General: Based on interview and review of documentation, on 12/23/25 at approximately 11:50 a.m. in the Twos Classroom, a two (2)-year-old child had a finger become caught in a hole in a table leg. The staff member in the room was unable to remove the child’s finger and requested assistance. The staff person in charge responded and was able to free the child’s finger by gently moving it and pulling it out. The child sustained scraped skin to the finger. This was the second similar incident, as on 07/18/25 at approximately 3:15 p.m., another two (2)-year-old child had a finger become caught in a hole in a table leg and also sustained scraped skin. General: Based on interview, a staff member stated that he drove his personal 2019 Dodge Ram pickup truck for about a week to transport children to the facility in the afternoon while the child care center's van was being repaired. The staff member could not remember the exact dates but indicated that he picked up children from Maxwell Elementary and Cardinal Valley Elementary after school in his personal vehicle. These children were then transported to the center. The Division of Regulated Child Care was not notified that the center was using a 2019 Dodge Ram pickup truck to transport the children in January of 2023. Prior to transporting a child, the facility shall notify the cabinet in writing of the type of vehicle used for transportation.

General: Based on interview and review of documentation during an investigation with DCBS and the Crimes Against Children Unit of the Police Department, a staff member at the child care center was listed as a perpetrator in a sexual abuse case regarding two (2) school-age children. It was alleged that the two (2) children were touched in an inappropriate way while being transported from their elementary school to the child care center in the staff member's vehicle. DCBS determined that this staff member will be issued a substantiation for the threat of sexual abuse. The Toddler 1 Room contained a drawer next to the hand washing sink that was missing the front facing of the drawer. 3. The outdoor play area contained a blue rocking horse without handles and a hole in the top of the apparatus. The hole in the top exposed an area of sharp plastic. 4. The outdoor play area contained a yellow ball catcher that was no longer attached to the pole. The ball catcher was sitting next to the metal pole upside down in the middle of the outdoor play space. 5. A broken green plastic tub was sitting next to the building in the outdoor play area. The tub contained sharp broken pieces of plastic. 6. A plastic purple crawl through tunnel was located upside down in the outdoor play area with a broken yellow metal pole inside it, and a discarded piece of plastic that appeared to be a wall for an outdoor playhouse. During this investigation it was determined that a child was tripped while walking by a teacher. As a result of being tripped the child fell into a table in the classroom. When the child fell into the table his sweater was ripped and the child recieved two (2) wounds on his side. The teacher did not console the child in anyway, but stated that she did not intentionally trip the child and eyes were closed when she stuck her leg out. It is important to note that the teacher was terminated after this incident.

General: Based on interviews, it was revealed that a six (6) year old male had a toileting accident during naptime. It was revealed that instead of giving the child dry clothes, a “pull- up” and his sister’s blanket was put on him instead. Interviews revealed that the facility did not have any clothes available for the child. A staff person reported that he had put the “pull-up” on the child at approximately 3:15 p.m. and said that the child remained in the “pull-up” until his mother arrived which was approximately 5:30 p.m. Interviews revealed that after the child entered the classroom he was told to close his legs because “his diaper was showing” and was called “pee, pee boy” repeatedly. The Director stated that some of the child’s classmates had also got a tutu from the dramatic play area and gave it to him. It was reported that the child was upset by having to wear the “pull-up” and upset by the name calling. In short, it is developmentally inappropriate to put a “pull-up” on a school-age child after having a bathroom accident. The staff put the child in a humiliating situation that was demeaning and subjected the child to ridicule. General: Based on interviews on 6/15/17, the Director informed the surveyor that she had personally interviewed some of the children in regards to an ongoing complaint investigation that involved a staff member and wanted to offer more insight into the situation. The surveyor informed the Director that she was impeding the investigation by interviewing the children involved in the investigation. The Director indicated that as the owner of the day care, she always conducts her own investigations so that she can “correct the children”. On 6/19/17, it was also revealed that the Director had spoken to the parent of the child involved in the investigation. The parent informed the surveyor that the Director told her that she had spoken to the children and had made them apologize to her son. It is important to note that the Director spoke to the children and to a parent before the surveyor and DCBS representative had a chance to conduct interviews with them. General: Based on Observation and interview, the facility failed to cooperate with the state agency during an investigation of an alleged complaint. On 1/18/17 the DRCC office received an allegation involving a preschool male child exiting the facility at the same time as an adult female; however, the date of the incident was not identified. It was reported that the staff at the facility did not know that the child went outside with the adult female until she walked the child back into the facility. It was reported that the child's mother works at the facility and a description of the mother was provided. On 2/1/17 an investigation was conducted at the facility and interviews were conducted with staff. Administrative staff present at the facility identifed the staff person and child that were described in the allegation; however, they stated that they were not aware of an incident such as the one described occurring. The staff person identified as the parent of the preschool child described an incident that occurred at the facility that was similar to the allegation; however, was unable to identify the specific date the incident occurred. The staff person stated that the incident occurred, "Approximately two (2) weeks ago" and she identified the time of the incident as, "A little after 5:00PM". On 2/6/17 the surveyor received a phone call from the owner of the facility. It is important to note that the owner was not present at the facility during the 2/1/17 investigation. The owner stated during the phone call , "I suspended the staff person that you interviewed on 2/1/17 because she lied to you". On 2/7/17 the surveyor made an unannounced visit to the facility and was greeted by the owner. The surveyor explained that the purpose of the visit was to view a few random dates of video surveillance footage during the afternoon transition time in the front classroom (two (2) year old room) in an attempt to determine if the incident described in the allegation and by a staff person occurred. The owner stated, "I don't have the ability to view past video anymore". The surveyor requested the owner to demonstrate on the system that this was not an option and/or provide documentation from the company that provides the service of the change because the DRCC office has viewed video surveillance footage from previous dates in the past at the facility. The owner refused and stated, "I'm paying an attorney $700 a month and he has discussed with me that the video belongs to me. I will not give you an answer on this until after I talk to my attorney". On 2/8/17 the owner sent an email to the surveyor stating that she spoke with her attorney and he advised her not to show the video to anyone without a court order. General: Based on Observation, at the time of the visit the staff person in the two (2) year old room opened the classroom door and three (3) of the children left the room and went down the hallway. The staff person was standing in the doorway and was attempting to get the children together to take them down the hall to the bathroom. The staff person called for the children to come back because not all of the children in the room were ready. All but one (1) of the children returned back to the room. The child who did not return turned the corner and was found sitting on the floor against the wall by the bathroom. There were no adults in the area where the child was sitting. The child could not be seen from doorway of the classroom. The staff person remained in the doorway of the classroom with the other children in the room. The staff person then took the children down the hallway to the bathroom. The child was left unsupervised for approximately one (1) minute. An interview with the staff person found that there were some of the children in the room that were still wanting to play with toys and not put them away when the door was opened to go to the bathroom. It was observed on the video that the twelve (12) year-old moved a toy away from the three (3) year-old child with her foot as well as placing her foot on top of the three (3) year-old child's stomach. After the 12 year-old removes her foot from on top of the three (3) year-old hearing impaired child, the child lays on the floor very still for a few moments before she gets up and goes to the teacher in the room. In addition, the twelve (12) year-old child puts another child in her lap (a 2 year-old) and places her legs around this child. The twelve (12) year-old then removes her legs from around the child and allows the child to get up. This child moves away from the twelve (12) year-old after the incident. It was also observed on the video that the twelve (12) year-old child grabs a chair and moves it away from a child in the room. On 7/1/15 the surveyor made a visit to the facility and watched video footage from the facility's surveillance system to observe activities during evening care on 6/26/15. A review of the video footage found that all the children present in the facility were transferred to the evening care room/two (2) year old room at 6:33PM and one (1) staff person was left alone in the facility to care for the nine (9) children present (four (4) infants, two (2) toddlers (one (1) year olds), a two (2) year old and two (2) school age children). Two (2) of the infants present in the room were restricted to walkers, one (1) was restricted to a car seat and one (1) was restricted to a Bouncy seat. The infant observed sitting in a Bouncy seat was observed sitting in the seat from 6:33PM - 7:24PM. The staff person picked the child up out of the seat to feed the child a bottle and then returned the child to the same Bouncy seat two (2) minutes later. There was no other infant equipment present in the classroom and there was no area where the infants could be laid on the floor to play independently. The staff person was observed sitting in a chair texting on her phone throughout the entire evening while children watched television and run aimlessley around the room. The schedule of daily activities posted in the classroom was dated June 8 - 12, 2015; therefore, it was not current. General: Based on Observation and interviews, on 3/25/15 it was observed through a video recording that a three (3) year-old child was made to stay on his cot during nap time for an extended period of time (approximately 10 minutes) when the child showed no signs of going to sleep. The staff struggled with the child to get the child to lay on the cot and the child's back was patted, the child was repositioned several times on the cot, and the child got off of his cot during nap time and then was put back on it by a staff member. The child began to hit his head on his cot over and over. The three (3) year-old child received a red mark on his forehead from hitting his head repeatedly on the cot. After approximately ten (10) minutes the child was escorted to the kitchen with a staff to help the staff carry things to classrooms. Based on interviews this child does not often nap and is taken out of the room and placed in the office or placed with a staff to help them carry things. Based on observation of the video recording from 3/25/15, the three (3) year-old child was left on the cot, without an alternate activity, for too long and the child was never permitted to play quietly. The portion of the video reviewed covered approximately 3:09 PM to 3:12 PM. There was a time where a staff person is behind a child and the child is reaching back swatting at the staff person's face. Then there is an occurrence where two (2) of the children are playing with a ball. A child throws the ball over a half wall into another room. The child gets the ball and throws it back into the school age room. Then the staff person picks up the ball and throws it over handed at the child. The ball does not hit the child but hits the wall near the child. The other two (2) things happen very close together and involved the same child. The staff was trying to get the children to come to the table for snack and most of the children had done so. However, there were two (2) children who had not. There was no sound in the video but it appeared that the staff person was talking to a child and pushed another child out of his way to walk over to the first child. The child who was pushed fell into the table and appears to be upset. Just after that the video shows the staff person pulling on the child's arm and her stumbling towards the table. The staff person involved stated that the first two (2) occurrences were "just playing". The staff person stated that when he pushed the child he did not mean to, he was trying to move her out of the way so he could get to another child to talk to him. He also stated that when it looked like he pulled on the child he did not. He said she was upset and being dramatic. General: Based on Interviews with staff and two (2) eye witnesses, it was found that a one (1) year old male child opened the latch on the gate located on the playground and exited the playground on 5/8/14 at approximately 10:45 a.m. The witnesses observed the incident from an office window located in the bank which is adjacent to the day care facility. Both witnesses stated that the child was running and made his way halfway through the parking lot. One (1) of the witnesses left her desk and ran out of the bank to the parking lot and retrieved the child while the other witness called the day care director to inform her of what happened. Both witnesses stated that the staff person that was on the playground was aware that the child had gotten out of the playground area. One (1) witness stated that the caregiver was yelling the child's name as he was making his way down the parking lot. Both witnesses and the staff person stated that the child was in the parking lot less than two (2) minutes. General: Based on observation while in the one-year-old room at approximately 9:37 a.m., one (1) of the staff was observed singing songs and doing fingerplays with the children. The children were gathered around the staff person. Some of them were sitting on the floor and others were standing up near the staff person. One (1) child was laying on the floor and the staff person told the child to get up. The staff person made the child sit up on the floor beside her. One (1) child was walking around in the area carrying a pretend piece of fruit. The staff person took the pretend fruit away from the child and required the child to sit on the floor beside her. She then gave the piece of pretend fruit to a child who was sitting in her lap. However, there was another child standing near the staff person who had a piece of pretend fruit and that child was allowed to stand and hold the fruit. The surveyor went back into the one-year-old room at approximately 9:45 a.m. and the staff person was still sitting on the floor singing songs. The children were not participating and were trying to walk to the corner of the room where there were shelves of toys. The other staff person in the room was redirecting the children back to the area where the other staff person was sitting on the floor singing songs. It is not developmentally appropriate to require a child of this age to participate in an activity for this amount of time. The daily schedule lists 9:00 a.m.- 10:00 a.m. as outdoor play/gross motor activities. The posted planned program of activities had a small group activity called Birds of a Feather listed for 9:00 a.m. A review of the posted plan of activities in the infant room revealed a science activitiy that involved rocks was listed for that day. The plan of activities for the same day also had playing with snow in the sensory table listed as an activity and making a bird house from blocks. For the following day bird seed was listed as an activity. For Thursday of that week mulch was listed as an activity and on Friday of that same week, rocks and ice were listed as an activity. Let it be noted that the age of the children in the infant room is six-months-old to one-year-old. Rocks, mulch and bird seed are not developmentally appropriate materials for children of this age. A staff person reported that he had put the “pull-up” on the child at approximately 3:15 p.m. and said that the child remained in the “pull-up” until his mother arrived which was approximately 5:30 p.m. Interviews revealed that after the child entered the classroom he was told to close his legs because “his diaper was showing” and was called “pee, pee boy” repeatedly. The Director stated that some of the child’s classmates had also got a tutu from the dramatic play area and gave it to him. It was reported that the child was upset by having to wear the “pull-up” and upset by the name calling. As he went through the second set of doors, the parent grabbed his hand and pulled him back to me". The staff person continued to explain by stating, "I was in the room by myself while the other staff person assigned to be with me was doing something; I'm not sure what she was doing. I had to leave my group of kids long enough to step out to the front set of doors to get my son". The staff person identified the age range of the children in her care by stating, "It was all age groups, infants, toddlers, two (2) year olds and preschool because all the groups were merging at the end of the day". On 1/18/17 the DRCC office received an allegation involving a preschool male child exiting the facility at the same time as an adult female; however, the date of the incident was not identified. It was reported that the staff at the facility did not know that the child went outside with the adult female until she walked the child back into the facility. It was reported that the child's mother works at the facility and a description of the mother was provided. On 2/1/17 an investigation was conducted at the facility and interviews were conducted with staff. Administrative staff present at the facility identifed the staff person and child that were described in the allegation; however, they stated that they were not aware of an incident such as the one described occurring. General: Based on Observation, there was an infant in a reclining infant seat with her bottle propped on a blanket. The blanket was pushed up on either side of the bottle and the infant's hands were down by her side.
General: Based on Observation, interview and review of documentation, the facility failed to ensure that staff provide adequate supervision of each child in the care of the facility. The following was found: 1. The surveyor arrived at the facility on 7/1/15 at 9:55AM and found that the facility’s entrance door was locked. The surveyor rang the doorbell and the staff person in charge came to the front door to open it. The staff person in charge escorted the surveyor down the hallway and into the preschool classroom. A tour of the classroom revealed that eight (8) children had been left without adult supervision while the staff person left the room to open the door for the surveyor. The staff person in charge stated that the owner/director was on a field trip with the school age children; therefore, there was not a staff person available to open the door. 2. On 6/30/15 the surveyor arrived at the facility at 6:35PM to investigate allegations regarding supervision issues during evening care hours. The surveyor found that only one (1) staff person and two (2) children were present in the facility at the time of the visit; however, an interview with the staff person revealed that she was left alone in the building the evening of 6/26/15 to care for nine (9) children. The facility attendance records for 6/26/15 were not available for the surveyor to review during the visit because all administrative staff had left for the day; however, the staff person presented a written statement during the visit identifying the names and ages of the children in her care along with the approximately times that each child was picked up. The staff person stated that there were four (4) infants, two (2) toddlers (one (1) year olds), a two (2) year old child and two (2) school age children. The staff person stated during interview that she had to leave the infants alone/unsupervised in the evening care classroom/two (2) year old room sometime between 7:00PM - 8:00PM to go to the kitchen and prepare a bottle for one (1) of the infants. The staff person stated, "I couldn't carry them all, so I left the infants in the room and took the rest of the children with me". On 7/1/15 the surveyor made a visit to the facility and watched video footage from the facility's surveillance system to observe supervision issues during evening care on 6/26/15. A review of the video footage found several incidents of inadequate supervision. From 7:03PM - 7:09PM the staff person was observed sitting in a chair texting on her phone while having six (6) children in her care. The four (4) older children present were observed watching television and running aimlessly around the room during this timeframe. A parent arrived to pick up two (2) of the children at 7:09PM. At 7:12PM, the staff person sat back down and began texting on her phone again. At 7:16:57PM the staff person exited the evening care classroom with two (2) children and a kitchen tray in her hand which left two (2) infants alone/unsupervised in the classroom. The surveyor found that only one (1) staff person and two (2) children were present in the facility at the time of the visit; however, an interview with the staff person revealed that she was left alone in the building the evening of 6/26/15 to care for nine (9) children. The facility attendance records for 6/26/15 were not available for the surveyor to review during the visit because all administrative staff had left for the day; however, the staff person presented a written statement during the visit identifying the names and ages of the children in her care along with the approximately times that each child was picked up. The youngest child in the group was an infant, making the minimum staff to child ratio one staff person for five (5) children. The facility exceeded the staff/child ratio by four (4) children. On 7/1/15 the surveyor made a visit to the facility and watched video footage from the facility's surveillance system to observe staff to child ratio issues during evening care on 6/26/15. A review of the video footage found that the facility became out of compliance with staff to child ratios at 6:33PM when four (4) infants were transferred to the evening care classroom. The evening care staff person already had five (5) children in her care; therefore, the additional four (4) children gave her a total of nine (9) children (infants - school age). The staff person was observed out of compliance from 6:33PM - 7:09PM. 2. The staff person did not wash her hands before or after changing the diapers or between diapering each child. The children's hands were not washed and the diapering mat was not sanitized between diaper changes. It is important to note that there is not a sink in this classroom. The closest sink to this classroom is located in the hallway. 3. At approximatley 6:52PM a one (1) or two (2) year old child was observed playing with an adult size broom. The child was swinging the broom around and around within close proximity to an infant sitting in a Bouncy seat. 4. At 7:16:57PM the staff person exited the evening care classroom with two (2) children and a kitchen tray in her hand which left two (2) infants alone/unsupervised in the classroom. The staff person and the two (2) children returned to the classroom at 7:21:14PM and the staff person was eating an ice cream cone (the children did not have any). The staff person sat down in a chair to finish eating the ice cream cone and the two (2) children (one (1) year old and two (2) year old) stood in front of her with their arms stretched out toward her.
