The classroom is adjacent to the Fours Classroom and is separated by cubbies and a half door. According to the staff member assigned to the Four's Classroom, the children were napping at the time and remained asleep throughout the incident. She reported she was unaware that the staff member had exited the Discovery Preschool Classroom. The incident was reported to the staff person in charge and subsequently reported to the Division of Regulated Child Care. General: Based on observation and interview, on 07/17/25 at approximately 10:40 a.m., during a walkthrough of the center with the staff-in-charge, the surveyor entered the Toddler Two (2) Room and counted ten (10) children with two (2) staff members present. Nine (9) of the children were one (1) year old, and one (1) child was four (4) years old. When the Surveyor asked why the four (4)-year-old child was in the room, the staff-in-charge responded that she did not know, as the child was the child of an employee and was not enrolled in the center. One (1) of the staff members in the room was the mother of the four (4)-year-old child. The staff-in-charge stated that she did not know the employee had brought her child into the center and that she did not see the employee enter that morning. The staff-in-charge explained that the employee begins work at 9:00 a.m. and is a floater, meaning she had been in several rooms. The staff-in-charge then took the four (4)-year-old child to her office. At approximately 11:05 a.m., the employee, who is the child’s mother, came to the office, took the child, and walked outside, stating that she was going to drop the child off elsewhere.

General: Based on interview and review of documentation, the child-care center failed to provide for the health, safety, and comfort a child in care. 1. On 04/24/24 at approximately 8:00 am, a one-year-old child was pulling up on a low highchair when the highchair tipped over. The highchair landed on top of the child, and as a result the child’s top gum was injured. A staff member walked in as the incident was unfolding and assisted the staff member in charge with administering first aid. Interviews with staff found that the child’s top gum was discolored and continuously bled. The child refused to eat lunch and bled from her mouth during naptime. Based on a review of documentation, there were several spots of blood on the crib sheet. Staff interviews found that the mother was not immediately notified. The child’s mother was notified an hour and a half (1 ½) later via the KinderCare app after the incident. The staff member in charge finally called the mother at noon. The mother transported the child to the emergency department (ED). 2. On 05/03/24 at approximately 10:45 am, a staff member witnessed another staff member mishandle a one-year-old child. The witness immediately notified management. Based on review of documentation, the child’s upper arm was red, resembling a grab mark. It reportedly remained red for approximately forty (40) minutes. General: Based on interview and review of documentation, on 04/16/24, a staff member was observed by another staff member charging a vape pen in the Toddler Room. The staff member then sat on the floor next to the napping children and vaped. Based on interview and a review of documentation, the vape smoke was in the air around the children. Based on a review of documentation, the staff member was a minor. KRS 438.350 prohibits possession or use of tobacco products, alternative nicotine products, or vapor products by persons under twenty-one (21) years-old, which would be against the local ordinance, in addition to the regulation that vaping shall not be permitted in the presence of a child. The facility terminated the staff members employment.
General: Based on interview and review of documentation, on 04/25/24, two (2) four-year-old children went outside with their Pre-Kindergarten class and decided to come back into the classroom without the staff members permission. The two (2) staff members on the playground were not aware that the two (2) children went back into the classroom. The two (2) children were found by another staff member, unsupervised in the Pre-Kindergarten class at 10:45 am; they were found unharmed. The staff members on the playground indicated that name to face attendance was taken at 10:26 am and both children were outside with the group. One (1) staff was tending to children on the playground while, the other staff was writing an incident report for another child on the playground. This incident report was written at 10:36 am. The staff in charge indicated sometime after that is when the children ran back inside the building. The staff in charge indicated that the children were in the classroom unsupervised, anywhere from nine (9) to nineteen (19) minutes. Staffing Requirements In Compliance
General: Based on observation, interview, and review of documentation, the following was found: During initial walkthrough, rooms were found to be chaotic. When asked for the lesson plan in the Pre-K room, staff did not know if they had one or where it was located. The Director finally found a schedule and an undated lesson plan about wild animals. However, staff was not following this lesson plan. Children were playing on their own and apparently not following planned or structured activities. It was determined that a child within the One-year-old classroom was served a food to which they had an allergy on an unknown date in early November of 2022. Pineapple was served to the child; moments later the staff members realized that the child had an allergy to this food item and removed it. On 7/18/21 the facility reported to the DRCC office that a preschool male enrolled at the facility entered the girls' bathroom while a female child was sitting on the toilet using the bathroom. The male child bent down and looked between the female child's legs. Interviews with staff during the investigation revealed that a staff person heard voices in the girls' bathroom and entered the area to see what was going on. The staff person observed the male child squatted down and looking at the female child's genital area. The staff person immediately redirected the male child out of the bathroom. General: Based on review of documentation and interview, this regulatory requirement was not met. The facility failed to meet the medical needs of a two-year-old child with Type 1 diabetes. The following was found: 1. Interviews conducted during the investigation revealed that on 2/23/22, the main administrative staff person assigned to monitor the child's Dexcom device failed to administer insulin to the child in a timely manner when the device signaled an alert that the child's glucose level was low. Staff stated that they called the office multiple times and could not reach the administrative staff person. After several failed attempts, a staff person that works in another classroom opened her classroom door and told the administrative staff person that she needed to check on the child. At this time, a second administrative staff person went into the two-year-old classroom and escorted the child to the office so his insulin could be administered. Staff described the child as being "very sleepy", "sluggish" and saying "my belly hurts". 2. On 2/25/22, the child's Dexcom device showed a low reading (40) for approximately two hours (11:30AM - 1:30PM). The child's parent described the number as being "dangerously low” and stated that when she saw that the reading had been low for two hours; it scared her. Therefore, the parent went to the facility to pick up her child. Once at the facility, she observed the main administrative staff person, who monitors her child's care, in the classroom with him. The administrative staff person did not appear alarmed with her child's condition and stated that she was planning on allowing him to finish his nap before administering his insulin, since there was only 30 minutes left of naptime. 3. The child's parent stated during interview that on more than one occasion, an administrative staff person provided incorrect information to the parent over the phone which caused the child to receive too much insulin. The staff person was trained to review dietary information on food packaging specific to the child’s food intake and provide the carbohydrate information to the parent. The staff person provided "calorie" information instead of "carbohydrate" information to the parent, which caused the calculations to be incorrect, and the child received too much insulin as a result. It is important to note, the administrative staff person attended a training class through UK Health Care on 1/26/22, that was specific to the diabetic care of the child. On 2/28/22, the facility reported an incident to the Division of Regulated Child Care that involved a staff person giving a demonstration of a "bear hug" restraining technique on a preschool child in front of the child's parent on 2/25/22. The staff person told the parent that the “bear hug knocks the wind out to readjust the child”. The staff person was placed on administrative leave effective 2/28/22, and then notified of her termination on 3/8/22.
General: Based on interview, three staff each stated that they witnessed another staff member getting extremely frustrated with two toddler children on 07/22/2021. Staff stated that they witnessed the staff member in question squeeze the children's cheeks, hold them up against the wall, scream into their faces and forcefully sit the children down on the floor for not listening to instruction. General: Based on Interview and record review, 1/25/16 a four (4) month-old infant was fed another infant's bottle. The bottle contained breast milk. One (1) teacher obtained the bottle from the refrigerator and placed it in the bottle warmer to warm the bottle. This teacher instructed the other teacher in the room to get the bottle out of the warmer and feed it to the four (4) month-old child. The staff member that fed the bottle to the child stated that she was new and had only been in the infant room working for 1 or 2 days. The staff member indicated in interview that the bottle had the correct child's name on it and she fed it to the wrong infant as she was instructed by the other teacher. The staff member indicated after a few minutes the four (4) month-old infant's mother arrived to pick her up and she said to the staff member "That's not her bottle!" The staff member then stopped feeding the bottle to the infant. The staff member indicated that she did not feed the child very much of the breast milk bottle before the parent arrived. The staff member estimated it was about a half of an ounce.

General: Based on Interview, it was found that on 12/9/15 between 3:30 and 3:45 p.m. a three (3) year old child was left unsupervised in the Pre-K classroom for approximately two (2) to three (3) minutes. An interview with the staff person who was responsible for the child found he was the only staff person in the room and that the children were lined up at the door in the classroom that leads out to the playground. One (1) child was playing with toys near the cubbies and was asked to get in line. The child got in line and the staff person counted twelve (12) children before going out the door and down the side walk to the fenced playground. The staff person stated that he counted the children again when they got inside the fence and he counted twelve (12) children. However, the staff person stated that the children were already moving around when he did the count. While the children were on the playground the staff person in the room located beside the Pre-K room was sitting on the floor reading books with her children. She heard a rattling sound but did not get up and called out the names of two (2) staff but did not get a response. The staff person heard the rattling noise again so she got up and looked over the diving wall and observed a child playing unsupervised in the block area located by the door to go outside to the playground. The staff person immediatley notified one (1) of the staff in charge and they came and got the child and went to the door leading out to the playground. This staff person asked the staff person on the playground how many children he had and he responded he had twelve (12) children. He was asked the question again and he stated he had twelve (12) children. He was then showed the child he left in the room. A review of records also found that the staff person had documented he had twelve (12) children on his Child Supervision Report (CSR) when he got to the playground. The administrative staff person stated that she went into the infant classroom to discuss something with the staff and further stated that she thought she had left the door open that separates the two classrooms. 2. An interview with staff during the investigation revealed that on 2/16/22, a three-year-old female child entered the preschool classroom from the playground and was found alone and unsupervised in the classroom by a parent walking through the room to pick up her child from the infant classroom. The parent escorted the child to the front office and alerted the staff person in charge of the situation. The staff person in charge escorted the child outside to the playground and informed the staff person assigned to the group about the situation. On 2/18/22, the facility reported the incident to the DRCC office and stated that an internal investigation found that the child was unattended for no more than two minutes. Interviews with staff during the investigation found that during the month of December 2021 and part of January 2022, there was only enough food available for one serving during breakfast, lunch, and snack in all the classrooms. There was no food available for additional portions to be served to the children. Staff stated that a new administrative staff person started working at the facility in December 2021 and started making changes to serving/portion sizes of the food served to the children which did not allow for second helpings of food to be served during mealtime.
