General: Based on observation, four (4) children in the Discovery Preschool Classroom and two (2) children in the Preschool Classroom were observed with blankets completely covering their heads during nap time, at 1:10 pm on 02/11/26. Upon the surveyor’s request, staff members immediately removed the blankets from the children’s heads.
General: Based on interviews, on 02/05/26 from approximately 1:15 p.m. to 1:20 p.m., eight (8) children, age two (2), were left unattended in the Discovery Preschool Classroom. The classroom is adjacent to the Fours Classroom and is separated by cubbies and a half door. According to the staff member assigned to the Four's Classroom, the children were napping at the time and remained asleep throughout the incident. She reported she was unaware that the staff member had exited the Discovery Preschool Classroom. The incident was reported to the staff person in charge and subsequently reported to the Division of Regulated Child Care. General: Based on interview and review of documentation, on 10/14/25, at approximately 7:08 p.m., a picture of a three-year-old child with bruises on the arms was sent to the staff- in-charge. The staff-in-charge did not report this incident for suspected abuse or neglect; therefore, the child care center did not follow their reporting policy. The center policy states, “requires you to immediately report your concerns to your manager, but this is in addition to and not in lieu of your requirement to make a direct report to the local child protection agency or local law enforcement agency”. General: Based on interview and review of documentation, a three-year-old child had bruises on both arms that were discovered on 10/14/25. Several staff members knew about the bruises and saw the bruises and/or pictures on the center’s communication app, but no one made a report for suspected child abuse or neglect to the cabinet. General: Based on interviews, a pair of a child’s soiled and wet underwear was found on top of a cabinet in the Pre-K Classroom by a parent. The clothing was not stored in a container or plastic bag and was accessible to children in care.

General: Based on interview and review of documentation, an incident report about alleged sexual abuse involving a child was altered. General: Based on observation and interview, on 07/17/25 at approximately 10:40 a.m., during a walkthrough of the center with the staff-in-charge, the surveyor entered the Toddler Two (2) Room and counted ten (10) children with two (2) staff members present. Nine (9) of the children were one (1) year old, and one (1) child was four (4) years old. When the Surveyor asked why the four (4)-year-old child was in the room, the staff-in-charge responded that she did not know, as the child was the child of an employee and was not enrolled in the center. One (1) of the staff members in the room was the mother of the four (4)-year-old child. The staff-in-charge stated that she did not know the employee had brought her child into the center and that she did not see the employee enter that morning. The staff-in-charge explained that the employee begins work at 9:00 a.m. and is a floater, meaning she had been in several rooms. The staff-in-charge then took the four (4)-year-old child to her office. At approximately 11:05 a.m., the employee, who is the child’s mother, came to the office, took the child, and walked outside, stating that she was going to drop the child off elsewhere.
General: Based on observation, in the Discovery Preschool Classroom, the diaper changing station is arranged so that the staff member's back was to the children during diaper changes. This does not allow for adequate supervision during diapering.

General: Based on review of documentation and ECE-TRIS, a staff member (DOH 01/29/24) has yet to complete the six-hour cabinet approved orientation training that is required within the first three (3) months of employment. Children's Records In Compliance
General: Based on interview and review of documentation, the child-care center failed to provide for the health, safety, and comfort a child in care. 1. On 04/24/24 at approximately 8:00 am, a one-year-old child was pulling up on a low highchair when the highchair tipped over. The highchair landed on top of the child, and as a result the child’s top gum was injured. A staff member walked in as the incident was unfolding and assisted the staff member in charge with administering first aid. Interviews with staff found that the child’s top gum was discolored and continuously bled. The child refused to eat lunch and bled from her mouth during naptime. Based on a review of documentation, there were several spots of blood on the crib sheet. Staff interviews found that the mother was not immediately notified. The child’s mother was notified an hour and a half (1 ½) later via the KinderCare app after the incident. The staff member in charge finally called the mother at noon. The mother transported the child to the emergency department (ED). 2. On 05/03/24 at approximately 10:45 am, a staff member witnessed another staff member mishandle a one-year-old child. The witness immediately notified management. Based on review of documentation, the child’s upper arm was red, resembling a grab mark. It reportedly remained red for approximately forty (40) minutes. General: Based on interview and review of documentation, on 04/16/24, a staff member was observed by another staff member charging a vape pen in the Toddler Room. The staff member then sat on the floor next to the napping children and vaped. Based on interview and a review of documentation, the vape smoke was in the air around the children. Based on a review of documentation, the staff member was a minor. KRS 438.350 prohibits possession or use of tobacco products, alternative nicotine products, or vapor products by persons under twenty-one (21) years-old, which would be against the local ordinance, in addition to the regulation that vaping shall not be permitted in the presence of a child. The facility terminated the staff members employment.
General: Based on interview and review of documentation, on 04/25/24, two (2) four-year-old children went outside with their Pre-Kindergarten class and decided to come back into the classroom without the staff members permission. The two (2) staff members on the playground were not aware that the two (2) children went back into the classroom. The two (2) children were found by another staff member, unsupervised in the Pre-Kindergarten class at 10:45 am; they were found unharmed. The staff members on the playground indicated that name to face attendance was taken at 10:26 am and both children were outside with the group. One (1) staff was tending to children on the playground while, the other staff was writing an incident report for another child on the playground. This incident report was written at 10:36 am. The staff in charge indicated sometime after that is when the children ran back inside the building. The staff in charge indicated that the children were in the classroom unsupervised, anywhere from nine (9) to nineteen (19) minutes. Staffing Requirements In Compliance
General: Based on observation, interview, and review of documentation, the following was found: During initial walkthrough, rooms were found to be chaotic. When asked for the lesson plan in the Pre-K room, staff did not know if they had one or where it was located. The Director finally found a schedule and an undated lesson plan about wild animals. However, staff was not following this lesson plan. Children were playing on their own and apparently not following planned or structured activities. The child-care center shall provide a daily planned program posted in writing in a conspicuous location with each age group and followed. First Aid/Medication Not In Compliance
General: Based on observation, interview and review of documentation, the following was found: A child with diabetes required monitoring of a Dexcom machine and administration of insulin, but the child care center only had one (1) trained staff member who could attend to this child's needs. If that staff member was unavailable or on leave, the center did not have another trained staff member who could monitor the Dexcom machine or could administer insulin to the child when the child's blood sugar levels became elevated, which put the child's life at risk. A licensee shall be responsible for the operation of the child-care center pursuant to this administrative regulation, 922 KAR 2:120, and 922 KAR 2:280; and protect and assure the health, safety, and comfort of each child. Additionally, the surveyor entered the One-to-Two-Year-Old classroom at 2:19 p.m. and observed that the 12:00 p.m. and 2:00 p.m. timeslots on the CSR sheet were not completed.
General: Based on review of documentation, the child-care center failed to meet this regulatory requirement. A staff member named as an alleged perpetrator in an investigation accepted by the Department for Community Based Services, (DCBS), was not removed from direct contact with children. The staff member continued to work as the lead teacher in the two-year-old classroom from 2/14/2023-2/27/2023. The staff member who was in charge during the incident indicated that she was unaware that the staff member could not work with children for the duration of the investigation. General: Based on interview, this regulatory requirement was not met. It was determined that a child within the One-year-old classroom was served a food to which they had an allergy on an unknown date in early November of 2022. The two staff members working in this classroom were not the regular staff that are typically in this classroom. Pineapple was served to the child; moments later the staff members realized that the child had an allergy to this food item and removed it. However, the child had eaten a few bites of pineapple and had a mild allergic reaction.

On 7/18/21 the facility reported to the DRCC office that a preschool male enrolled at the facility entered the girls' bathroom while a female child was sitting on the toilet using the bathroom. The male child bent down and looked between the female child's legs. Interviews with staff during the investigation revealed that a staff person heard voices in the girls' bathroom and entered the area to see what was going on. The staff person observed the male child squatted down and looking at the female child's genital area. The staff person immediately redirected the male child out of the bathroom. General: Based on review of documentation and interview, this regulatory requirement was not met. The facility failed to meet the medical needs of a two-year-old child with Type 1 diabetes. The following was found: 1. Interviews conducted during the investigation revealed that on 2/23/22, the main administrative staff person assigned to monitor the child's Dexcom device failed to administer insulin to the child in a timely manner when the device signaled an alert that the child's glucose level was low. Staff stated that they called the office multiple times and could not reach the administrative staff person. After several failed attempts, a staff person that works in another classroom opened her classroom door and told the administrative staff person that she needed to check on the child. At this time, a second administrative staff person went into the two-year-old classroom and escorted the child to the office so his insulin could be administered. Staff described the child as being "very sleepy", "sluggish" and saying "my belly hurts". 2. On 2/25/22, the child's Dexcom device showed a low reading (40) for approximately two hours (11:30AM - 1:30PM). The child's parent described the number as being "dangerously low” and stated that when she saw that the reading had been low for two hours; it scared her. Therefore, the parent went to the facility to pick up her child. Once at the facility, she observed the main administrative staff person, who monitors her child's care, in the classroom with him. The administrative staff person did not appear alarmed with her child's condition and stated that she was planning on allowing him to finish his nap before administering his insulin, since there was only 30 minutes left of naptime. 3. The child's parent stated during interview that on more than one occasion, an administrative staff person provided incorrect information to the parent over the phone which caused the child to receive too much insulin. The staff person was trained to review dietary information on food packaging specific to the child’s food intake and provide the carbohydrate information to the parent. The staff person provided "calorie" information instead of "carbohydrate" information to the parent, which caused the calculations to be incorrect, and the child received too much insulin as a result. It is important to note, the administrative staff person attended a training class through UK Health Care on 1/26/22, that was specific to the diabetic care of the child. General: Based on review of documentation and interview, this regulatory requirement was not met. On 2/28/22, the facility reported an incident to the Division of Regulated Child Care that involved a staff person giving a demonstration of a "bear hug" restraining technique on a preschool child in front of the child's parent on 2/25/22. The staff person told the parent that the “bear hug knocks the wind out to readjust the child”. The staff person was placed on administrative leave effective 2/28/22, and then notified of her termination on 3/8/22.

General: Based on interview, three staff each stated that they witnessed another staff member getting extremely frustrated with two toddler children on 07/22/2021. Staff stated that they witnessed the staff member in question squeeze the children's cheeks, hold them up against the wall, scream into their faces and forcefully sit the children down on the floor for not listening to instruction. Staff stated that the staff member in question got very frustrated with the children and seemed to be very off that day. Staff stated that they reported their concerns to upper management and it was then reported to DCBS and the Cabinet. The staff person was removed from the classroom. Programming Not In Compliance

General: Based on interview, a staff person fell asleep while on duty in the preschool classroom during naptime on 4/15/2021. The staff person’s co-worker stated that he was asleep for approximately ten minutes before she “nudged” him awake. It is important to note, the staff person was terminated because of the incident.

On 4/22/2021, one staff observed another staff member push a two-year-old child down on the ground by his arm in a rough manner while they were on the playground. When the child refused to sit down because he was throwing mulch /dirt, the two-year-old child was then pushed against a chain link fence on the playground and held by the staff member who was using her body weight against the fence. Based on interviews, this staff member has been observed being rough with the children, picking them up by one arm. Based on interviews, this staff member has been heard belittling the children and calling them names such as "Fat little girl", because a child took another child's snack. General: Based on Interview and record review, 1/25/16 a four (4) month-old infant was fed another infant's bottle. The bottle contained breast milk. One (1) teacher obtained the bottle from the refrigerator and placed it in the bottle warmer to warm the bottle. This teacher instructed the other teacher in the room to get the bottle out of the warmer and feed it to the four (4) month-old child. The staff member that fed the bottle to the child stated that she was new and had only been in the infant room working for 1 or 2 days. The staff member indicated in interview that the bottle had the correct child's name on it and she fed it to the wrong infant as she was instructed by the other teacher. The staff member indicated after a few minutes the four (4) month-old infant's mother arrived to pick her up and she said to the staff member "That's not her bottle!" The staff member then stopped feeding the bottle to the infant. The staff member indicated that she did not feed the child very much of the breast milk bottle before the parent arrived. The staff member estimated it was about a half of an ounce.
General: Based on Interview, it was found that on 12/9/15 between 3:30 and 3:45 p.m. a three (3) year old child was left unsupervised in the Pre-K classroom for approximately two (2) to three (3) minutes. An interview with the staff person who was responsible for the child found he was the only staff person in the room and that the children were lined up at the door in the classroom that leads out to the playground. One (1) child was playing with toys near the cubbies and was asked to get in line. The child got in line and the staff person counted twelve (12) children before going out the door and down the side walk to the fenced playground. The staff person stated that he counted the children again when they got inside the fence and he counted twelve (12) children. However, the staff person stated that the children were already moving around when he did the count. While the children were on the playground the staff person in the room located beside the Pre-K room was sitting on the floor reading books with her children. She heard a rattling sound but did not get up and called out the names of two (2) staff but did not get a response. The staff person heard the rattling noise again so she got up and looked over the diving wall and observed a child playing unsupervised in the block area located by the door to go outside to the playground. The staff person immediatley notified one (1) of the staff in charge and they came and got the child and went to the door leading out to the playground. This staff person asked the staff person on the playground how many children he had and he responded he had twelve (12) children. He was asked the question again and he stated he had twelve (12) children. He was then showed the child he left in the room. A review of records also found that the staff person had documented he had twelve (12) children on his Child Supervision Report (CSR) when he got to the playground. General: Based on Observation, during a tour of the facility the kitchen door was observed propped open. The 3-5 year-old preschool classroom is located adjacent to the kitchen. There were nine (9) children present in the 3-5 year-old room and these children had access to the kitchen during the relicensure survey. Two (2) knives were observed in the kitchen on the side of the 3 compartment sink.
General: Based on Observation and record reviewn a staff member was working alone with five (5) toddlers during the relicensure survey and she did not have a completed CAN check or criminal records check on file. This staff member was hired on 9/25/14. The staff schedule indicated that this staff member works alone Monday through Friday from 7:30 AM until 4:30 PM. Both the CAN check and the criminal records check were mailed 9/17/14, but no results were on file for either background check. Another staff member hired on 4/24/15 had lived in Washington within the past five (5) years and the facility did not have an out-of-state criminal records check on file for this staff member. Further interview found that an additional child had been sent inside to go to the bathroom but that child had returned to the playground. It is unclear as to how long the child had been left unsupervised. An interview with the staff person in charge found that both staff failed to follow the facility's written policies regarding supervision in general as well as sueprvision for the playground and bathroom.

Twos: Based on Observation, three (3) of the cots used by the children for nap time were being used as "couches" in the classroom. The cots had been covered with sheets, pushed against the wall and pillows added at the wall to resemble a couch. The children were observed sitting and walking on the "couches" at the time of the survey. According to the staff person present, the cots are not sanitized before the children use them at nap time. The sheets being used to make the cots "couches" were porous and would allow contaminates to reach the surface of the cots.

A staff member walked in as the incident was unfolding and assisted the staff member in charge with administering first aid. Interviews with staff found that the child’s top gum was discolored and continuously bled. The child refused to eat lunch and bled from her mouth during naptime. Based on a review of documentation, there were several spots of blood on the crib sheet. Staff interviews found that the mother was not immediately notified. The child’s mother was notified an hour and a half (1 ½) later via the KinderCare app after the incident. The staff member in charge finally called the mother at noon. General: Based on interview, this regulatory requirement was not met. An interview with staff during the investigation found that in early February 2022 (exact date could not be determined), two staff working in the infant classroom had 13 children (infants and one-year-olds) in their care for approximately 10 - 15 minutes before another staff person arrived to split up the groups into their own classrooms. Staff stated that the second staff person assigned to the infant classroom arrived to work approximately 30 minutes late which caused the staffing issue. Since the youngest child in the group was an infant, the minimum staff to child ratio would need to be one staff person for five children and the maximum group size would need to be 10 children. A two-year-old child receives insulin injections approximately two times a day while in care at the facility; however, there is no record of this on file. An interview with staff during the investigation revealed that on 1/31/22, a five-year-old male child was left alone and unsupervised in the preschool classroom for approximately 5 - 10 minutes. An administrative staff person was assigned to work in this classroom for one hour during naptime while another staff person went on her lunch break. During this time, a staff person that was returning from her break entered the room and observed the child sitting up on his cot watching cartoons on a tablet. There was no adult present in the classroom at the time and there were no other children present in the room. The room was dark because it was naptime. The staff person that entered the room stated that she remained in the preschool room with the child until the administrative staff person returned to the room 5 - 10 minutes later. The administrative staff person stated that she went into the infant classroom to discuss something with the staff and further stated that she thought she had left the door open that separates the two classrooms. 2. An interview with staff during the investigation revealed that on 2/16/22, a three-year-old female child entered the preschool classroom from the playground and was found alone and unsupervised in the classroom by a parent walking through the room to pick up her child from the infant classroom. The parent escorted the child to the front office and alerted the staff person in charge of the situation. The staff person in charge escorted the child outside to the playground and informed the staff person assigned to the group about the situation. On 2/18/22, the facility reported the incident to the DRCC office and stated that an internal investigation found that the child was unattended for no more than two minutes. An interview with the staff and a review of facility documentation during the investigation found that the child was unattended for approximately two - seven minutes; the exact amount of time could not be determined. General: Based on interview, this regulatory requirement was not met. Interviews with staff during the investigation found that during the month of December 2021 and part of January 2022, there was only enough food available for one serving during breakfast, lunch, and snack in all the classrooms. There was no food available for additional portions to be served to the children. Staff stated that a new administrative staff person started working at the facility in December 2021 and started making changes to serving/portion sizes of the food served to the children which did not allow for second helpings of food to be served during mealtime. The administrative staff person told the staff that children at the facility were eating too much, and she would only allow for the required amount of food per age group to be served to the children. Several staff stated during interview that some of the children asked for more food and cried when they were told that there was no more food available for them. Staff further stated that a food program specialist met with the administrative staff person and the issue has now been resolved.

A review of a child's file during the investigation found a 16 page packet of forms labeled "Checklist for Enrolling Children with Diabetes". The child has a Type 1 diabetes diagnosis and requires insulin injections after every meal. The child has a diabetes medical management plan from UK Health Care in his file, along with medication permission forms; however, the facility's "Checklist for Enrolling Children with Diabetes" packet was blank. This packet includes a form to list the names and signatures of staff that are trained, a diabetes care worksheet and an agreement form that the parent and staff providing care are supposed to sign off on. A strap made of ribbon was attached to the end of the pacifer and then secured to the front of the infant's clothing with a clip. In addition to the dirt being exposed, a black plastic water drain was visible near the end of of one of the slides and near the edge of a wood plank used to contain the mulch in the area. There was no name as to to who this belonged to on the tube inside the baggy. During an interview with the director it was found that she was unsure as to who this belonged to and what it was used for. General: Based on Review of Documentation, one (1) staff member that was hired on 9/30/11 had completed only 2.50 hours of training within her completed training year.
General: Based on Observation, the infant room had a lesson plan posted that was outdated. The posted lesson plan was from June. The Discovery Preschool, 2 year-old room, had a blank lesson plan posted. The school-age room did not have a posted lesson plan.
General: Based on Review of Documentation and interviews, the facility transported children after school during the school year and there were no monthly emergency procedures practiced and documented prior to June 2015.
General: Based on Observation, the 2010 Cheverolet Express Bus, used to transport the children, did not have a flashlight or a thermometer in the first aid supplies.
General: Based on Review of Documentation, a pre-trip inspections were not properly documented on 6/16/15 for the Shillito Park field trip, as well as on 6/18/15 for the Children's Garden field trip. The pre-trip inspections were not dated for these trips.
General: Based on Observation, one (1) bottle in the infant room refrigerator was uncovered.

General: Based on Interview, it was found that on 5/19/14 a five (5) year old child was found alone in the preschool room playing with blocks. The staff person in charge stated staff informed her they had sent her inside to use the bathroom while the remainder of the children played on the playground. Further interview found that an additional child had been sent inside to go to the bathroom but that child had returned to the playground. It is unclear as to how long the child had been left unsupervised. Staffing Requirements
General: Based on Observation, staff member hired on 05/08/2013 failed to complete the required hours for the 2013 - 2014 employment year ( 6 of 15 hours). Staff member hired on 08/27/2013 failed to complete orientation within the required time frame (completed on 01/01/2014).
General: Based on Observation, lesson plans were not dated in the classrooms that were surveyed.
General: Based on Observation, the air return vent in Preschool 1 Classroom beside the sink in the wall had visible dust and was in need of cleaning.
General: Based on Observation, the stand-up freezer had food particles that were frozen into an iced bottom, as if something had been spilled and not properly cleaned.

General: Based on Review of Documentation, there were two (2) staff with the hire dates of 03/29/2012 and 05/08/2013 with did not have a current professional development plan in their employee files.
General: Based on Review of Documentation, the facility failed to have transportation routes for two (2) recent field trips taken on 5/30/13 and 6/11/13.
