General: Based on observation, interview and review of documentation, the surveyor was not presented with a personnel file for a staff member (DOH: 01/25/25) who was observed to be working in a classroom. During interview with staff-in-charge the surveyor was informed that there should be a file for the employee, but she could not locate it at the time. Therefore, staff-in-charge did not have documentation of background checks submitted through the Kentucky Applicant Registry and Employment System (KARES) for the surveyor to review. Based on review of the Kentucky National Background Check Service, the staff member did not have a completed background check; therefore, the staff person was hired prior to clearance for employment. During interview, staff-in-charge informed the surveyor that the staff member was hired on 01/25/25 and that a Child Abuse/Neglect Background check was completed; however, she was unable to locate the documentation. Staff-in-charge also confirmed that a background check was not submitted through the KARES and that she was unaware that she needed to submit a background check through KARES. The surveyor did not observe the staff person working alone with children.

General: Based on observation and interview with staff, the surveyor found the following: 1. While standing in the doorway of the Preschool Classroom at approximately 10:13 am, the surveyor learned through interview with staff that one (1) child had gone to the restroom alone. The Preschool Classroom was observed to be located on the second story balcony above the Gym. A railing was around the balcony. The restrooms are located on the first floor of the Gym on the opposite side from the downstairs stairwell door where the children would exit. The children pass by a set of exit doors in the Gym that lead outside when they go to the restroom. The surveyor observed the stairwell door located near the Preschool Classroom to open and a child came through the door alone at approximately 10:15 am. The child struggled to open the stairwell door. The surveyor checked the stairwell and found no staff in the stairwell. The surveyor observed two (2) classrooms in the Gym. Through interview with staff and review of the child's file, the surveyor learned the child was three-years-old and the children in the classroom ranged in age from three- to four-years-old. The surveyor did not observe a staff member standing on the balcony when going to the Preschool Classroom. Therefore, the child was not within scope of vision, range of voice, or provided with adequate supervision at all times. 2. The surveyor entered the upstairs stairwell located near the Preschool and Pre-K Classrooms at approximately 10:25 am and observed a child walking up the stairwell alone. The surveyor followed the child back to the Pre-K Classroom, which consisted of children ages three- to five-years-old. Through interview with staff, the surveyor learned the child was four-years-old and had gone to the restroom alone. Staff reported the children will go down the stairwell to the restroom and come back up the stairwell on their own. Staff reported if the children are in the restroom for over three to five (3-5) minutes, they will call for another worker to check on the child because the younger children like to play in the restroom. Staff reported the classroom also takes breaks and will go to the restroom together as a class. The surveyor observed two (2) classrooms in the Gym. The surveyor did not observe a staff member standing on the balcony. Therefore, the child was not within scope of vision, range of voice, or provided with adequate supervision at all times. 3. Through interview with staff, the surveyor learned at approximately 9:00 am on the day of the surveyor’s visit, a three-year-old child in the upstairs Preschool Classroom came out of the classroom and walked past the stairwell located near the classroom and around the balcony to the back stairwell. Staff reported the child went into the stairwell alone and a staff member went to meet her at the downstairs door and took her to the restroom. Staff stated the child reported she could not open the bottom stairwell door closest to her classroom; therefore, the child went to the other door while the staff member remained in the classroom. Staff reported the child was not scared. Through interview with staff, the surveyor learned the children in the Preschool and Pre-K Classrooms normally use the first stairwell, go into the restroom alone, and then return to their classroom. Staff reported that most of the time a teacher will stand on the balcony and look over as the children go to the restroom. Therefore, the child was not within scope of vision, range of voice, or provided with adequate supervision at all times. 4. Through interview with staff, the surveyor learned a three-year-old child who was a runner, would want to run to the ramp or the hallway during the morning. Staff reported this child would push the chairs out of the way in the Gym and then run through the breezeway door, up a ramp, and down the hallway. A staff member would go after the child and keep their eyes on the child. Therefore, the child was not provided with adequate supervision at all times. It is important to note that the surveyor measured the distance from the upstairs Preschool and Pre-K Classrooms to the stairwell door to be approximately 37.74 feet; the distance from the second story stairwell door to the first-floor stairwell door, approximately 35.48 feet; and the distance from the first-floor stairwell door to the restroom, approximately 60.52 feet. The surveyor observed there to be two (2) flights of stairs with nine (9) steps each. The surveyor measured the distance from the second story stairwell door located near the Preschool and Pre-K Classrooms to the back stairwell door to be approximately 151.13 feet and the distance from the second story back stairwell door to the first-floor stairwell door to be approximately 37.6 feet. General: Based on observation, the surveyor was inspecting the girls' restroom at approximately 9:55 a.m. when a staff person entered the restroom with two (2) toddlers ages seventeen (17) and nineteen (19) months old. The surveyor noted that the diaper changing table was positioned against the wall at the entrance of the restroom. As the staff person started changing the female toddler's diaper, the male toddler ran around the corner to the hand-washing sink. He climbed up a two (2) step step stool and placed his arms on top of the countertop and proceeded to swing his body back and forth (his feet were not touching the top step of the step stool). The toddler kept trying to reach for the water faucet. The surveyor got the toddler down from the step stool two (2) times. After the staff person finished changing the female toddler's diaper, she then picked up the male toddler to change his diaper. The female toddler also ran around the corner and climbed up the step stool. The staff person could not see either toddler when they were at the hand-washing sink due to the positioning of the diaper changing table. The staff person stated that the diaper changing table was not always in the restroom. She stated that due to recent water damage, some of the classrooms had to be moved temporarily and the only place to change diapers is in the restroom.

However, the diaper change was finished by 9:38 AM and the staff person went back to the middle of the play space and interacted with other infants. When the classroom observation was over at about 9:43 AM the infant was still in the crib and not visible to the staff in the room.

This area is located directly across from the outdoor play area used by the children, and is accessible to children walking to the outdoor play area. The height of the exposed under part of the building is approximately two (2) feet tall. The exposure is tall and wide enough for a child to enter the under part of the building, which is supported by several cinder blocks.

infants: Based on Observation, a two (2) month old child was observed sleeping in a "Boppy Pillow" in a crib. A blanket was also observed pulled up around the childs face. The infant was also sucking on a pacifier. Interviews with staff found that there was not a medical statement on file indicating that the infant is required to sleep in the "Boppy Pillow". Staff also indicated that the infant's mother works at the facility and that the mother put the child in the "Boppy Pillow" and pulled the blanket up around the infant's face. The American Academy of Pediatrics practices the policy that blankets be kept away from an infant's face who is sleeping and that items such as pillows and stuffed animals not be placed in an infants crib.

General: Based on observation and interview, the surveyor found that the first and third toilets located in the restroom next to Room 105 were unable to be flushed. Staff-in-charge stated that the toilet handles had to be wiggled in order for the toilet to flush. The surveyor informed the staff-in-charge that, when testing multiple toilets throughout the child care center some toilets would flush after wiggling the handle; however, the two (2) toilets remained nonfunctional. Through interview with staff, the surveyor learned a staff member grabbed a three-year-old child a “little too hard,” when trying to catch the child while she was running. Staff reported this left a pink/red mark that looked like an “Indian Rug Burn” or friction on the child’s right forearm. Staff reported the mark was not bright red and faded. 2. Upon entry into the child-care center, the surveyor observed children at the restroom located in the Gym. Children were observed to run past the surveyor to the stairwell door located on the opposite side of the Gym. A staff person was observed to yell at the children “Did I tell you to go in there?” Staff-in-charge reported she heard the staff person and was going to address it with them. Through interview with staff, the surveyor learned the children were approximately three- to four-years-old. 3. Through interview with staff, the surveyor learned a staff member asked staff if “anyone wanted to play catch because they were getting ready to throw a child over the banister”. Staff reported the staff member and a three-year-old child were on the balcony above the Gym at the time of the statement. Staff reported the child was having a “meltdown” and the staff member was frustrated. Staff reported they thought the staff member made the statement as a joke. Staff-in-charge stated the staff member was given a verbal warning. 4. The surveyor observed an eight-month-old child in the Nursery to be placed in a highchair with no buckles. The surveyor observed four (4) highchairs that did not contain buckles. Through interview with staff, the surveyor learned the highchairs have not contained buckles since approximately July 2023. 5. The surveyor observed a red half circle table that contained seats with buckles in the Mobile Infants Classroom; however, two (2) of the seats were observed to not contain buckles. The table measured approximately thirteen and one-half (13 ½) inches from the floor. 6. Through interview with staff, the surveyor learned that children in the Mobile Infants Classroom are not always buckled when seated at a red half circle table. Staff reported they will buckle new children when they are seated at the table. The staff also stated that if children are sick, they will wipe the toys down with Clorox wipes. It was also stated that sometimes toys are put in the dishwasher. The children enrolled in this classroom are one-year-old and not toilet trained. 2) An interview with the staff person in Room 103 found that toys that are plaed in children's mouths are spritzed daily with bleach water. The staff person also stated that approximately once a week she will scrub the toys in soapy water and put them in bleach water and then let them air dry. General: Based on Observation, this regulatory requirement was not met. Upon arrival (9:25AM) the surveyor entered the infant classroom with the staff person in charge and observed two (2) infants sleeping in the infant sleeping room without an adult present. The staff person in charge and the surveyor walked through this room to talk to the two (2) staff that were working in the adjacent infant room. The staff person in charge moved an empty crib that was positioned in the doorway between the two (2) infant rooms to gain access to the room where the two (2) staff were working. The surveyor observed three (3) children present in the room with the two (2) staff. The two (2) infants that were asleep in the adjacent room were not visible from where the two (2) staff were positioned; therefore, adequate supervision was not provided. Staffing Requirements

Upon arrival (9:25AM) the surveyor entered the infant classroom with the staff person in charge and observed an eight (8) month old child asleep in a swing and an eleven (11) week old child asleep in a Bouncy seat that had been placed in a crib. The eight (8) month old had a blanket positioned loose over his entire body from head to toe. Part of the blanket was being used to prop a bottle in the child's mouth. The eleven (11) week old child had a fleece blanket positioned loose over the majority of the infant's body. The blanket came up to the child's nose. General: Based on Observation, the facility failed to ensure that bottles be labeled. At the time of survey, a child in the two (2) year old classroom was observed walking around the classroom with an unlabeled bottle of milk. The staff member stated that the parent of the child dropped the child off with the bottle.

The staff member in charge reported that a criminal records check had not been completed for the employee, but the employee has not been left alone in the presence of a child in care.

General: Based on Observation, the facility failed to ensure that toxic cleaning supplies be inaccessible to a child in care. In the one (1) year old classroom, a bottle of Lysol wipes was found on the floor, next to diaper changing area. The manufactory label on the back of the bottle read, “Keep out of reach of children.” In the toilet room used by the preschool and pre-kindergarten classrooms, a bottle of SpanSan Disinfecting and Deodorizer was found on the floor under the hand washing sink. The manufactory label read, “Keep out of reach of children.” Also in the toilet room used by the preschool and pre-kindergarten classrooms, a bottle of Fast and Easy Hard Surface and Glass Cleaner was found in one of the showers across from the toilet stalls. The bottle’s manufactory label read, “Keep out of reach of children.” On the van used to transport children in care, the following items were found on the floor, next to the steps of the van: one (1) bottle of STP Power Steering Fluid, trash bags, and one (1) bottle of Fast and Easy Hard Surface and Glass Cleaner. The manufactory labels on the bottle of Fast and Easy Hard Surface and Glass Cleaner, and the STP Power Steering Fluid read, “Keep out of reach of children.”

General: Based on Observation, the facility failed to ensure that a sink used for hand washing be equipped with hot and cold running waster that allows for hand washing and be equipped with hot water at a minimum temperature of ninety (90) degrees Fahrenheit. The portable sinks in the preschool and pre-kindergarten classrooms did not have adequate water pressure for running water. The hot water temperature of the sinks measured at seventy (70) degrees Fahrenheit. The sinks did not provide enough water for hand washing purposes.
