General: Based on observation and interview, in the Infant Two Classroom, a child's bottles were not labeled in the refrigerator. When the staff member was asked how she knew who the bottle belonged to, she stated that she just knew but if someone else came in the classroom to give her a break, there was no way they would know who the bottle belonged to.

General: Based on interview and review of documentation, the center failed to maintain compliance with group size regulations. On 10/23/25, there were three (3) staff members with fifteen (15) children, aged one (1) year to two (2) years-old, on the playground. General: Based on interview and review of documentation, the center failed to maintain compliance regarding the rules established in their staff handbook. Their handbook stated that the name-to-face feature for taking attendance in their Brightwheel app must be used "Transitioning children between locations (e.g. classroom to playground, gymnasium, music, etc)." Review of Brightwheel records and interview with staff members found this policy was not followed at the times specified. The handbook stated "The staff member actively conducting the "Name-To-Face check must record their name in the Notes section". Interview with staff and review of Brightwheel documentation found name-to-face checks without a staff member's name.

Based on review of documentation, a staff member (DOH: 01/14/25) did not have proof of educational qualifications in their personnel file.
General: Based on observation, the following was found: Preschool #1 Classroom 1) Excessive buildup of dirt and grime were embedded in the crevices of a Step 2 dramatic play kitchen unit. 2) Excessive tape residue was on top of a shelving unit located in the dramatic play area. Toddler 1 1) Tape residue that accumulated dirt was found on several shelves. Toddler 2 1) Tape residue that accumulated dirt was found on one of the shelves. Early Preschool 1 1) Tape residue that accumulated dirt was found on furniture throughout the room. 2) An area rug with flowers had a corner folded and presented a tripping hazard. General: Based on observation, the following was found: Room 105 (Infant 1) 1. There was tape residue on the top of a wooden shelf that was used to store the blocks. 2. A wooden shelf labeled “Cozy” contained chipped paint on the top and on the shelf edges. 3. Tape residue was observed on the front of a cabinet under the sink labeled “Supplies”. Room 104 (Early Preschool 1) 1. A blue shelf with cubby boxes contained stains on the top. Room 102 (Toddler 1) 1. Tape residue was observed on the end of a wooden shelf that contained musical instruments. Room 210 1. The arms of a child-sized couch, located in the book area, were ripped.
General: Based on observation and interview, Room 103 (Two's 2) contained a diaper changing table that folds down from the wall in the bathroom. The staff member in the classroom indicated that is where the children are diapered and the plastic diaper changing table does not have a pad. The staff member indicated that three (3) children wear diapers in the room. The diapering surface shall be padded. General: Based on review of documentation, the following was found: 1. A staff member (DOH 01/26/24) did not have documentation of completing orientation training, which is required within ninety (90) days of employment. 2. Five (5) staff members (DOH 05/02/22, 09/01/20, 07/31/18, 05/12/22, and 10/14/21) did not complete the required fifteen (15) hours of annual training. 3. Two (2) staff members (DOH 08/01/22 and 07/21/22) had not completed the required PAHT training that is due within the first year of being hired and renewed every five years thereafter at the time of the survey. Based on interviews, the licensee failed to assure the health, safety, and comfort of a child when a staff member placed her legs over the child's legs and restricted the child's movement.
Based on interview, a staff member restricted a child's movement by placing their legs over the child's legs which staff verified by video documentation. An incident of child abuse or neglect shall be reported to the cabinet pursuant to KRS 620.030.
General: Based on interview and review of documentation, on 11/29/23, at approximately 3:02pm, a three (3) year-old child was left on the outdoor play area unsupervised for approximately eight (8) minutes. The teachers took the children inside and left one (1) of the children in the fenced outdoor play area alone. The child was found by another staff member (a toddler teacher) at approximately 3:10pm and was taken to the office. The child did not sustain an injury. One (1) of the preschool staff members went to look for the child on the outdoor play area at approximately 3:11pm. Four (4) staff members hired respectively on 11/7/2022, 5/2/2023, 5/15/2023, and 5/22/2023, did not have TB documentation available for review. 3. General: Based on interview and review of documentation, the facility reported that on 3/24/2023 a child was given the wrong bottle that contained formula. The child's correct bottles contained breastmilk. Director Requirements In Compliance Employee Records In Compliance
General: Based on interview and review of documentation, it was found that a three-year-old child was hit on the back on the head by a staff member. This incident was reported to the parent by the staff member. The parent then spoke with administrative staff about the incident. The child was not injured as a result and the staff member was terminated the next day.
General: Based on interviews, it was found that the child care center failed to maintain the health, safety, and comfort of two (2) children in care. Two (2) infants were bounced too hard in bouncy seats. It was reported that each child's was coming off of the seat as a result of the seat being rocked too hard. Two (2) different staff members witnessed this incident occur.
General: Based on interview, the child care facility failed to maintain the health, safety, and comfort of a two-year-old child in care. It was found that the child had a chair pulled out from underneath him, which resulted in him falling to the floor and hitting his head. In addition, the child was then inappropriately grabbed by the wrist. These two actions were carried out by the same staff member.

A child was injured when another child shut the door on the child's fingers. The parent was not notified about the child's injury until approximately four (4) hours later. General: Based on observation, napping mats were made with sheets and blankets and stacked on top of one another in each classroom, the napping mats were separated by a plastic sheet. A plastic sheet was not used in between two napping mats in the Dalmatians classroom. Additionally, bedding in the Hedgehogs classroom hung over the plastic sheet used to divide the napping mats. Four staff (hire dates: 7/22/13, 11/2/12, 3/28/16, and 6/22/18) did not complete the required 15 hours of cabinet-approved training hours between 7/1/2020 and 6/30/21. 2.) Two staff (hire dates: 10/20/21 and 10/14/21) did not complete the required Orientation training. These staff have been employed for more than three months. 3.) General: Based on interview and record review, this regulatory requirement was not met. On 1/12/2021, a three-year-old child disclosed an allegation of possible abuse to staff members in the Barn Owls Room. The three-year-old told the teachers that her mommy slapped her in the face. A staff member in the Barn Owls Room stated that on 1/12/2021, she reported what the child said to the person in charge. However, the staff person in charge indicated that the statement was not reported until sometime later. Additional interviews found that the staff person in charge set up a meeting between child’s mother and the staff person who initially reported the statement, to discuss the child’s statement. Approximately three weeks passed before the incident was reported to the Cabinet. The incident was not immediately reported to the cabinet as required in the KRS 620.030.
General: Based on interview and record review, this regulatory requirement was not met. On 1/12/2021, a three-year-old child disclosed an allegation of possible abuse to two staff members in the Barn Owls Room. The three-year-old told the teachers that her mommy slapped her in the face. A staff member in the Barn Owls Room stated that she reported the abuse to the staff person in charge on or about 1/12/2021; however the staff person in charge indicated the incident was not reported to her until later. The staff person in charge also indicated the teacher did not communicate that she felt the incident needed to be reported to the cabinet. A meeting was held with the child’s parent and the teacher on 1/19/21. A report was made to the Department for Community Based Services on 2/03/2021. The staff person reported telling the child “shut it or I am going to tape your mouth" because he was not being quiet at naptime. In an interview with the child, he indicated that teacher put tape on him, on his mouth, hands, feed, and legs while he was on his mat. Additional children in the classroom reported observing the staff person put tape on the child. The staff member denied putting tape on the child. However, this regulation states that a child shall not be subjected to threatening, frightening, humiliating, or abusive language. General: Based on observation, the following was found: 1.) In the donkey classroom, there were numerous areas of missing/chipped paint throughout the classroom. 2.) In the piglets classroom, there were areas of missing/chipped paint by the rocking chair and by the door of the room. 3.) In the ponies classroom, there was an area of missing/chipped paint and scuff marks by the exit door leading out to the playground. 4.) In the ducklings classroom, there were areas of missing/chipped paint on the back wall beside where the swings were positioned. 5.) In the mallards classroom, there were areas of missing/chipped paint on the wall underneath the bullentin board, as well as by the kitchen dramatic play area. 6.) In the dalmations classroom, there was an area of missing/chipped paint underneath the window in the classroom. 7.) In the stallions classroom, there was a brown colored substance on the wall in the corner where the nap mats were being stored. 8.) In the emu classroom, there was an area of missing/chipped paint throughout the classroom. 9.) In the bunnies classroom, there were areas of missing/chipped paint throughout the classroom. 10.) General: Based on observation of video surveillance, on 02/17/2020 at approximately 3:45pm a two-year-old child left his class which was on the playground and went inside the building through a side door that had been propped open with a block. The child went down a long hallway and into a large open entrance area of the building that leads outside to the front parking lot, cafeteria or courtyard. The child stood in the entrance area for a few seconds then went into the cafeteria and retrieved a plastic child size shopping cart and was seen again on video approximately one minute later pushing the cart around in the front entrance of the building. During the time the child was in the entrance way with the shopping cart, one adult male came out of the cafeteria, looked at the child then walked past the child down a hallway. Within a few seconds a second adult male came in through the front entrance of the building, walked past the child and straight out onto the courtyard. Approximately thirty (30) seconds later an adult female walked in through the front entrance of the building and looked at the child several times then walked over to the entrance door of the child care facility and requested to be let in. While that adult female waited to be let into the facility another adult female and adult male walked in through the front entrance of the building and both adults looked at the child and the adult male waved to the child but then they both walked past him and into the cafeteria. During that time, someone from the child care facility opened the facility door and the adult female, who was waiting to be let in, was seen talking to the staff person and looking over at the child. A second staff person then came out of the facility door carrying another child and walked over to the two-year-old child, picked him up and took him back into the facility. The child was alone without any adult supervision for approximately three minutes. Per interview with staff, there were three staff present on the playground with nine children. One staff member took in five of the children for diaper changes leaving four children still outside on the playground with the two other staff. The two staff on the playground stated they counted only three children and thought that the other staff had actually taken in six children instead of five children. General: Based on observation, the surveyor noted that the mulch on both playgrounds was sparse and did not provide adequate protective surfacing for the equipment. General: Based on Observation the following was found: 1. A staff person's purse was sitting on the counter next to the hand-washing sink used by the children. A bottle of Miralax was observed to on top of the rest of the contents of the purse. The purse and its contents were accessible to the children in care. 2. There were several cleaners being stored under the sink in the kitchen area of the Schoolage classroom. The door to the kitchen area was open and the cabinet was not locked. General: Based on Observation, it was found that in the dalmation and emu rooms the children's bedding items were touching. In the dalmation room the bedding was located in the children's indivdual cubbies. However, in multiple cubbies the bedding was spilling out and was touching personal items/bedding of the cubbies next to it. In the emu room, the bedding had been placed on the individual mat and the mats were then laid on top of each other causing the material to touch. General: Based on Observation, at the time of the follow-up visit there were thirty-four (34) children ages five to ten (5-10) years old in the school age room with three (3) staff. The maximum group size with the age of the youngest child being five-years-old is thirty (30). An interview with the staff person in charge found that normally the two (2) school age groups are not supposed to combine until aroung 4:30 p.m. each day. General: Based on Observation, at the time of the survey the children in the Donkey's room and the Chicks room were both on the playground. There were fourteen (14) children age two (2) years in the Donkey's room and fifteen (15) children ages two to three (2-3) years in the Chicks room. There were five (5) staff. The children were not in defined groups and were playing as one (1) large group. The maximum group size with the age of the youngest child being a two-year-old is twenty (20). The group size was over by nine (9) children. During an interview with the staff person in charge it was indicated that normally one (1) classroom will play in the gym while the other classroom plays on the playground. General: Based on Interview, it was found that a former staff person in the one (1) year-old classroom, forcefully pulled a one (1) year-old child down on his mat during nap time. In an interview with the former staff person, she stated that she did forcefully pull the child down on his nap mat during nap time because he slapped her in the face and kicked her in her upper torso area. Interviews with three (3) other staff confirmed that they did observe the one (1) year-old child being forcefully pulled to the nap mat during nap time. In an interview with the staff in chrage, she stated that the individual was terminated from employment.

It was reported on 8/22/13 that a child in the toddler classroom was observed hiding under a table and crying when a substitute staff person grabbed a spray bottle to clean the tables. The staff person reported what she had observed to the Assistant Director and Director. During interviews with the classroom staff on 8/23/13, it was revealed that a staff person was spraying the child with water on her legs when she climbed on top of a table that is located in the classroom. The other staff person admitted to spraying the child one (1) time to prevent her from climbing on the table. The Director reported that both staff knew that this particular child was fearful of water. Futhermore, it was revealed that one (1) of the staff made a toddler touch a flower on 8/22/13 when she knew that the child was fearful of flowers. It was reported that the child cried for a long time after she was made to touch the flower. It is important to note that both staff were terminated from employment on 8/24/13.

During a complaint investigation administrative staff acknowledged that a five (5) year old child received injuries to his face (scratches, abrasions, bruising) while in their care on 5/2/12. The two (2) staff identified as being present with the child when the injuries occured stated that they did not observe the child get hurt and indicated that they were not aware of the child being injured until the day after the incident when it was brought to their attention by administrative staff. The child told the DCBS Worker during interview that he was pushed off a piece of playground equipment by another child and got hurt when he landed in the mulch. The child also told the DCBS Worker that he told his teacher what happened. The time of the incident was identified as sometime between 2:30PM - 3:00PM on 5/2/12 and the child was present at the facility until 4:00PM on this day. Staff stated that a staff person from Pre K 2 escorted a child inside to use the bathroom during this time frame and a staff person from Pre K 1 went inside the building for an unknown reason at the same time. A review of the facility attendance records found that thirty-two (32) children (four (4) and five (5) year olds) were present on the playground during this time frame. The facility exceeded the staff/child ratio by four (4) children and the group size by four (4) children, during the time frame that there was only two (2) staff present with the children. However, the facility exceeded the group size by four (4) children during the entire time frame (2:30PM - 3:00PM).

In addition, an administrative staff in the facility was also made aware that this particular staff person could not be in the presence of the children. Based on interviews, it was found that the individual who had been identified as an alleged perpetrator helped with morning drop offs of the children after being identified as an alleged perpetrator.
