The surveyor arrived at 10:20 a.m. The children were observed running around the room and engaged in free play. The staff member was frequently correcting misbehavior. A review of the class schedule showed that they should be completing "activity one" and then preparing for recess. The staff member was asked if she would be taking the children out for recess and she replied, "no, it is too cold today." According to Weather.com, the temperature at the time was between 45 and 51 degrees Fahrenheit outside. During a subsequent interview with the director, she agreed that it was not too cold for the children to be outside and they should be following their schedule. Green Classroom 1.) General: Based on observation, interview and review of documentation, the surveyor completed a walkthrough of the facility accompanied by the staff-person-in-charge. During a tour of the Three-Year-Old classroom, the surveyor inquired how many children were present. The staff member in this classroom stated that twelve (12) children were present, however, the surveyor and staff-person-in-charge counted thirteen (13). The surveyor and staff-person-in-charge reviewed the child supervision record and found that the thirteenth child had not been documented when he arrived at 9:30 am. The staff-person-in-charge removed one child from the classroom, leaving twelve children. The classroom was over ratio by one (1) child from 9:30 am until 11:07 am. On Thursday, March 23, 2023, at approximately 3:30 p.m., a staff member was feeding a nine-month-old female a bottle when the child sat up abruptly and stopped breathing. The child started turning a purple/ red color and appeared unconscious. The staff member handed the child to her coworker who is a Certified Nursing Assistant (CNA). This staff member put her mouth over the child’s nose/ mouth to suction the mucous, turned the child over her knee, and gave two (2) quick back blows. The child started crying and her color returned to normal. Afterwards, the staff member paged the staff person in charge and told her that the child was having trouble breathing. The staff person took the child to the front office for approximately thirty (30) minutes and then returned her to the classroom. The child’s parent arrived at approximately 4:30 p.m. and found her daughter sleeping in an upright position in a bouncy seat. The staff informed her that they did not feel comfortable placing her in a crib after what had occurred. The staff proceeded to describe what had happened. The parent spoke to the staff person in charge over the phone. The staff person in charge told the parent that the staff member asked if she would take the child because she was having trouble breathing due to congestion. The staff person in charge stated that she was not given the full account of what happened. On March 23, 2023, after leaving the child-care center, the parents took their daughter to the emergency room. The examination found that it was a possibility that Child #1 had a brief resolved unexplained event or an isolated choking event.

One (1) staff person was tending to some other children in the corner near the window that faces the hallway, and the other staff person was putting something in one (1) of the children’s cubbies located along the wall near the door to enter the classroom. The staff person who was observed near the cubbies stated she had just finished changing a diaper and knew the child had gone in the bathroom, but the door had closed. The child then came to the staff person who was near the cubbies. The staff person stated the child had been looking for her pacifier which she (the staff person) gave the child after she came out of the bathroom. The staff person stated she had the child’s pacifier in her pocket. It should be noted that there is a half wall and half door that encloses the bathroom. The diaper changing table is located beside the bathroom. It could not be determined how long the child was in the bathroom unsupervised. 2) The surveyor and staff person in charge went back to the Yellow Room after the initial walk through. As the surveyor and staff person in charge entered the Yellow Room, several children were observed running around in the area near the front part of the classroom. At that time there was not a staff person visible. The door to the bathroom which is a half door was open. Additional children were observed playing in the back part of the room near the bathroom. A few seconds after the surveyor and staff person in charge entered the room, a staff person stood up from behind the bathroom door. The staff person could not see the children in the front part of the classroom due to the bathroom door blocking her view as she was bent down behind the door assisting a child with toileting. The children in this room at the time were ages two to three years old. General: Based on interviews, the heating system for the infant classroom on 01/24/2022 was not working properly. Three staff stated that the infant classroom got extremely hot, and staff raised a window to cool the classroom. An interview with staff during the investigation revealed that on 10/28/20, two children identified as three-year-old males were left alone and unsupervised in the Green Classroom for a period of time while the rest of their group was outside on the playground. The staff person assigned to the group stated that she was outside on the playground when a staff person from another classroom brought the two children to her. It was reported the staff person walked by the Green Classroom to go on her 10 minute break and observed the two children alone in the classroom. The staff person assigned to the group further stated that the two children had not yet arrived to the facility when she took her group of children outside. A review of the Green Classroom Transition Log found that the staff person documented that the group was outside on the playground from 9:20AM - 10:00AM and she documented the arrival time for both children as 9:47AM. A review of the facility attendance software with the staff person in charge found that one child arrived at 9:29AM and the other arrived at 9:32AM; therefore, there is a period of time (15 - 18 minutes) where the two boys are unaccounted for. Both management staff described the facility policy regarding transition times by stating that staff should make eye contact with the staff person they are transferring a child to; however, this policy/procedure was not adhered to on 10/28/20. The surveyor noted the classroom was a wide-open space with no set boundaries or defined activity areas. The shelving units were empty and against the wall and two child-sized tables were in the closet. The surveyor inquired about the arrangement of the classroom and the staff stated it was due to the children pushing the shelves and climbing on the tables. The surveyor noted there were very few toys accessible to the toddlers during the observation. The surveyor reviewed video footage recorded on 12/13/2019, and observed the toddler in question, run towards the window, collide with another toddler, and fall to the floor. While watching the video, the surveyor noted that a staff person was in the diapering area and appears not to notice the children collide. During an interview, the staff person stated that she was aware that the children were running around the classroom, but did not see them collide and only became aware of it after watching the video. A second staff person, who was present in the classroom on 12/13/2019, stated that she saw the toddler running but did not see her collide with the other child until after she reviewed the video. Based on interview, the facility failed to provide for the safety of a child in care. After interviews it was found that staff had knowledge that the closet door in their classroom was not easy to shut. Staff were also aware of a two-year-old child's history of slamming the closet door shut. There were no measures in place to prevent an incident from occurring as a result of these two things. On 11/19/18 a child received an injury to her finger after her hand was caught when another child slammed the closet door shut. Further, during the inspection a staff person was observed squeezing a child in the cradled position excessively hard while speaking angrily and frustrated towards her. When staff saw the surveyor her grip loosened and she smiled at the child before putting her down.

These instances by this same staff person happened over a period of time and to more than one (1) child. General: Based on Observation, it was found that on 7/19/18 at approximatley 10:30 a.m. an individual who lives near the facility was in their backyard and heard a child crying. Approximatley five (5) minutes passed and the individual observed a child who was three-year-old or younger standing at the door leading from the playground into the facility. This individual watched and did not see an adult anywhere. At approximately 10:40 a.m. this individual went to the facility and notified them a child was on the playground without an adult being present. As the individual left the facility the assistant director removed the child from the playground and brought the child inside the facility. Further interviews with staff confirmed that it was a two-year-old female that had been left outside unsupervised for approximately ten (10) minutes. It was also found that the door leading from the playground into the facility locks and can only be opened from the inside. The distance from the classroom to the door to the playground is approximately twenty (20) feet. Additional information found during interviews found that staff did not count children prior to coming inside the building and again once the children were inside the classroom. It was also found that staff who were in charge of the group of children did not know they had left the child outside until the assistant director brought the child to the classroom. It was reported that the child was left alone/unsupervised for approximately eight (8) minutes and was found by a staff person walking down the hallway. An interview with staff at the facility on 2/5/18 revealed that two (2) staff that work in the Red Room, which is positioned across the hall from the Yellow Room, observed the child standing at the Yellow Room door crying; however, were not aware that no one else was in the room with the child. Both staff stated during interview that the lights were off in the classroom; however, this was not concerning to them because the teacher in Yellow Room often turns out the lights during classroom activities. He stood there at the door alone for approximately eight (8) minutes crying and did not attempt to open the door". During the investigation the surveyor found that the Blue Classroom (Four (4) year old class) was over ratio by one (1) child on 11/6/2017. During an interview, the staff person working in the Blue Classroom stated, “One-day last week I was out-of-ratio around lunch time. I had fifteen (15) children so I was over by one (1) child.” The surveyor asked how long she was out of ratio. He woke up from nap at approximatley 2:45 PM and was served snack but did not have his diaper changed. At approximately 3:45 PM his mother arrived at the center to pick him up. His mother discovered that his diaper was soaked through and his clothes were wet. The staff completing the diaper changes after nap stated his diaper change had not been neglected but she had not gotten to him due to the number of children needing a diaper change.

General: Based on Review of Documentation and interview, this regulatory requirement was not met. On 1/27/17 the director reported via email that a three (3) year old child was left alone in the green room (preschool classroom) when her group left the room to go to the activity room down the hall. An interview with staff at the facility on 2/3/17 revealed that the child was found by a staff person that was walking down the hallway. The staff person heard a child crying and then observed the child standing at the green classroom door. The staff person stated during interview that the child was visibly upset and scared and indicated that the child could not open the door to get out of the classroom. The staff person stated that she opened the classroom door, picked up the child and took her to the director that was standing in the hallway in front of the activity room. The staff person and the director stated during interview that the staff assigned to care for the child were not aware that the child was missing until they brought it to their attention. Administrative staff immediately reviewed video surveillance footage and found that the child was in the children's bathroom in the green classroom when the group exited the classroom to go to the activity room down the hall. Administrative staff stated during interview that the child was unsupervised approximatley three (3) minutes. The child's parents were notified of the incident and the two (2) staff that were assigned to care for the child were terminated from employment the same day. General: Based on Review of Documentation and interview, the facility failed to ensure a child be helped with personal care and cleanliness based upon his/her developmental skills. On 1/27/17 a three (3) year old child was left alone/unsupervised in the children's bathroom in the green room when her group exited the room and went to the activity room down the hall. An interview with staff revealed that the child was in the bathroom several minutes because she was having a bowel movement. The child's health appraisal and allergy form in her facility file contained the following statement, "trouble passing urine or bowel movements". The form also noted that the child takes medication for constipation. The child's mother stated during interview that the child was not cleaned properly on 1/27/17 as evidenced by the feces in the child's underware when the child got home that afternoon.

General: Based on observation and interview, the child-care facility failed to meet this regulation as follows: 1. The surveyor found a planned program (weekly lesson plan) posted in each classroom. However, when the surveyor interviewed staff about the implementation of the activities listed on the lesson plan, a majority of staff stated that they did not have the materials to implement the activities. For example, in the wobbler classroom, the weekly theme listed was “sounds of Christmas”. The activities on the lesson plan were: exploration bins to include child-safe jingle bells, various musical instruments, and Christmas stockings. The plan also listed various books for the staff to read to the children. Interviews and observation found that the staff person had none of the materials listed. Furthermore, lesson plans in other classrooms listed activities such as white playdough with glitter, sensory bottles, a nativity scene, and exploring with wrapping paper, yet none of these materials were available to the staff or to the children. Staff stated that they often have to make substitutions for the materials. For example, instead of exploring wrapping paper, the children explored felt pieces. Another example, a staff person stated she did not have a nativity scene, but the children could “act it out”. The lesson plans do not include changes or substitutions. In short, interviews with staff found that lesson plans that are posted in each classroom are not being fully implemented with the children in care. 2. The surveyor found that infant classroom #2 did not have multi-cultural materials available or represented in the classroom environment. 3. The surveyor found that red classroom #1 did not have a variety or a sufficient amount of dramatic play materials. For instance, the surveyor observed only three stuffed animals available to the nine toddlers in care. General: Based on Observation, it was found that on 7/19/18 at approximatley 10:30 a.m. an individual who lives near the facility was in their backyard and heard a child crying. Approximatley five (5) minutes passed and the individual observed a child who was three-year-old or younger standing at the door leading from the playground into the facility. This individual watched and did not see an adult anywhere. At approximately 10:40 a.m. this individual went to the facility and notified them a child was on the playground without an adult being present. As the individual left the facility the assistant director removed the child from the playground and brought the child inside the facility. Further interviews with staff confirmed that it was a two-year-old female that had been left outside unsupervised for approximately ten (10) minutes. It was also found that the door leading from the playground into the facility locks and can only be opened from the inside. The distance from the classroom to the door to the playground is approximately twenty (20) feet. Additional information found during interviews found that staff did not count children prior to coming inside the building and again once the children were inside the classroom. It was also found that staff who were in charge of the group of children did not know they had left the child outside until the assistant director brought the child to the classroom.

The staff member was observed on video to grab this two (2) year-old child from a seated position up off the carpet by one (1) arm and flip her around carrying her body parallel on her hip with her legs dangling in the air. The teacher appeared agitated with the child in the video. Based on interview the teacher left approximately eight (8) children unsupervised in the classroom when she exited the room into the hallway. Based on a review of the video from 7/18/18 the children inside the room were wandering around the room aimlessly and one (1) child was climbing on a table. The video showed some children exiting the classroom and walking down the hallway. One (1) child was observed near the exit door at the end of the hall and another child was pushing a chair out into the hallway while the teacher was interacting with the two (2) year-old child as well as conversing with a parent.

It was reported that the child was left alone/unsupervised for approximately eight (8) minutes and was found by a staff person walking down the hallway. An interview with staff at the facility on 2/5/18 revealed that two (2) staff that work in the Red Room, which is positioned across the hall from the Yellow Room, observed the child standing at the Yellow Room door crying; however, were not aware that no one else was in the room with the child. Both staff stated during interview that the lights were off in the classroom; however, this was not concerning to them because the teacher in Yellow Room often turns out the lights during classroom activities. Video surveillance footage of the incident was not available for the surveyor to review; however, management staff at the facility stated that they viewed the video footage on 1/29/18. The director explained what she observed on the video footage by stating, "At 4:29PM the staff person working in the Yellow Room lined her group of children up at the classroom door and she did a head count. The staff person led the group out of the Yellow Room and into the Green Room next door. I saw the Yellow Room door close before the child exited out. He stood there at the door alone for approximately eight (8) minutes crying and did not attempt to open the door". The director further explained by stating, "The staff person messed up because she was not at the back of the line and she must not have done a second head count when her group entered the Green Room or she would have known someone was missing". A review of the employee misconduct notice found the following statement, "When Green room left to go to the activity room at 10:35AM CK policy of headcount and room sweep was not followed. A child was left in the restroom and in the green room until another teacher noticed the child at 10:38AM and took her to the activity room to be with her class". General: Based on Review of Documentation and interview, this regulatory requirement was not met. On 1/27/17 the director reported via email that a three (3) year old child was left alone in the green room (preschool classroom) when her group left the room to go to the activity room down the hall. An interview with staff at the facility on 2/3/17 revealed that the child was found by a staff person that was walking down the hallway. The staff person heard a child crying and then observed the child standing at the green classroom door. The staff person stated during interview that the child was visibly upset and scared and indicated that the child could not open the door to get out of the classroom. General: Based on Observation, it was found that the teacher in the Yellow classroom was supervising nine (9) two-year-old children. The ratio policy of the facility states that the facility staff to child ratio for that classroom is 1 to 8. The teacher stated that she was aware that she exceeded the facility policy by one (1) child.

An individual hired on 12/12/2016 did not have their Ohio background check completed and stated they moved to Kentucky in May 2016. It was found that they all worked alone in the classroom.
