General: Based on interview and review of documentation, this regulation was not met. The center failed to protect the health, safety and comfort of a four-year-old child; a staff in the Pre-K classroom inappropriately handled the child when she forcefully threw him down on his cot.

General: Based on interviews, the surveyor found that on 8/23/2022 at approximately 2:30 p.m., a four-year-old child was left in the restroom when her class transitioned to the playground. Staff in the adjacent three-year-old classroom saw the child in the restroom washing her hands. The child said hi to the staff and exited the restroom. She soon returned and told the staff that she did not know how to get outside. The staff realized that the child never went outside with her class and immediately escorted her to the playground and informed her teachers. The staff person in charge confirmed via video footage that the child never went outside with her class. The child was in the restroom/ classroom for approximately seven (7) minutes. The four-year-old staff stated that they miscounted the children and never checked the bathroom stalls prior to going outside. Staffing Requirements In Compliance

General: Based on Review of Documentation, it was found that a child enrolled in the New Beginnings II room was receiving a prescription medication. An interview with staff in the room indicated that the medication is kept in the office. The surveyor was shown where the medication was kept and it was found that it is kept in an unlocked drawer in a cabinet behind a desk in the front room of the office area. Outdoor Play Area
General: Based on Observation, during a tour of the infant/toddler playground a large sandbox with a play kitchen set was observed. The sandbox was not covered and there were no children using the playground at that time. During an interview with the staff person in charge it was indicated that the sandbox is going to removed.
General: Based on Observation, during a tour of the Pre-K room, the Intermediate room and the toddler room there were several nap mats that had edges that were torn and worn. This does not allow for the mat to be adequately sanitized.
General: Based on Observation, during a tour of the Pre-K room the nap mats were observed stacked on top of each other under the sink with no barrier between them. An interview with staff found that the mats are sanitized once a week and that the children do not use the same mat everyday.
General: Based on Review of Documentation and interview, it was found that a four (4) year old child was left unsupervised on a bus sitting outside of the facility for approximately thirty (30) minutes. Review of video footage found that the classroom entered the side door of the facility at 11:14am and the child was observed to be brought back into the facility at 11:38 am. In an interview with the Manager, she stated that the teacher who left the child on the bus had been standing outside of the bus with a group of children for about four (4) minutes prior to them entering back into the facility. The staff in charge of supervising the child stated that she and another staff person took a group of children out to the vehicles to practice loading and buckling the children before an upcoming field trip. This staff stated they buckled the children in and then had the children unbuckle their seatbelts. The staff stated she did not remember going to the back of the vehicle to check that all children had exited. The child was not discovered missing until later when lunch was served. At that time she was found strapped in the car seat, crying.

General: Based on observation, the black geo-textile cloth was coming through the rubber mulch in three (3) areas on the Toddler Playground.
General: Based on review of documentation, the earthquake and tornado drill documentation presented for review did not include the time the drills were completed.
General: Based on observation, the surveyor observed a staff person's red purse on the counter next to the hand-washing sink in the Intermediate Classroom (ages three (3) to four (4) years old).
General: Based on observation, a toilet located in the restroom between the Explorers and Preschool Classrooms had a cracked lid. Hygienic Practices
General: Based on observation, a blue cushioned adult chair located in the Preschool Classroom contained several black stains.
General: Based on Review of Documentation, it was found that the facility could not locate a current copy of the general liability insurance.
General: Based on Review of Documentation, the staff in charge could not locate the transportation routes for the schools the facility transports to each day.
General: Based on Observation, it was found in the school-age room a sheet was posted indicating that a particular child could have "no peanut products" due to an allergy.
General: Based on Observation, the facility did not have a copy of the Kentucky Consumer Product Safety Program's website and information posted.
General: Based on Review of Documentation, one (1) staff person (hire date: 9/9/13) had a child abuse/neglect check (CAN) that was submitted on 9/27/13; therefore, it was not submitted within the regulatory timeframe. The same staff person had a criminal records check (CRC) that was dated 9/25/13. There was no documentation to verify that the CRC was submitted within the regulatory timeframe.

General: Based on Review of Documentation, the surveyor found two (2) staff files (hire dates: 5/6/13, 3/11/13) that did not have proof of education.
General: Based on Observation, of the toddler room there was a sticky substance on the wall near the changing table.
General: Based on Review of Documentation, the surveyor found that one (1) staff file (hire date: 1/28/13) did not have TB skin documentation on file.
General: Based on Review of Documentation, the surveyor found that one (1) staff person (hire date: 5/6/13) has lived in the state of Indiana within the last five (5) years. There was not an out of state background check on file for this staff person.

General: Based on Observation, during a tour of the bathroom located between the toddler and preschool room there was a changing table. The proper procedure for diapering and handwashing after diapering a child was not posted. During an interview with the staff person in charge it was inidcated that the bathroom had been painted recently and the diapering and handwashing procedures had not been put back on the wall. General: Based on review of documentation, the facility did not have an updated annual emergency preparedness plan on file as required by KRS 199.895
General: Based on review of documentation, the fire drill documentation presented for review did not include the time the drills were completed.
General: Based on Review of Documentation, the following was found: 1. One (1) staff person (hire date: 3/26/01) identified as a regular driver had criminal records check (CRC) dated 3/25/14 on file and one (1) staff person (hire date: 3/25/02) identified as a back-up driver had a CRC dated 6/28/13 on file; however, driver history records through the state transportation agency that issued the driver's license had not been obtained. 2. One (1) staff person (hire date: 12/12/04) identified as a regular driver had a CRC dated 3/20/13 on file. This documentation was not obtained through the state transportation agency and had not been obtained within the required timeframe (annual). Programming
General: Based on Review of Documentation, the staff in charge could not locate the facility policy in regards to the loading and unloading of the children and providing adequate supervision in regards to the transporting of the children.
General: Based on Observation, it was found that the chest freezer in the kitchen area contained a broken thermometer inside it. The temperature inside the freezer could not be determined.
General: Based on Review of Documentation, one (1) child (enrollment date: 1/2/13) had an immunization certificate that was no longer current as of 4/30/14.
General: Based on Review of Documentation, two (2) staff eligible did not have evidence of a current staff professional development plan on file in the faciltiy. The professional development plans in their file were dated November 2012.
General: Based on Review of Documentation, the staff in charge could not locate the written orientation policy that specifies the procedures that were taught in orientation training will be implemented by each child care center staff member.
General: Based on Review of Documentation, it was found that some of the rooms contain fish and the facility did not have written parental consent for the children to be in the presence of the fish.
General: Based on Observation, there were many grocery bags in a garbage bag and stored under the sink in the toddlers' bathroom. The children had access to the plastic bags.
General: Based on Observation, there was no thermometers in the refrigerators in the Voyagers room or the Toddlers room.
