary School personnel confirmed the doors of the school are not open to receive children until 7:55 AM. Director Requirements

General: Based on interview and review of documentaion on 8/18/14 at 3:42 PM seven (7) children were picked up from Northern Elementary School in a Dodge Grand Caravan. This is a six (6) passenger minivan. Therefore, this vehicle is equipped with only six (6) seatbelts (not including the driver). The driver stated that three (3) children were placed in the second row of seats that is equipped with two (2) seat belts. Two (2) children in this row of seats used the same seat belt.
General: Based on Review of Documentation, it was found that the facility is listing sibling groups on the form used for medical information. It was also found that the file for a child enrolled on 6-20-12 did not contain the name of the parent's preferred hospital.

General: Based on Review of Documentation, from a field trip taken on 6/21/13 the following was found. The facility documented the time children were loaded onto the van at the facility (12:00PM) and the time the children returned to the facility (3:17PM); however, they did not document the times children got on and off the vehicle at the field trip location.

922 KAR 2:120. Section 4. Premises Requirements.
General: Based on Observation, and interview the facility failed to meet this regulatory requirement. Upon arrival the surveyor entered building #2 (school age room) and noticed a strong odor. Staff working in the classroom acknowledged the odor and indicated that it was due to the carpets being cleaned over the weekend and not allowed to properly air out. The staff person in charge stated during interview that she recently became aware of a water leak in the ceiling and indicated that the carpet in this classroom got wet as a result of the leak.
