General: Based on observation, the following was found: Blue Room 1.) There was a bottle of hand sanitizer and a teacher's silver coffee mug accessible to the children in the classroom. These items were sitting on top of a cabinet used for storage in the room. 2.) There were glue sticks accessible to the children in care. The glue sticks contain a warning label to keep out of reach of children under three years of age due to small pieces that could pose a chocking hazard. These were being stored in an unlocked cabinet within the room. Yellow Room 1.) The teacher's desk there contained four (4) tumbler type cups sitting on top of the desk, as well as a container of Clorox disinfectant wipes and a bottle of hand sanitizer. General: Based on Observation, it was found that the hot water faucet of the sink in the bathroom being used by the children was not functioning, therefore hot water was not available for hand washing. Although other bathrooms were present in the facility, the children were only being taken to the one in the classroom.
General: Based on Observation, it was found that a square blue and yellow metal structure was being used for climbing by the children. This structure is surrounded by bushes and does not have an adequate fall zone or protective ground covering. It was also found that a red metal and wood car shaped climber was present on the playground. This climber was elevated on metal springs that were supported by wooden railroad ties. These railroad ties, which were positioned on top of the mulch, spanned the width of the mulched area around the climber. In addition, it was found that the fall zone was not equal to the height of the climber.

Animals 1175 - Animals in the Presence of Children Not Applicable 922 KAR 2:120. Section 13. Animals. (1) An animal shall not be allowed in the presence of a child in care: (a) Unless: 1. The animal is under the supervision and control of an adult; 2. Written parental consent has been obtained; and 3. General: Based on Observation, it was found that the parent and child rights were not posted.
General: Based on Review of Documentation, it was found that two (2) of the three (3) staff working with the children did not have completed criminal records checks on file. All three (3) staff did not have completed central registry checks on file. The staff person in charge stated that the criminal records checks and central registry checks had not yet been submitted.
General: Based on Review of Documentation, it was found that the file for an employee hired on 8-1-13 contained the results of a criminal records check that was submitted on 9-9- 13. This is not within the timeframe required by the regulation. It was also found that two (2) employees hired on 8-19-13 did not have evidence of submission for or the results of criminal records checks on file. An employee hired on 8-1-13 and two (2) employees hired on 8-19-13 did not have evidence of submission for or the results of a central registry check on file. It should be noted that these three (3) adults were the only facility staff working with the children during the survey.
General: Based on Review of Documentation, it was found that the files for two (2) employees hired on 8-19-13 did not contain evidence of a high school diploma, GED or Commonwealth Childcare Credential.
General: Based on Review of Documentation, it was found that the file for an employee hired on 8-1-13 contained the results of a TB skin test that was read on 8-15-13. This is not prior to date of hire as required by the regulation. It was also found that the files for two (2) employees hired on 8-19-13 did not contain evidence of a TB skin test being conducted.
