Cribs and play pens required under He-C 4002.26(c) above shall: (1) Not be stacked; (2) Be free of cracked or peeling paint, splinters, and rough edges; (3) Have no more than 2⅜ inches between slats; (4) Have no missing, loose, broken, or improperly installed parts, screws, brackets, baseboards, or other loose hardware, or damaged parts on the crib or mattress supports; (5) Not have corner posts that extend more than 1/16 of an inch above the end panels; (6) Not have holes or tears in the mesh walls or in the material that connects the walls to the bottom of the crib or play pen; (7) Have fitted sheets designed for the size mattress, including elastic corners so that there is no excess fabric with visible folds or bunching, and that do not compress the mattress; (8) Not have bumper pads, blankets, flat sheets, pillows, quilts, comforters, sleep positioners, or any soft items or toys with infants up to 12 months of age; and (9) Have mattresses which are in good repair, free of rips or tears, and fit the crib or playpen so that the space between the mattress and crib or playpen is not more than 2 adult fingers wide and does not create a suffocation hazard.
Two licensing coordinators observed that five of the cribs in Infant One did not have fitted sheets designed for the size of the mattress in use, resulting in excess fabric with visible folds or bunching. Corrective action: As a result of the crib sheets not fitted properly, the infant rooms with cribs now have sheet clips so they're nice & snug.

Sinks that are used for food preparation or clean up, including sinks used for getting water for baby bottles, rinsing bottles, or dishes, and washing toys, shall not be used for hand washing after toileting or diaper changing.
Two licensing coordinators observed multiple items, including pacifiers, bibs, bottles, eating utensils, and high chair trays in the handwashing sink in the Infant One, Infant Three, Young Toddler One, Toddler Two, and Preschool One classrooms. Corrective action: Sinks are only used for handwashing in all classrooms as this will be reminded at our next staff meeting. In the future, bottles, pacifiers, eating utensils, etc will be sent home to be washed properly by the child's parents.

In order to assure that staff and children are familiar with all of the EOP drills, programs shall: (1) Practice evacuation off-site and bomb threats once per year with all child care staff; (2) Practice at least 2 other components of their EOP with all child care staff and children each calendar year; and (3) Review all EOP response actions with all staff at least 4 times each calendar year.
The two licensing coordinators' review of Emergency Operations Plan drills revealed that the program did not practice evacuation off-site and bomb threat drills in 2024 with all child care staff. Corrective action: Evacuation off-sire & bomb threat drill with all child care staff will be completed at our next staff meeting on Tuesday, April 22nd. In the future, this drill be done at one of our quartly staff meetings & will be written on the calendar as a reminder

Except for nature-based programs that operate solely outside, programs shall conduct fire drills in accordance with the following: (1) Programs that operate continuously throughout the year shall conduct at least one drill each month of operation; (2) Programs that operate only during the school year shall conduct a drill within 14 days of opening each year and monthly thereafter; (3) Programs that operate only during the summer months shall conduct one fire drill in each month of operation; (4) Child care personnel shall conduct fire drills at varying times during operating hours, including night time hours, if applicable, to ensure that each child attending the program experiences fire drills; (5) Child care staff shall activate the actual fire alarm system for the building for at least 2 of the required monthly fire drills required each year and use a fire alarm or smoke detector to signal all other fire drills; (6) All children and child care staff shall evacuate the building during each fire drill; and (7) Child care staff shall check daily attendance records to ensure that all children and staff are accounted for, after the building is evacuated.
REPEAT CITATION PREVIOUSLY CITED ON JULY 11, 2024. The licensing coordinator's review of the fire drill log revealed that the program did not conduct a fire drill in October 2024. Corrective action: Moving forward, we will conduct fire drills every month & record the drills as required. We will log all upcoming fire drills on a calendar, so we don't forget.

For children 24 months through 5 years, during naptime, a center-based program may have one less staff person in a classroom than required to meet ratios in accordance with He-C 4002.36 through He-C 4002.38 provided that: (1) The total number of child care staff required to maintain all ratios are on the premises of the program; (2) The ratio of awake children to staff in the classroom shall be no more than half the number of children as stated in He-C 4002.36 through He-C 4002.38; (3) Rooms in which staff is reduced shall be equipped with a two-way communication system to allow for immediate contact with other staff for assistance and response; and (4) There is a safety plan on file for review by the department, child care staff, and parents which includes plans or procedures for: a. Evacuation; b. Supervision; c. Environment; d. Schedule; e. Naptime policy; and f. Staff training and support; (5) The program provides parents with written notice of the reduction of staff; and (6) Documentation of the written notice in (5) above, in the form of a posted document, a policy statement that is signed by each parent, or other method of documentation is kept in the child’s record for review by department staff during visits.
The complainant's statement that there are not have enough staff to meet ratios when staff take breaks. Staff B and Staff F stated that they do not have staff to cover staff lunch breaks. Staff C stated they do not have written notice informing the parents of this posted in the program. Additionally, the licensing coordinator's review of the parent handbook revealed that there is no information or notice to parents regarding reduction of staff during nap time. Therefore, the families have not been notified of this practice via written notice. Corrective action: Any staff member that needs to take a break will be covered by another staff member to obtain student to child ratios. In the future, all staff will be covered for breaks with no issue meeting ratios.

Programs that provide meals and snacks for children shall:(1) Ensure that snacks and meals are prepared and served in a safe and sanitary manner, including washing fruits and vegetables before serving them; (2) Not serve food to children beyond the recommended dates of use, or beyond 3 days of storage in the refrigerator for perishable leftover food; (3) Store all food in the original containers or in a clean, covered container labeled with the date open and expiration date; (4) Store all unopened food at least 6 inches above the floor, separate from non-food items; (5) Store food items separate from non-food items that could contaminate food or be mistaken for food; (6) In addition to (c) above, properly wash and sanitize all infant bottles between each use; (7) Prepare and make available to parents on request written menus, including snacks, for each week; and (8) Keep previous menus on file for one year.
The licensing coordinator's observation that the refrigerator in the Infant and Infant 1 classrooms were not equipped with a working non-mercury, food service approved thermometer. Corrective action: More thermometers were ordered for the rooms that were missing them. Will put in each refrigerator once we receive them. In the future, every fridge will have a thermometer & licensing checks will happen weekly.

Corrective action: Staff member completed the health and safety trainings for her file. In the future, all staff will have all required trainings needed for their files. Upon employment, staff members will need to complete all Health & Safety before hire date.

Of 15 staff files reviewed, there was no documentation of completion of a skills test to obtain certification in pediatric first aid and CPR on file for four staff who completing the training via an on-line course. Corrective action: Director was unaware that the completion of the skills test had to be done in person. Moving forward, all staff will be required to complete the skills test to obtain certification in pediatric first aid and CPR on file.

The licensing coordinator observed that staff medications were stored with children's medications in a bin on the top shelf of the cabinet in the preschool classroom. Staff immediately relocated the staff's medications into their own bin, separating them from the children's medications. Corrective action: Teachers in Preschool 2 immediately relocated the staff's medication into its own bin & put it in a locked cabinet. In the future, all staff will keep children's medicine & adult medicine separate and inaccessible.

Of 15 child files reviewed there was no record of a health screening on file for one child, and no record of immunizations on file for another child. Corrective action: All child files are up to date with immunization records and health screenings. In the future, we will make sure all files have the correct paperwork & send out reminders to parents before they expire. Before a child's start date, all records need to be on file before they begin.

The licensing coordinator observed a staff member in the infant three classroom pulling a child by the back of the shirt to stop them from crawling in between two pack and plays. This was not done due to an emergency or for the child's safety. Corrective action: Director had a meeting with the staff member in Infant 3 to address the citing. Staff member explained that the child was crawling in between two pack and plays & heading toward a cord for a cd player. She grabbed the back of the child's shirt to scoot the child back & deemed this situation an emergency for the child's safety. In the future, staff member will remove the child appropriately from danger & redirect in a safer area.

A written record of a health screening for all child care staff, household members and other individuals who have 5 or more hours per week of contact with children shall: (1) Be on file at the program and available for review by the department for all child care staff within 60 days of the date of hire or the date the household member or individual begins having daily contact with children; and (2) Include, at a minimum, the information on the “Child Care Personnel Health Form” (11/2017) provided by the department, or its equivalent.
Of seven files reviewed, there was no record of a health screening on file for two staff employed for longer than 60 days. Corrective action: Both staff members have health screenings scheduled & will be completed for their file. In the future, all staff will be required to have a health screening on file. We have an account with Convenient MD so staff are able to get a physical & not able to start employment until completed.
The only exception to He-C 4002.20(b)(1) shall be children 4 years and older may leave the classroom to use a bathroom located on the same level as the classroom, provided that child care staff are aware of each child leaving the classroom to use the bathroom and the level of the building that the bathroom is located on is used exclusively by the child care program.
The complainant's statement that staff send children under the age of 3 to the bathroom by themselves. Staff D and Staff F stated that, although they typically take the children to use the bathroom as a group, they have sent children under the age of 4 to use the hallway bathroom unaccompanied by a staff member because they were working alone and a child had an urgent need to use the toilet. Corrective action: All staff were notified that children under the age of 4 can not go down to the bathroom unsupervised, so a staff member will need to accompany the child or go down as a group. In the future, this rule will be followed by all staff & addressed during the hiring process and/or staff meetings.

The complainant's statement that the program does not have enough staff to meet ratios when staff take breaks. Staff G stated that there are children under the age of 24 months in one of the Toddler rooms and that they do not have another staff to cover during breaks, therefore they are not maintaining the minimum required staff-to-child ratios for children under 24 months old during nap. Corrective action: For the children under the age of 24 months, an extra staff member will cover breaks to obtain staff to child ratios. In the future, this will be addressed during the hiring process and/or any staff meetings.

In the future, we will make sure all required staff records are on file. All new hires will have a job description to sign & all documents will be filed in employee folders.

The licensing coordinator's observation of a basket containing medications, including AUVI-Q, on a low shelf accessible to children in the Pre-K classroom. Corrective action: Once the licensing coordinator mentioned the medication being low on a shelf, the teacher immediately moved it up high on a shelf not accessible to children. In the future, all medications will be stored away in every classroom not accessible to the rule.

The licensing coordinator's review of the daily attendance revealed that there were nine children signed into the Preschool classroom when 13 children present. The licensing coordinator's review of the daily staff attendance revealed that there was one staff signed into the Preschool classroom when two staff were present. Corrective action: All the classroom teachers will be more aware of signing themselves in on the roster once arrived & signing the children in as they get dropped off. In the future, staff will record their attendance as well as children in their classroom maintaining group size ratios. The center director will do daily checks of the classroom rosters to ensure they're being filled out correctly.

The licensing coordinator's observation in the Infant 2 classroom, where two staff stepped over a baby gate at the entrance of the classroom, while carrying an infant. In the future, we will make sure all staff, current & new, know this rule moving forward. The center director will do daily checks to make sure this rule is being followed & understood.

The licensing coordinator's observation of an Epipen in the Toddler classroom that did not have a label or medication order from a licensed professional . Corrective action: Child's parents were notified by teacher at drop off on 07/12/2024 & the proper label will be dropped off on Monday, 07/15/2024. In the future, staff will only accept medications with a label or medication order from a health care professional.

The licensing coordinator reviewed staff attendance records and found one recorded who had not been determined eligible by the Unit. The director confirmed those individuals were in attendance as indicated. Corrective action: Once determined staff member wasn't eligible, they were asked to leave for the day & not able to return until eligible. Appointment made immediately for fingerprints.
