General: Based on review of documentation, the following was found: 1) A staff (DOH: 09/14/20) had a pediatric abusive head trauma training record on file that exceeded five (5) years and therefore was no longer current. 2) Two (2) staff (DOH: 12/13/24 and 02/01/24) did not complete the required pediatric abusive head trauma training and have been employed for longer than one (1) year. A review of ECE-TRIS confirmed this finding.
General: Based on observation, on the day of inspection, the Preschool Classroom had an area of chipping paint that the drywall chalk was exposed and accessible to the children in care.

During the exit conference, the staff in charge stated the heat/thermostat was not currently working in the classroom for some reason, making the classroom colder than usual. General: Based on observation, the refrigerator used for the storage of children's food in the Tiny Tots Classroom did not have an indicating thermometer to determine the temperature for safe food storage on the day of inspection.
General: Based on observation, this regulation was not met. The surveyor noted 2% milk in the refrigerator that was being served to the preschool children. Per regulatory requirements, children ages two (2) and older are to be served pasteurized unflavored low fat one (1%) percent or fat-free skim milk.
General: Based on interview and review of documentation, there were no attendance records for any of the documented drills.
General: Based on observation, the following was found during inspection: 1) The center failed to conduct/document a fire drill for March of 2026. 2) There was no evidence presented at the time of survey of shelter-in-place drills being conducted at the facility. 3) There was documentation of earthquake, tornado, and lockdown drills on file at the facility for the second (April- June) quarter of 2025; however, they were documented at the same time as the documented fire drill. Each drill conducted requires different times and actions; therefore, must have different times documented. 4) There was no documentation of earthquake, tornado, and lockdown drills for the first quarter (Jan-Mar) of 2026 on file at the facility.

Based on interviews and a review of video footage, it was determined that on 03/18/26, a staff member in the Two-Year-Old Classroom observed a child taking snacks from a peer and responded by swatting/tapping the child’s hand while stating, “No, we don’t take our friends’ food.” Programming In Compliance

General: Based on interviews, documentation, and CCTV video review, a staff member was observed on camera, and later confirmed to the surveyor, taping a child's shoes to the child’s feet to keep them on. In the video, the child can be seen walking back and forth in the classroom with the taped shoes, while the staff member took a photo with her phone, as confirmed in her interview. The photo was sent to other staff members via a group message. It should be noted that another staff member was present in the room and did not alert management when the event occurred. Both staff members were terminated.

General: Based on observation, the Crawlers Room contained a thermometer inside the refrigerator that read forty-nine (49) degrees Fahrenheit. A cold-storage facility shall be forty (40) degrees or below.
General: Based on observation, the bathroom inside the Preschool Room contained an exhaust fan in the ceiling without a cover. The exhaust fan was exposed and contained an accumulation of dust.
General: Based on review of documentation, the following was found: 1. Eleven (11) staff members (DOH: 01/24/24, 04/11/24, 06/04/24, 03/10/25 [x3], 08/09/24, 04/18/24, 02/10/25, 06/17/24, and 03/05/25) did not have a negative TB skin test or statement from a medical professional available for review prior to their date of hire. It should be noted all eleven (11) employees did currently have a negative TB skin test available for review at the time of survey. 2. Two (2) staff members (DOH: 11/18/24 and 03/10/25) did not have a negative TB skin test or statement from a medical professional available for review at the time of survey.

General: Based on observation, interview and review of documentation, the facility failed to provide for the health, safety, and comfort of a child in care. On 02/03/25, a staff member in the Junior Tots alerted administrators that a staff member working in the classroom had inappropriately handled a two-year-old child. A review of the footage from the classroom revealed that a staff member was sitting on the floor with a child on her lap when a second child hit her on the brow with a textured block. The staff member grabbed the child, who had hit her, by his shoulders and yanked him onto the floor, causing the child to hit his head on the toys surrounding them.
General: Based on interview and review of documentation including video footage, the child care center failed to maintain state regulations. During the investigation, the following was found: 1. On 01/21/25 a staff member aggressively pulled a child in care from their seat and removed them from the classroom. This is supported by video evidence and staff interview. Therefore, the health, safety, and comfort of the child in care was compromised. 2. On 01/21/25 a staff in charge overheard a child in care yelling, “I don’t want a whoopin’.” When asked about the issue, the staff member admitted to “taking care” of it. Therefore, the health, safety, and comfort of the child in care was compromised. 3. On 01/21/25 a staff member was observed pulling a child in care through the hallway towards the restrooms aggressively. Therefore, the health, safety, and comfort of the child in care was compromised.
General: Based on interview and review of documentation, the child care center failed to maintain state regulations. On 01/21/25, two (2) staff were working in the PreK One (1) classroom with sixteen (16) children in care. At 3:29 pm one (1) staff member and one (1) child exited the classroom, leaving one (1) staff member with fifteen (15) remaining children. The ages of this classroom range from three to four (3-4) years old, which makes the ratio one (1) teacher to fourteen (14) children, meaning that after the first staff left the room, the remaining staff was out of ratio by one (1) child. This is supported by video evidence and staff interview. The staff member that remained in the classroom estimated she was left alone for approximately two (2) minutes. General: Based on interview and review of documentation, on 05/16/24 a staff member in the Preschool Room grabbed a three-year-old child by the arm. Based on interview, the staff member asked the child to get in line with the other students to go to the gym and the child was not listening so the staff member grabbed the child by the arm. The child sustained fingernail marks on her arm and her arm was bleeding. The video was reviewed from 05/16/24 and it did not show the staff member grab the child's arm because the child was out of camera range, but it did show the child holding her arm as if she were hurt when she got in line with the other children.

General: Based on review of video footage from the one-year-old classroom taken on 06/08/23, and 06/12/23, the following was found: 1) The children were made to sit in chairs and highchairs for approximately six (6) minutes without anything to do before lunch was served. This happened at lunch both days. 2) After the children were finished eating lunch, they were made to sit until staff were finished eating their lunch. This happened both days. Some of the children seated in chairs ended up getting up and dancing around but the three (3) children in highchairs waited with nothing to do for approximately fifteen (15) minutes after they were finished eating lunch. 3) A child was placed in a highchair at 9:33:02, for playing with the edge of a rug. The child was let out of the highchair at 10:43.10. He was in the highchair for approximately one (1) hour ten (10) minutes.
General: Based on review of video footage from the one-year-old classroom taken on 06/08/23, and 06/12/23, the following was found: 1) The diaper changing pad was not cleaned in between each diaper change. The diaper changing pad was only cleaned after all the children's diapers had been changed. 2) A staff member was seen cleaning the highchair trays while the trays were located on top of the changing pad.
General: Based on review of video footage from the one-year-old classroom taken on 06/08/23, and 06/12/23, the following was found: 1) Children were viewed eating each other's pancakes and drinking out of each other's sippy cups while walking around the classroom. 2) A child threw her lunch plate off the table. The staff member picked a piece of the food from the child's plate off the floor and handed it to another child at the table. 3) A child appeared to be finished eating. The staff member picked a piece of food off the child's plate and gave it to another child to eat.

General: Based on observation, the child care center failed to maintain state regulations. During the survey, the following was found: 1.) A bottle of Dr. Pepper Zero was found on a small black shelf in the PreK #2 room, next to the classroom sink, accessible to children in care. 2.) A bag of De-Icer salt was found on the front porch, directly to the left of the front entrance door. The front door is used to access the outside playground, making the bag of De-Icer accessible to children when entering and exiting.
General: Based on observation, the child care center failed to maintain state regulations. During the survey, the following was found: 1.) Red and purple paint on the left wall, near the classroom sink, in the PreK #2 room. 2.) A missing ceiling tile, just above the door, in the bathroom near the Preschool room. 3.) Multiple spots of peeling paint that exposed the drywall underneath, on the right-side wall, in the PreK #1 classroom. 4.) A large, circular brown stain was found on a ceiling tile, just above the toilet, in the hallway bathroom that is at the top of the ramp. General: Based on interview, the following was found: 1) A staff member witnessed another staff member pinch and then squeeze the leg of a two-year-old child because the child did not have her shoes on while she was on the playground. The staff member then aggressively put the child's shoes back on her feet and then slammed the child's legs and feet to the ground. 2) A staff member also witnessed the same staff member jerk another two-year-old child by the upper arm off the bottom of the slide and place him on the ground for coming down the slide on his belly. Both incidents happened within a few minutes of each another and were both reported to the staff person in charge. Both children were checked for any marks/bruising and there were no visible marks/bruising found. Both sets of parents were notified of the incident. General: Based on review of documentation and observation, this regulatory requirement was not met. The following was found: 1. The facility failed to obtain the results of a background check from a previous state of residence for one employee (hire date: 10/8/21) prior to allowing the staff person to work alone with children. A review of this staff person's file during the inspection found New Jersey and South Carolina listed as a previous residence within the past five years. The staff person in charge stated that this was an oversight on her part and indicated that out of state background checks had not been submitted for processing. This staff person was observed caring for seven preschool children alone during the visit. 2. The surveyor toured the facility with the staff person in charge upon arrival and observed one staff person caring for two children in the Jr Tots Classroom (one-tp-two year old's). During the file review, it was found that this staff person was hired on 4/25/22. Her personnel file only contained a packet of background check forms that had been filled out by the staff person and an IdentoGo form. There was no evidence on file that the staff person's fingerprints had been submitted for processing and a review of the Kentucky National Background check service (KARES) supported this finding. The staff person in charge entered the staff person's information in KARES during the visit and provided the surveyor with documentation stating that the staff person's background check was "In Process". During the investigation it was found that a three-year-old child was left alone and unsupervised in the gym for a few minutes on March 16, 2022, at approximately 5:00 pm. On March 16, 2022, the preschool class was transitioning from the gym to the playground. A staff member stated that she was positioned in the front of the line and a second staff person was positioned in the back of the line as they walked to the playground. After they reached the playground, a third staff member brought the three-year-old child outside and told the staff that she had found him alone in the gym. General: Based on interviews, the center failed to maintain the health and safety of the children in care by allowing children to have access to their classrooms during construction on the roof. During the investigation, the surveyor found that the gym, infant, and preschool classrooms were affected for a few days during construction on the roof. Staff stated that they could see the sky through holes in the ceilings and dust and debris on classroom floors and tables. Staff stated that the ceilings were later patched, and staff cleaned their classrooms the best that they could, but dust and debris continued to fall while the children were present in their classrooms. A teacher found the child in the staff workroom playing with sand. The teacher escorted the child to the playground and informed the child's teachers of the incident. General: Based on observation, this regulatory requirement was not met. During a tour of the Tiny Tot's Classroom (one (1) year olds) the surveyor observed a sharp knife lying in the classroom sink along with several dirty dishes. It appeared as though this sink is not used for children's hand washing; however, the children's hand washing sink is positioned right beside the sink with the knife.
General: Based on review of documentation, observation and interview, this regulatory requirement was not met. The surveyor observed eight (8) children present in the Jr. Tots Classroom during the visit. A review of the building diagram obtained during the 1/11/18 change of location inspection found that the classroom was over capacity because seven (7) was noted as being the room capacity. It is important to note that this same diagram was posted in all the classrooms throughout the facility. The staff person in charge stated during interview that she was told that the Jr. Tots Classroom was large enough for eight (8) children and she presented the surveyor with a copy of a Fire Marshal inspection dated 10/23/17. A review of the Fire Marshal inspection revealed that the Jr. Tots Room was listed as a total capacity of eight (8). The surveyor measured the classroom during the visit and found it to be 13' 8" by 20'2" which only provides the minimum thirty-five (35) square feet of space for seven (7) children. General: Based on interviews and review of documentation, the facility failed to notify the cabinet within twenty-four (24) hours of discovery of an injury to a child that required medical attention. Based on interviews, a toddler fell into a chair causing an injury to his forehead and was treated at a physician’s office on 6/27/17. Based on record review, the incident was reported on 6/29/17. Therefore, the cabinet was not notified within the twenty-four (24) hour time-frame. The director reported that she was on vacation during the time of the incident and was unable to notify the cabinet within the twenty-four (24) hour time-frame. General: Based on Observation, the surveyor saw a staff person come around the corner of the hallway and enter the infant classroom. The surveyor went into the classroom and noted there were six (6) infants with two (2) staff. There was only one (1) staff in the infant room with six (6) children when the surveyor saw the staff person in the hallway. The director acknowledged this finding.
General: Based on Observation, there were cigarette butts and paper found on the playground. The director stated that she cleans the playground every morning but trash still gets on the playground.
General: Based on Observation, in several classrooms there were lunch menus posted with a child's name printed on the sheet. Certain foods were marked through on the menus and words like, "no bread", "milk is ok" was printed on the lists. This is considered confidential information for the child. The director stated that she did not understand this regulation and felt if a child could not have a certain food then anyone who walked into the classroom should be aware of this to help prevent a medical emergency. She stated that the parent is the one who completes the lunch sheet and is aware it is posted in the classroom.

General: Based on Interview, it was found that the classrooms do not consistently maintain the required staff to child ratio at nap time. The staff are premitted to take lunch breaks during nap time leaving one (1) staff person in the room. It was found that a staff person had been left with fourteen (14) two (2) year old and a staff person had been left with eight (8) one (1) year olds. The staff take breaks that are thirty (30) minutes or one (1) hour based on the number of hours the staff person works. Programming
General: Based on Observation, there were brownish spots or stains on the carpet in the Tiny Tots room. Based on interview there had once been mold in a near by area of the carpet. The carpet had been cleaned but the brown spots remained. Also, the gym ceiling had areas where there were holes in the plaster. The staff person in charge stated the plaster had recently been scraped because there had been water damage but the finish wasn't going to be completed until spring to ensure the roof no longer leaked. The walls also had unpainted areas. The staff person in charge stated that these things were cited during a relicensure visit and the plan of correction submitted stated that the repairs would be completed by the end of May 2014.

There are fourteen (14) children enrolled in this group, some part time, and four (4) are two (2) years old and the rest are one (1) year old. General: Based on Observation, the facility failed to ensure that medication be kept in the original bottle and properly labeled. In the Tiny Tots classroom, an Epi Pen was observed in a locked box inside a teacher cabinet. The Epi Pen was not in the original box, or labeled with a prescription or name. In the infant classroom, a bottle of Benadryl was observed in a locked box inside a cabinet. General: Based on Observation, the facility failed to ensure that an infant or toddler aged child shall participate in an activity with an older child for no more than one (1) hour per day. At the time of survey, two (2) two-year old children were observed participating in an activity with six (6) one-year old children. The oldest child in the classroom was two (2) years and one (1) month old. The youngest child in the classroom was eighteen (18) months old. The staff member in the classroom reported that the two-year old children are always in the classroom with the one-year old children. The staff member also reported that the two-year old children were not scheduled to transition into the two-year old classroom until May 2014.
General: Based on Review of Documentation, and interview it was found that the facility employed a person that was found by the cabinet to have neglected a child, pursuant to 922 KAR 1:470. Following the Division of Regulated Child Care's receipt of a child abuse and neglect check submitted by this facility for an employee a phone interview was conducted with the director. During this interview it was confirmed that this individual was employed by the facility. The director also confirmed that she had a copy of the child abuse and neglect check that identified the substantiation but had not realized there was a substantiated finding marked on the report. The director indicated that the individual listed on the child abuse and neglect check was hired in February but only worked a couple of days due to a family emergency. During the brief time the person worked she was under the supervision of another qualified teacher. The director went on to indicate that the individual had also worked on April 29, 2013 and May 3, 2013.

General: Based on review of video footage from 06/08/23, and 06/12/23, in the one-year-old classroom, the following was found: 1) Children were viewed sitting, standing, jumping, and lying on top of the child size tables in the classroom while staff were using their phones; in many instances staff just sat in chairs across the room and casually watched the children. 2) Two (2) children were smacking/fighting with one another while a staff member watched. The staff member said something to one (1) of the children and then pushed that child towards the other child he was fighting as if encouraging it. The child swung at the other child and one (1) of them fell down. The staff member stood the child back up and pushed the child towards the other child again. The staff member kept doing this until one (1) of the children ran off. At no point did the staff member try and stop the fighting. 3) Children were viewed multiple times hitting, biting, smacking, kicking, and pushing one another while staff did nothing about it. 4) A child was seen hanging from the sink by her fingers and she fell backwards, landing on her bottom on the linoleum floor. A staff member just laughed and did nothing to assist the child. The heater placement poses a safety risk to the children in the classroom. 6) A staff member put a piece of food in her mouth; the staff member then took the food out of her mouth and put it in a child's mouth. This happened more than once. 7) A staff member took off her shoe (she was not wearing socks) and touched a child's face with her foot. 8) After changing a child's diaper, the staff member initially picked up the child under each arm; as the staff member was placing him on the floor, she had only one (1) hand around the child's elbow by the time his feet hit the ground. The child cried, ran over to the other staff member, and pointed to his arm. The staff member was using her phone and did nothing to assist the child. 9) The heater placed on the floor was plugged into an outlet that was located high on the wall. Two (2) children were seen running around the heater and under the cord while one (1) staff was using her phone and the other staff was out of the classroom. 10) Two (2) children were wrestling on the floor. A staff member walked up to the child that was on top of the other child, grabbed the child's shirt with one (1) hand, grabbed the child's pants with the other hand, lifted the child off the other child, and placed the child on her stomach on the floor. 11) A staff member picked up a baby doll, aggressively threw the doll against the wall, and then appeared to say something to the children. Some of the children were later observed throwing dolls and toys against the wall. 12) A staff member was viewed pulling a child up from the floor by the collar of his shirt. 13) A staff member walked over near the classroom door and lifted a child up by the left arm, causing him to fall. 14) A staff member took a child by the arm and pushed her towards the other staff member who was vacuuming. The child appeared to be scared of the vacuum, but the staff member held the child’s hand. The other staff member hit the child’s feet with the vacuum while the child was trying to get away. Then the staff member started chasing the child around the room with the vacuum. Both staff were laughing, and the child was crying. When the staff member finished vacuuming, she grabbed the child by the hand and made her walk with her out of the classroom while the staff pushed the vacuum. he child seemed to be very hesitant to go with the staff member. 15) A staff member called for a child to come over to where she was sitting. The staff member turned the child around, so his back was to her stomach. While the child was standing, the staff member wrapped her legs around the child's legs, held his hands by the wrists above his head with one (1) of her hands, and took her fist and tapped it on the child's belly. The staff member then took both of the child's arms and crossed them behind his head, holding them there. This went on for approximately one (1) minute. 16) On more than one (1) occasion, a staff person motioned as if she were going to hit a child with her hand but then did not. 17) A staff member was seated on the floor asked a child to come over to her. When the child was approximately two (2) feet away from her, she yanked the child by the front of her shirt and pulled her to the ground in order to put the child’s shoes on her feet. 18) While a staff member was vacuuming, she appeared to deliberately bump into a child more than once, causing the child to fall over onto her hands and bump her face on the front of the vacuum. 19) A child was lying on the floor and a staff member seated in a chair looked over at the child and kicked the child on the leg with her foot. 20) A staff member walked over and flicked a child on top of her head with her fingers for no apparent reason. 21) A child kicked a ball towards a staff member. The staff member picked up the ball and threw it at the child, hitting the child on the front of her body. 22) A child was lying on a pillow when a staff member jerked the pillow out from under her, causing her to topple over onto the ground. 23) A staff member appeared to say something to a child and then walked up to her and kicked the child in the butt/backside with her foot. 24) A child was teetering around after just getting up from nap. A staff member walked up to the child and pushed the child out of the way. The child fell down to the floor. The staff member did nothing and walked away. 25) A staff member swatted a child on the head with her hand for no reason. 26) A staff member flicked two (2) children on their ear for apparently no reason. The children immediately grabbed the side of his/her head. 27) A staff member hit a child on the head with a plastic bin. This is the same child who fell, hitting his head against the wall. 28) A staff member was sitting on the floor when a child ran up to the staff member. The staff member shoved the child away with her hand. 29) A staff member walked over to a child and pushed the child on the bottom with her shoe, causing the child to stumble. 30) A parent was seen picking up a child for the day. A staff member was hugging and kissing on another child in front of the parent. As soon as the parent left, the staff member smacked the child on the bottom with her hand. 31) A staff member and a child appeared to be arguing. The staff member and the child were both saying something, waving their arms, and shaking their heads. 32) A staff member walked over to a child, stood over him, and then flicked/pinched him on his ear. The child grabbed his ear. 33) A staff member pushed a child’s head to the ground more than once while they were both seated on the floor. 34) A child walked past a staff member seated in a chair. The staff member flicked her finger to the side of the child’s head and then threw a block at her twice. The staff member then pointed a finger at her and appeared to say something to her before throwing a block at her again. 35) A staff member was viewed combing multiple children's hair with the same comb. 36) The children were allowed to leave their shoes off all day and run around in their socks/bare feet. Children were seen walking around holding their shoes, putting the shoes in their mouths, and even hitting children with the shoes. Children's shoes should remain on at all times in case there is an evacuation of the building. 37) A staff member was seen sitting on top of one of the child size tables with her legs crossed and shoes touching the table. This is not a sanitary practice. 38) A staff member lifted a child up from a cot by the arm and placed the child on the floor. 39) A staff member was sitting on top of the child size table while the children were eating their lunch. 40) Both staff members lay in between children during nap time. The lights in the room were turned off but the staff members were using their phones and the light from their screens shone directly on the children that were lying beside of them. The staff member grabbed the back of a chair, stuck out her bottom, and started shaking it in front of a child. 43) A staff member walked over quickly to where a child was seated for lunch, jerked the child out of the chair by the arm before walking her over to the changing table and aggressively placing the child on the changing pad. 44) A staff member was seen taking both of her hands to either side of a one-year-old child's face and squeezing the child's cheeks together. The child grabbed both of the staff's arms with her hands. The staff tried to get her arms free from the child's grasp, causing the child to fall down. The child got up; the staff member swatted the child on the bottom with her open hand and then appeared to tickle the child. 45) A staff member was seen taking a child's shoe and hitting the child on the leg with the shoe. 46) Staff are viewed multiple times throwing foam blocks at the children, often hitting them on the head, back, or other parts of their bodies. 47) A staff member seated in a chair leaned over and flicked a child on the head with her fingers. The child was just sitting on the floor. The same staff then picked up a ball and threw it towards the child she had just flicked but missed the child; instead, it hit another child on the shoulder. 48) A staff member stood up and threw a foam block, hitting a child on the head. The staff member then motioned for the child to come over to her. The staff member placed her hands on the child's hips, lifted the child up, flipped the child completely over, and the the child landed on the staff's shoulders. The child's bottom was resting on the staff's shoulders with his torso and legs straight out. The child started to squirm. The staff member kept the child in this position for approximately thirteen (13) seconds. 49) Two (2) children were standing with their hands on the ground, heads down, and bottoms up in the air. A staff member came up to the first child, took her foot between the child's legs, and flipped the child completely over causing the child to land on her back. The staff member walked over to the second child and did the same exact thing. The staff member then sat down in a chair, stuck her foot out, and flipped the first child over again the same exact way. Both children appeared stunned. 50) A staff member was on the floor with a child to put on the child’s shoes. The staff member jerked the child by the ankles to get the child closer to the staff member. The staff member then pulled the child up by the elbow and pushed the child away. 51) A staff member was sitting on the floor and a child was approximately two (2) feet away from her when the child began to turn to walk away. The staff member grabbed the child by the shirt aggressively, pulled her to the ground, looked the child straight in the face, and said something to her. 52) A child picked up a toy and a staff member jerked it out of her hand. 53) A staff member was seated with a child standing at her legs facing the staff member. The staff member wrapped both of her hands around the child’s neck and then leaned toward the child’s face. 54) Two (2) staff in the one-year-old classroom were observed sitting in chairs, using their phones multiple times while not directly supervising the children and ignoring children when they would walk up to the staff. Children were sitting/standing on tables, aggressively hitting one another, and walking out of the classroom while both staff were using their phones.
General: Based on review of video footage from the one-year-old classroom taken on 06/08/23, and 06/12/23, the following was found: 1) During a diaper change, a staff member was viewed wiping a child's nose with a tissue and then continuing with the diaper change. The staff member did not wash her hands prior to wiping the child's nose. 2) Staff never washed their hands in between each diaper change. 3) Staff never washed their hands prior to feeding children food. 4) A staff member was seen wiping a child's nose but did not wash her hands afterwards. 5) A staff member was eating something out of a yellow bag while seated on the floor. The staff member used her fingers to eat the food. The staff member was seen using those same fingers to give some of the food to some children in the classroom to eat.
General: : Based on review of video footage from the one-year-old classroom taken on 06/08/23 and 06/12/23, the following was found: 1) There were two (2) staff present and there was no programming, no positive interaction, or structured activities completed with any of the children on 06/08/23. The two (2) staff mainly looked at their phones, walked in and out of the classroom, let the children run and do whatever they wanted the entire time they were in the room. 2) The bookshelf was completely turned around and the children did not have access to any of the books. 3) There were some blocks, baby dolls, and what appeared to be dinosaurs for the children to play with the entire day. 4) On 06/12/23, the staff were observed completing two (2) art projects but the rest of the day the children were again allowed to run and play with the same toys they had on 06/08/23. 5) Children were turning over their sippy cups, spilling the liquid; they then wiped their hands through the liquid and licked it up off the table while staff were seated using their phones.
General: Based on review of video footage from the one-year-old classroom taken on 06/08/23, and 06/12/23, the following was found: 1) On more than one (1) occasion, the children were reaching up towards the food tray that was on a high shelf appearing to want more food while staff sat in their chairs using their phones not attending to the children's needs. 2) A child appeared to want more snack but the two (2) staff just kept eating their food and appeared to be taunting the child. 3) The staff member took what appeared to be half of a granola bar and held it up in the air. The children had their hands in the air appearing to want the granola bar. The staff member then threw the granola bar in the air and it fell to the floor. The children fought over the granola bar.

The child size chairs were only brought out at lunch time and then immediately stacked back up and not for use. General: Based on review of video footage from the one-year-old classroom taken on 06/08/23, and 06/12/23, the following was found: 1) On multiple occasions both staff were viewed standing at the open classroom doorway with their backs to the children in the classroom while looking out into the hallway. 2) A child tripped over his own feet and fell onto the wall, hitting his head. The child got up and appeared to be crying, holding his head. One (1) staff was cleaning out the highchairs across the room from where the child fell and the other staff was not in the classroom. There was one (1) staff present with nine (9) one-year-old children when the incident occurred. 3) Five (5) children can be seen coming into the classroom alone and the staff member can barely be seen at the edge of the classroom door. Then the staff member completely went out of view and the children were left alone in the classroom for approximately one (1) minute. 4) Several children were playing behind the changing table where the plastic cots are stored. They were lifting the edge of a cot up and down and one of the children ended up smashing a finger. Both staff were seated across the other side of the room not supervising the children at all. The child that got his hand smashed ran up to one (1) of the staff members crying and holding his hand. The staff member said something and just laughed. 5) A staff member exited the classroom at 9:13:17, leaving the class out of ratio. Then the second staff person left the classroom at 9:15:19, leaving the classroom without any adult supervision. One (1) staff returned at 9:16:05, and the second staff person returned at 9:16:25. The staff member had her back to the child on the changing pad the entire time she was fixing the vacuum. The staff member then walked back to the changing pad. The child was left unattended for approximately two (2) minutes on the changing pad. The second staff person was not in the classroom when this occurred. 3) A staff member was changing a child's diaper when she walked several steps away; she stretched and then went back to the changing pad. A staff member jerked up the bin, hit the child in the chest and left arm with the bin, and then placed the bin on the shelf. The child went up to the staff member who pushed the child away and slapped the child's left hand. The staff member then picked up a foam block and threw it at the child's head. The child grabbed her head and fell to the floor with her face on the carpet. While the child was on the floor two (2) other children began to climb over the child, falling, etc. The staff member reached over and smacked both of those children on their heads with her hand. The child grabbed his head. 5) A staff member used her hand and spanked a child on the bottom for sitting in the adult size chair. The child then smacked the staff member on the hand with her hand. The staff member grabbed the child's hand, swatted it away, again grabbed the child's hand, placed it on the seat of the chair, and then sat on the child's hand. The staff member sat on the child's hand for approximately three (3) seconds and then laughed at the child. 6) A child was walking around with a plastic bin on top of his head. A staff member snatched the bin off the child's head and smacked him on the head with her hand. 7) A child took another child's sippy cup. A staff member gave the cup back to the other child and then kicked the child on the bottom with her foot. 8) A staff member flicked a child on the ear for spilling his drink and the child grabbed his ear. The staff member then came back again, flicked the child's ear a second time, and then hit him on the back of the head. 9) A child walked up to a staff member and appeared to hit the staff member on the leg with her hand. The staff member was changing a diaper, so she reached out with her foot and kicked the child. The staff member then poked the child on the face three (3) times with her finger, causing the child's head to go backwards each time. The same child then climbed on top of a play kitchen and the staff member smacked the child's forehead with her hand. 10) A child reached for a Ziplock bag that was on the floor during an art project and a staff member used her hand to smack the child on top of his hand. 11) A staff member smacked a child twice on the head with her hand for spilling the liquid out of his sippy cup onto the table. 12) A staff member was using her phone and looked up to see a child take another child's sippy cup. The staff member walked over and pushed the child with her foot. 13) A child had scooted a pen that was on top of a shelf. A staff member saw this and smacked him on the back of the head with her hand. 14) A child pushed another child; a staff member pushed the child in the chest and knocked him down. The child got up and walked over to the staff member. The staff member gave the child a hug. 15) A staff member saw two (2) children on top of the cots, so she walked over to them and smacked them on top of the head with her hand. 16) Two (2) children were standing on top of a table. A staff member took a new roll of paper towels and hit one (1) child on top of the head with the paper towels, flicked him on the ear, and then took the paper towels and smacked the other child on the face causing him to fall down. 17) A child was standing next to a staff member who was seated in a chair; the child wiped his nose with his hand and then wiped his hand on the staff's pant leg. The staff member initially grabbed the child's arm and then let go of his arm; the staff member then grabbed the child's shirt and wiped the substance off of her leg with the child's shirt. 18) A child was standing on the step at the sink; a staff member got the child down and smacked him on the bottom with her hand. 19) A child finished lunch, got up from the table, picked his chair up, and began to walk away with the chair. A staff member immediately jerked him all the way around by the arm, grabbed the chair, and forcefully placed him on the chair at the table. 20) Two (2) children knocked over the play kitchen and it landed on top of another child. The staff member walked over and used her hand to spank one (1) of the children twice on the upper part of her leg/bottom area. 21) A child was seen turning his sippy cup upside down and spilling the contents. A staff member was using her phone but looked up, walked over to the child, and popped him in the head with her hand. This is the same child who had fallen earlier and hit his head on the wall. 22) A child was placed in a highchair with nothing to do for six (6) minutes. It could not be determined what the child did prior to this discipline. 23) A staff member walked over to a child who was playing with the adult vacuum and flicked the child on the ear with her fingers. The child slumped down to the floor and appeared to be crying. 24) A child sneezed while standing directly in front of a staff member who was seated on a chair. The staff member was visibly angry, jerked the child around by the upper part of his arm, and moved him away from her. 25) A staff member grabbed one (1) of the children for hitting, took the child over to the carpeted area, placed the child on his stomach, pushed the child’s torso down with her hand, and then pushed the child’s head onto the carpet with her hand. 26) Two (2) children kept hitting another child and the staff just watched. Finally, one (1) of the staff members got up and chased after the two (2) children. The staff member got one (1) of them behind the changing table, leaned down over the child (completely out of camera view), and did something to the child; when the child came out from behind the table, he was crying and visibly upset. The staff member then did the same to the other child. One (1) of the children ran over to the other staff member, crying and showing the staff member his hand, but the staff member did nothing. 27) A staff member flicked a child’s ear for flipping up the edge of the rug. The staff member then flicked another child’s ear and that child appeared to have done nothing. 28) A staff member randomly walked up to a child, flicked him on the ear and smacked him on the back. The child grabbed his ear and then appeared to try and flick another child on the ear. A staff member saw this and made him sit in time out. 29) At 8:59:52, a child was in a highchair for an unknown reason. The child was let out of the highchair at 9:22:17. The child had nothing to play with and no activity was provided during that time. The child was in the highchair for approximately twenty-three (23) minutes. This was the second time this child had been placed in the highchair. 30) A staff member was using the facility's iPad and the other staff member had left the classroom while two (2) children were fighting over the tray that went to a highchair. One (1) child appeared to bite the hand of the other child who then appeared to cry out. The staff member stood up, walked over to the biter, stood directly in front of him (blocking him completely from the camera), leaned over him, and did something to him more than once. When she was finished, she moved out of the way and the child was very upset and crying. 31) Right before nap time, two (2) children were playing with the sheets that were on their cots. A staff member walked over to them and one (1) of the children automatically put his hand to the side of his head as if protecting his ears, but the staff member still flicked both children on the ear. The staff member walked away, and children resumed playing with their sheets. The staff member came back over and flicked them on the ear/head area again. They grabbed their ears afterwards. The staff member then aggressively grabbed one (1) of the children’s legs and flipped the child over while he was seated on his cot; she then did the same thing to the other child. The staff member then threw the children's bedding over them and smacked both children on top of the head. The same staff member then walked over to another child and aggressively put that child down on her stomach on her cot; the other staff member threw a large square pillow at the child’s head. Then a staff member walked by a child who was seated up on her knees and she flicked the child on the ear. The child immediately lay down on her cot. The staff member then picked up a foam block and threw it at the child but missed her. The staff member picked up the block again and threw it close range and hit the child on the face. The child grabbed her face; the staff member grabbed the block again and hit the child on the back of the head with the block. 34) Two (2) children were seen trying to climb a bookshelf while both staff are using their phones. While seated, one (1) staff member looked up and threw two (2) blocks across the room in the children's direction trying to get them down. 35) Two (2) children were wrestling with a toy; a staff member grabbed one (1) of the children and stood in front of him (could not see the child on video), looked around as if to see if anyone were looking, and did something to the child. The staff member took the child by the hand and sat him on the floor next to a bookshelf. The child was crying and grabbed his lower back. 36) A child was placed back in the highchair again for possibly biting another child. He was in the highchair for approximately eight (8) minutes. The staff member handed him a dinosaur to hold. This was the fourth time this child had been placed in a highchair. 37) A child swatted at a child in a highchair with his hand; a staff member saw this and slapped the child on the head. The surveyor toured the facility with the staff person in charge upon arrival and observed one staff person caring for two children alone in the Jr Tots Classroom (one-to-two-year old's). During the file review, it was found that this staff person was hired on 4/25/22. Her personnel file only contained a packet of background check forms that had been filled out by the staff person and an IdentoGo form. There was no evidence on file that the staff person's fingerprints had been submitted for processing and a review of the Kentucky National Background check service (KARES) supported this finding. General: Based on Review of Documentation and interview, this regulatory requirement was not met. A review of the 4/25/16 facility attendance records found that six (6) children had an arrival time documented; however, did not have a departure time. Also, three (3) children had a departure time documented, but did not have an arrival time. The staff person in charge stated that sometimes their parents forget.
General: Based on Review of Documentation, one (1) staff did not have a professional development plan on file. The staff was hired on 7/1/89. The director indicated that it was on her to do list.
General: Based on Observation, the facility failed to maintain adequate supervision at all times by a qualified staff person who ensures each child is within scope of vision and range of voice. At the time of survey, a four (4) year old child enrolled in the Pre-Kindergarten One (1) classroom, was observed in the toilet room unsupervised. The toilet room is located outside of the classroom, directly left of the classroom. While the child was in the toilet room, the child was not within the range of vision of the staff member. The child was unsupervised in the toilet room for approximately two (2) minutes. The door to both the classroom and toilet room were open, however, the staff member was not within scope of vision while standing inside the classroom.
General: Based on Observation, the facility failed to maintain that all toys, equipment, and furniture contacted by a child shall be kept clean and in good repair. In the Jr. Tots classroom, two (2) shelves located in the library were observed to be in poor repair. The backs of the shelves were loose and not secured to the sides of the shelves. A clear, plastic tape had been placed along the connecting sides of the shelf to the back. The plastic tape had become frayed, and the back of the shelf was loose. In the Gymnasium area, three (3) tricycles were observed with missing pedals. In the Tiny Tots classroom, three (3) high chairs were observed against the wall. The high chairs did not have straps in the seats. The staff member reported that they use the high chairs to feed the toddler aged children during meal service. The staff member reported that the straps had been removed from the high chairs. In the infant classroom, two (2) high chairs were observed without straps. One (1) of the high chairs in the infant classroom was in use by an infant aged child. The child was not strapped into the high chair. The staff member reported that the straps of the high chair had been removed.
General: Based on Review of Documentation, one (1) staff person (hire date: 1/20/14) had a criminal records check (CRC) that was dated 1/30/14 and another staff person (hire date: 2/20/14) had a CRC that was dated 3/19/14. There was no documentation to verify that the criminal records checks were submitted within the regulatory timeframe.
General: Based on Review of Documentation, the facility currently has three (3) children who receive child care subsidy. However, the facility was not using the required sheet to document each child's time of arrival and departure.

Three (3) staff files (hire dates: 2/14/13, 2/4/13 and 7/1/13) did not contain evidence of the six (6) hours of cabinet-approved training being completed within the first three (3) months of employment. 2. General: Based on Observation, the facility failed to ensure the walls of the building is smooth, in good repair, and constructed to be easily cleaned. At the time of survey, an excessive amount of chipped paint was observed in the following locations: along the baseboard under the calendar in the Jr. Tots classroom, on the wall to the right of the yellow door in the Busy Bees classroom, along the blue baseboard behind the swings in the Infant classroom, along the red baseboard in the block area of the Pre-Kindergarten One (1) classroom, at the window ledge of three (3) windows in the Gymnasium, at the window ledge of two (2) windows in the back of the Preschool classroom, along the baseboard in the toilet room located in the Pre-Kindergarten two (2) classroom. At the time of survey, pieces of drywall were observed damaged and flaking in the following areas of the facility: behind the dramatic play area in the Jr. Tots classroom, along the metal trim in the toilet room of the Prekindergarten two (2) classroom, and at the end of the Gymnasium below the basketball goal.
General: Based on Observation, the facility failed to ensure that the handwashing sink in the preschool classroom be equipped with liquid soap, a hand drying blower or single use disposable hand drying material.
General: Based on Observation, the facility failed to ensure that toilet training chairs used, be kept out of of reach of other toilets or toilet training chairs and be sanitized after each use. In the Busy Bees classroom, two (2) toilet training chairs were located on the floor, in front of the toilet. The space between the training chairs was approximately four (4) inches. The staff member in the classroom reported that the training chairs are sprayed with soapy water mixture, and then wiped with a paper towel between uses. The staff member also reported that the training chairs are only sanitized at the end of the day. In the Preschool classroom, two (2) toilet chairs were observed on the floor by the toilet in the toilet room. The training chairs were stored across from each other, with approximately six (6) inches of space between the chairs and the toilet. The staff member stated that the toilet chairs are cleaned with soap and water in between uses, however, did not state if the chairs are sanitized. In both the Busy Bees and Preschool classroom, the training chairs were stored within reach of another toilet chair and toilet.
General: Based on Observation, the facility failed to obtain a written request from the child’s parent to administer medication in an Epi Pen form for a child enrolled in the Tiny Tots classroom. The staff member reported that the Epi Pen is for a child with a life threatening allergy but had not been used. The Epi Pen was located in a locked box inside a cabinet in the classroom.
General: Based on Interview, the facility failed to ensure compliance with a food service permit. In the infant classroom, the staff member reported that the microwave is used to heat baby food for the infant aged children. The facility did not obtain a food service permit that would allow the facility to heat food.
General: Based on Observation, the facility failed to ensure eating and drinking utensils be kept clean and sanitary. At the time of survey, two (2) sippy cups and three (3) spoons were observed in a single compartment sink in the infant classroom. The staff member in the classroom reported that they wash the dishes used by the children in the single compartment sink. The staff member also reported that the sink is sometimes shared as a hand washing sink and is not sanitized in between uses. The staff member reported that the dishes used by children enrolled in the facility are washed with soap and water, but are not sanitized.

General: Based on Review of Documentation, two (2) eligible staff did not have evidence of a professional development plan on file in the facility.

The rates and services were posted down behind the counter where the front desk is located. It was also found that the facility had received a civil penalty in January 2014. General: Based on Observation, Based on observation an uncovered outlet was observed in the home living area in the Busy Bees room.
General: Based on Observation, a play pen/play yard was observed in the Tiny Tots room. An interview with staff found that the play pen/play yard is used to place a child who has bitten another child. The child only placed in the play pen/play yard for a "few seconds". Time out is not age appropriate for children under the age of two (2) years old. Based on observation it was found there was not a daily planned program of activities posted in the infant room.
General: Based on Observation, Based on observation during a tour of the preschool room numeorus areas of chipping and peeling paint were observed on the walls in the dramatic play area and the book center.
