General: Based on observation and interview, both the Stingray Room and Angelfish Room had outdated lesson plans posted. A subsequent interview with staff in charge found the current lesson plans had been given to the teachers at the beginning of the week, but not posted. Animals In Compliance

General: Based on interview and review of documentation, the center's policy and procedures in the event of an accident, injury, or illness of a child were not followed. The policy and procedures state to contact parents immediately. A two-year-old child who was in state's care was injured while on the playground at around 4:00 pm. When the parent arrived to pick up the child at a bit after 4:30 pm, this incident had not yet been reported to her. The parent then took the child to the ER to receive care where it was found that her arm was broken in two (2) places. The mother was also not provided an incident report to understand what had caused the injuries to her child.
General: Based on interview and review of documentation, it was determined that a two-year-old child was injured on the playground ground around 4:00 pm. When the parent arrived at 4:30 pm, she had not been notified that the child was injured. General: Based on observation, this regulatory requirement was not met. The following was found: 1. The bathroom in the Butterfly Fish Room contained a section of linoleum tile that was not secured to the floor. There was a gap around the tile where it shifted. 2. The Angelfish Room contained a small hole in the drywall in the dramatic play area. In addition, next to the hole in the wall there was a small area of chipped paint. General: Based on interview and review of documentation, it was found that one staff member hired 11/30/2020, did not have proof of a criminal records check on file at the facility. The staff member had been previously employed at another facility, where a KARES background check had been run and the staff member was found eligible for hire; however, the staff member had a break in employment, requiring an updated criminal records check. Upon being hired at this facility, the staff member had a central registry check (CAN) completed, but not a criminal records check. General: Based on observation, the following was found: 1. There was a small area of missing/unravelled carpet in the children's play area in the Jewels classroom. 2. There was a piece of the black plastic baseboard in the bathrrom in the Flying Fish classroom that was pulling away from the wall. All of the black plastic baseboard in that bathroom had an accumulation of dirt and grime. 3. There was a ceiling tile that was hanging down slightly out of the ceiling grid. It appeared that the tile was not secured in the ceiling. General: Based on observation and review of documentation, this regulatory requirement was not met. A review of the Division of Regulated Child Care records found that notice of a civil penatly was issued to the facility on 3/11/19. At the time of the investigation it was observed that this notice of a civil penalty was not posted in a conspicuous place. An interview with office staff confirmed that the facility received the civil penalty on 3/11/19 and placed the document in their files.

It was found through staff interviews that on 2/27/19 a seventeen-year-old staff person escorted a child alone that was left on the playground to the front office without being under the direct supervision of a qaulified staff person. General: Based on observation and interview, this regulatory requirement was not met. Interviews with staff found that on 2/27/19 at approximately 4:00 p.m., staff and children from the Angelfish room and the Jellyfish room left the middle playground together and entered the building through a door located beside the fenced infant patio. It should be noted that the door leads directly into the Angelfish/Jellyfish room. The lead teacher in the Angelfish room was at the front of the line and the lead teacher for the Jellyfish room was at the back of the line. There was a third staff person working with the teacher in the Angelfish room but staff could not recall the whereabouts of this staff person. The lead teacher of the Angelfish room indicated that the children from both rooms were mixed together in line and she only counted her children entering the building. The staff person stated she counted eight (8) children but did not make eye contact with each child as the facility's policy requires for transitioning children from any area. Once the children from the Angelfish room were inside and the door was closed, the lead teacher realized she had only seven (7) children on her side of the room. The staff person opened the door leading from the room to playground and looked out but did not see the child and closed the door. The staff person opened the door again and asked two (2) staff who were in the fenced infant patio area if they had seen a child outside. The staff stated a child had gone in the door that leads into infant rooms labeled Shrimp A and Shrimp B. The staff person closed the door again, then opened the door and went out to the playground to ask additional staff who were outside if they had seen a child and they responded they had not. The staff person asked the staff in the infant patio area again if a parent came to the playground and got a child and they told her the child was taken to the office. It was found that a female child who was two- years-old at the time of the incident had stopped at the fence to look at the babies. The lead teacher in the Angelfish admitted she had not seen the child get in line. It was also found that the facility has a written policy that they take the LifeCubby tablets with them anytime the children are outside of their classroom. Staff are required to do a verbal roll call and make eye conctact with each child and verify the roll call with check-in documentation in LifeCubby. The lead teacher in the Angelfish room stated she did not take her tablet to the playground and did not make eye-contact with each child. It was found that the child was in the front office for approximately two-three (2-3) minutes before the staff perosn from the Angelfish room came to get the child.
General: Based on Observation, interview, and record review, on 1/03/19 a four (4) year-old child was left on the playground unsupervised for approximately ten (10) minutes. The preschool staff (Flying Fish Room) were unaware that the child was left unsupervised on the playground until a staff member from another room, heard the child crying on the playground, and brought the child back into the preschool classroom. General: Based on Review of Documentation, and interview, on 1/3/19 two (2) of the preschool teachers (Flying Fish Room) left a four (4) year-old child unsupervised on the playground for approximately ten (10) minutes. Based on interviews, the staff were both aware of the facility policy to count the children throughout the day. The staff signed the Employee Orientation Manual Agreement sheet indicating that they agree to comply with the employee orientation manual, including the personnel policies. The classroom procedures state that adequate supervision means that a qualified staff devotes full time and attention to the children being supervised and are aware of their whereabouts at all times and within scope of vision and range of voice. The policy further states that it requires the counting of heads continually throughout the day to ensure the whereabouts of each child at all times. Based on staff interviews neither of the staff counted heads when the children left the playground and went back to their classroom. The director shall manage the staff to assure the development, implementation, and monitoring of child-care center plans, policies, and procedures. General: Based on interview and record review, in November of 2018, a four (4) year-old child was left unsupervised in the classroom for approximately five (5) to ten (10) minutes while her class was outside on the playground. A staff member that was on her break found the four (4) year-old child in the Flying Fish Preschool Room alone, crying, without any adult supervision. The staff member looked for the child's teachers in the classroom and did not locate them so she took the child to the playground where her class and teachers were located. Based on review of documentation, a one-year-old child had her fingers closed in a door on April 10, 2018. During a tour of the children's bathroom in the Jellyfish and Mollies classroom the surveyor observed a small black bag sitting on the bathroom counter beside the sink. The small black bag was identified as belonging to a staff person and contained deorderant and makeup.

During a tour of the facility it was found that seven (7) staff were caring for a group of nineteen (19) toddlers (one (1) year olds) on the playground. Since the youngest child in the group was a one year old, the maximum group size would need to be twelve (12) children. The facility exceeded the group size by seven (7) children. Staff stated during interview that these three (3) classrooms are typically together on the playground approximately one (1) hour. General: Based on Observation, during a tour of the Butterfly infant room there were twelve (12) children ages infant to one-year-old present. The room was divided into three (3) areas. In one (1) area there were two (2) staff and three (3) infants. In the eating area there was one (1) staff person and nine (9) children ages infant to one-year-old. The staff to child ratio with the age of the youngest child being an infant is one (1) staff for five (5) children. General: Based on Interview, it was found that on 11/10/2016 the three (3) year old classroom was over capacity by four (4) children. The room sized measured for a capacity of seven (17) children and through interview and review of attendance sheets there were twenty (21) children present. In and interview with a staff she stated that two (2) classrooms were combined together on 11/10/2016. It was also found that the two (2) year old classroom was over capacity on 11/09/2016. In an interview with a staff person, she stated that the facility received a delivery of classroom furniture. The staff person stated that two (2) two (2) year-old classroom were combined together giving them a total of twenty-four (24) children. Measurment of the classroom found that the maximum capacity for that space was for twenty (20) children. The classroom was over capacity by four (4) children.
General: Based on Interview, it was found that on 11/09/2016 there were six (6) staff with twenty-four (24) two (2)year-olds combined together in one classroom. The group size for this age group is two (2) staff to twenty (20) children. The class was over group size by four (4) children. It was also found through the walk-through conducted on 11/21/2016 that there were two (2) staff caring for eleven (11) infant children. The group size for this age group is two (2) staff to ten (10) children and the ratio is one (1) staff for every five (5) infants. General: Based on Interview with staff members, it is confirmed that the child care center director failed to assure compliance with regulatory requirements. Several staff members confirmed observing the perpetrator argue back with the child victim, pull him by the arm and squeeze his arm, sling him down on his cot, and almost completely pick him up by his shirt. The director reported upon hearing of these incidents, this particular staff person was immediately terminated from the child care center.

General: Based on Observation, 1. The backpack containing the first aid kit in the Betas classroom was sitting on a plastic tote in the child care area. The backpack and its contents were accessible to the children in care. 2. There were two (2) backpacks with first aid kits in them hanging on hooks in the Angelfish classroom. The hooks were placed in the wall approximately two (2) feet from the floor. This left the backpacks and their contents accessible to the children in care. The director acknowledged these deficiencies during the exit conference.

General: Based on Observation, during a tour of Jewels classroom and the Angelfish classroom bottles of disinfectant and sanitizing solution were observed sitting on the changing table. These items were accessible to the children.
General: Based on Review of Documentation, a staff person hired 9/27/10 had only fourteen (14) hours of training for her current training year. There was one (1) staff person hired 9/30/14 who did not have documentation of completing the required orientation training. Also, there were four (4) staff who had completed the orientation training but it was not within the first three (3) months of employment. A staff person hired 11/6/14 completed the training on 3/24/15. A staff person hired 11/13/14 completed the training on 3/2/15. A staff person hired 11/24/15 completed the training on 4/14/15. A staff person hired 9/29/14 completed the training on 3/14/15.
General: Based on Observation, during a tour of the Clownfish room a lamp was observed sitting on a low shelf located between the block area and the table toys area. The cord stretched across the wall to the outlet in the block area. The cord was accessible to the children

General: Based on Observation, it was found that several bottles of sunscreen were being stored in an unlocked plastic tub on an open shelf in the bathroom of Preschool C. Outdoor Play Area

General: Based on Observation, it was found that a bottle of Nivea lotion and Avon body spray were being kept on the vanity of the hand-washing sink in Class 1A. Each bottle bore the label "Keep Out of Reach of Children."
General: Based on Observation, it was found that the vents in the gross motor room, Preschool C, Class 2B, Pre-K A, Pre-K B, the bathroom of Class 1A and the bathroom located in the cafeteria were very dusty. Throughout the facility, the carpet was found to be running and coming apart in several places. The carpet was also buckled and loose in Pre-K A, Pre-K B, Class 1A and Class 1B. In Class 2B, the baseboard in the dramatic play area was found to be pulled off the wall. In Preschool C, the vent cover in the bathroom was missing. In the common area of Infant C and Infant D, it was found that there was severe damage to the cabinet beneath the sink. The bottom was falling out of it and a black substance that appeared to be mold was growing along the bottom and sides of the cabinet. The staff person stated that the damage was caused by water.
General: Based on Observation, 1. There were seven (7) infants with one (1) staff person in the Infant A-B classroom. 2. There were eleven (11) two-year-old children with one (1) staff person in the Preschool II B classroom. General Administration
TYPE B CITATION: Based on Observation, upon entering Preschool II B it was found that the staff person in the classroom was asleep. Two (2) of the eleven (11) children in the classroom were awake and sitting on their cots. There was no other staff person in the classroom to supervise the children. General: Based on Observation, the staff person in the Preschool II B was lying on a bean-bag asleep with a blanket over her head. The Surveyor walked through the classroom to count the napping children. There were two (2) children awake and sitting on their cots while the other nine(9) children and the staff person slept. General: Based on review of documentation, a child's file did not have an updated immunization certificate. The immunization certificate had expired on 3/30/2021. General: Based on observation and interview, this regulatory requirement was not met. Interviews with staff found that on 2/27/19 at approximately 4:00 p.m., staff and children from the Angelfish room and the Jellyfish room left the middle playground together and entered the building through a door located beside the fenced infant patio. It should be noted that the door leads directly into the Angelfish/Jellyfish room. The lead teacher in the Angelfish room was at the front of the line and the lead teacher for the Jellyfish room was at the back of the line. There was a third staff person working with the teacher in the Angelfish room but staff could not recall the whereabouts of this staff person. The lead teacher of the Angelfish room indicated that the children from both rooms were mixed together in line and she only counted her children entering the building. The staff person stated she counted eight (8) children but did not make eye contact with each child as the facility's policy requires for transitioning children from any area. Once the children from the Angelfish room were inside and the door was closed, the lead teacher realized she had only seven (7) children on her side of the room. The staff person opened the door leading from the room to playground and looked out but did not see the child and closed the door. The staff person opened the door again and asked two (2) staff who were in the fenced infant patio area if they had seen a child outside. The staff stated a child had gone in the door that leads into infant rooms labeled Shrimp A and Shrimp B. The staff person closed the door again, then opened the door and went out to the playground to ask additional staff who were outside if they had seen a child and they responded they had not. The staff person asked the staff in the infant patio area again if a parent came to the playground and got a child and they told her the child was taken to the office. It was found that a female child who was two-years- old at the time of the incident had stopped at the fence to look at the babies. The lead teacher in the Angelfish admitted she had not seen the child get in line. It was also found that the facility has a written policy that they take the LifeCubby tablets with them anytime the children are outside of their classroom. Staff are required to do a verbal roll call and make eye conctact with each child and verify the roll call with check-in documentation in LifeCubby. The lead teacher in the Angelfish room stated she did not take her tablet to the playground and did not make eye-contact with each child. It was found that the child was in the front office for approximately two-three (2-3) minutes before the staff perosn from the Angelfish room came to get the child. General: Based on Observation, interview, and record review, on 1/03/19 a four (4) year-old child, with a diagnosed medical condition, was left on the playground unsupervised for approximately ten (10) minutes. The preschool staff (Flying Fish Room) were unaware that the child was left unsupervised on the playground until a staff member from another room, heard the child crying on the playground, and brought the child back into the preschool classroom.
General: Based on Review of Documentation, this regulatory requirement was not met. A review of the emergency drill log in the Shrimp Classroom found that the fire drill for 5/8/17 had already been documented on the fire drill log, therefore the information documented was not accurate. General: Based on Observation, an epi-pen was found in an unlocked drawer of the teacher's desk in the Betas classroom. The epi-pen was not labeled with a child's name and was accessible to the 3 and 4-year-old children in the classroom. The director stated she was not aware that the epi-pen was in the desk drawer. General: Based on Observation, during a tour of the Guppies Room a staff person was helping the children brush their teeth. The staff person took the lid off of the container that held the toothbrushes and put it on the changing table mat. The lid was then put back on the container that held the toothbrushes. This same staff person was observed placing a tube of toothpaste on the changing table and using the toothpaste on a child's toothbrush.
General: Based on Observation, there were twelve (12) children ages four (4) months to thirteen (13) months and three (3) staff in the Butterflyfish room. An interview with staff found that the staff work as a group caring for the children. The maximum group size with age of the youngest child being four (4) months old is ten (10).
General: Based on Interview, during the exit conference the director indicated there had been some changes on the facility diagram from the previous year. After reviewing the diagram from the previous year and the current diagram presented at the time of the survey it was found that one (1) of the spaces used for child care had extensive renovations done. A call was made to the director on 4/24/15 and she indicated that since the survey conducted on 3/20/14 there had been a renovation to an area that is now the four (4) and five (5) year old room. The director confirmed that some walls had been removed and the space further renovated. However, the Divison of Regulated Child Care was not notified of this renovation.
General: Based on Review of Documentation, a volunteer who began volunteering 1/1/15 had no evidence of a criminal records check on file. Also, there were three (3) grandparent volunteers used by the center as part of a program through Comminity Action Council. Of these (1) was missing a criminal records check and one (1) was missing both the criminal records check and the child abuse and neglect check. None of these indivduals were left alone with the children.
General: Based on Observation, during a tour of the Betas room there were eleven (11) sets of track lighting with three (3) bulbs each that were uncovered. The director was unable to verify that the bulbs in the track lighting were shatterproof. In addition there was a flourencent light fixture in one (1) of the bathrooms in the same room that was missing the cover. The bulbs were not shatterproof.
General: Based on Observation, at the time of the survey the back door located by the Glassfish room was observed propped open and there was no screen. A staff person was observed taking trash out to the dumpster through this door.
General: Based on Observation, during a tour of the Shrimp Room a staff person was observed sitting on the floor holding a child. The staff person was observed coughing and holding her hand up to her mouth. The staff person did not get up and wash her hands after coughing into her hand.
General: Based on Observation, during a tour of the outdoor play area a blue elephant slide was observed sitting on grass. In addition there was a Little Tikes climber with two (2) slides and a tunnel sitting on grass in the same area as the elephant slide. Grass is not an acceptable form of surfacing under equipment used to climb and slide.
General: Based on Observation, it was found that the children's toothbrushes in Class 2B were not labeled with their names.

General: Based on Observation, it was found that a metal vegetable cage with sharp metal stakes was on the ground in the large playground area. It was also found that the wooden shed located on the large playground area was splintering all along the bottom edges and on multiple spots on the sides. The splintered areas also contained several exposed nails.
General: Based on Observation, it was found that current schedules of daily activities were not posted in Infant A, Infant B, Preschool B, Preschool C, Pre-K B, Infant C and Infant D.
General: Based on Observation, it was found that allergy and medication information for a child was posted in a public viewing area of Preschool C. The facility did not have written permission from the parent to post this information.
General: Based on Review of Documentation, one (1) staff person's file (hire date: 5/4/98) contained results of a negative TB test that was no longer current. The test was dated 3/12/12 which exceeds the two (2) year time frame.
General: Based on Observation, it was found that the yellow paint on the wall next to the side door of the cafeteria was flaking away due to damage. In the gross motor room, a corner of the wall in the carpeted area had been damaged, resulting in broken drywall which exposed the metal strip underneath. One (1) ceiling tile was found to be stained by apparent water damage in the gross motor room. Two (2) ceiling tiles were found to be stained by apparent water damage in Preschool C. Six (6) ceiling tiles were found to be stained by apparent water damage in Preschool B. Two (2) ceiling tiles were found to be stained by apparent water damage in Pre-K A. Four (4) ceiling tiles were found to be stained by apparent water damage in Class 1A. Three (3) ceiling tiles were found to be stained by apparent water damage in the common area of Infant C and Infant D. In Class 2B, a ceiling tile was found to be broken.
General: Based on Observation, it was found that the changing pads in Infant D and Class 2B were torn. The changing area in Infant C was found not to have a pad. Children were being changed directly on the hard surface.
General: Based on Interview, it was found that the mouth contact toys were not being scrubbed with a brush in warm soapy water prior to being sanitized and air dried. First Aid/Medication
General: Based on Observation, it was found that two (2) boards of the fence on the small playground had been broken by a fallen tree branch. The bottoms of three (3) boards were observed to be broken on the fence around the middle playground, resulting in jagged, splintering edges. On the large playground, three (3) fence planks were observed to be broken.
General: Based on Observation, it was found that there were several protruding nails on the small wooden fort located on the large playground. The tall wooden fort located on the large playground was found to have two (2) broken slats, protruding nail points on the top horizontal slat of the railing and multiple protruding nails on the floor of the fort. It was also found that the paint of the metal car and helicopter shaped pieces of equipment was peeling.
General: Based on Observation, it was found that the posted menu was not dated.
General: Based on Review of Documentation, there were no current professional development plans on file. The professional development plans are completed as part of the staff evaluation. The most current on file were dated 3/2012.
