General: Based on observation, two caterpillar climber/tunnel play structures were not placed on a protective surface on the playground. The climber/tunnels were approximately three feet tall and were placed directly on the grass/dirt. General: Based on observation, the School-age classroom being used at the time of the investigation measured 96.5 square feet. The capacity for this room is limited to two children. At the time of the investigation, there were three children and one staff person in the classroom. Outdoor Play Area Not In Compliance
General: Based on observation and interview, the following was found: 1. Upon entering the facility for her shift at 6:30 a.m. on 11/3/2020, a staff person informed the staff person in charge that she had a "horrible" headache and that her whole body hurt. The staff person reported that she requested to leave early due to the symptoms. However, this staff person was asked to work a second shift in the Three's classroom, and stayed until 6:00 p.m. 2. The block area and the book area of the School-age classroom were located in the front hallway of the facility. There was no barrier between these areas and the main hallway. All children and staff enter the facility through the main hallway. 3. An eight-year-old child was observed in the School-age classroom with no face covering on his face. 4. A staff person witnessed three other staff persons taking turns using the same computer for a facility-wide training. The staff person stated that the computer was not cleaned or sanitized between uses. 5. In interviews with staff, it was determined that on 11/3/2020, two staff persons took a 15 minute break together in one of the staff person's car. According to staff, masks were removed while in the car due to eating and drinking.

General: Based on interview and review of documentation,the child-care center failed to meet this regulation. On 8/14/2020, at approximately 11:40 a.m., a four-year-old child went to the restroom, retrieved a broom, and injured his bottom lip on the broom handle. The child went to the hospital where he received one stitch to close the wound. In short, the broom was accessible to the child, and as a result, he was injured. Employee Records In Compliance
General: Based on review of documentation and interview with the staff person in charge, it was found that the facility is no longer providing transportation and has removed all vehicles from the premises. Further interview with the staff person in charge found that they have not transported children since the summer of 2019. A review of DRCC files found that a written request to remove transportation had not been submitted. General: Based on observation, during a tour of the facility the following was found: 1) In the Infant A room, there were numerous soft toys that included dolls, puppets, soft books and vegetable shaped stuffed cloth toys. 2) In the Preschool Room, there were numerous stuffed animals, soft cloth puppets and dress-up clothes. 3) In the Toddler A and the Toddler B rooms, there were stuffed animals, soft cloth puppets and dress up clothes. The emergency regulation does not allow for washable toys and materials to be present in the classrooms.
General: Based on observation and interview, it was found that dietary restrictions and allergies of the children enrolled were posted in public view in most of the classrooms. The document posted contained the child's name, a picture of the child and any allergies and dietary resrtictions. An interview with the staff person in charge found that they had not obtained parental permission to post this confidential information. The bathroom floor was sticky in the preschool room, the two (2) year-old room, the Pre-K room, and the school-age room. 2. The rug in the preschool room with the sunshine and rainbow on it contained food crumbs and debris. 3. The windows were scratched or marked with crayons (the lower sections) in the preschool room, the two (2) year-old room, and the toddler room. 4. The wall next to the diaper changing table in the two (2) year-old room contained an excessive amount of crayon marks and smudges. 5. The wall outside the bathroom in the two (2) year-old room contained a clear toothbrush holder that had a brown substance trapped behind it. 6. The wall outside of the bathroom in the Pre-K room (below the telephone) contained an excessive amount of crayon marks and smudges. 7. General: Based on Interview, a four-year-old child was left on the playground unsupervised for at least twenty-five (25) minutes on 09/29/17. The name-to-face documentation for the classroom indicated that at 11:00 am nineteen (19) children were taken outside. The same log indicates that at 11:30 am nineteen (19) children were brought back inside. There were two (2) staff present with the nineteen (19) children. Interviews with the staff involved determined that the children were counted as they lined up to come inside. Prior to coming inside there were two (2) behavioral incidents to which staff attended. Once the children returned to the classroom a name-to-face count was not done. A staff assigned to the classroom returned from her break and noticed two (2) coats on the floor. One of the coats belonged to the child that was left outside. Viewing the coat caused the staff to look for the child. She saw the child on the playground from the window.

General: Based on Review of Documentation, observation and interview, this regulatory requirement was not met. The following was found: 1. One (1) staff person (hire date: 5/23/17) did not have evidence or results of a criminal records check (CRC) on file prior to being left alone with children. The surveyor observed this staff person working alone with nine (9) children in the preschool classroom during the inspection. The staff person in charge stated that she thought the facility corporate office processed CRC's on new hires; however, she found out during the visit that this was not done. 2. Five (5) staff (hire dates: 2/8/17, 6/23/16, 4/5/17 and 2 on 5/16/17) did not have evidence or results of a CRC on file. During a tour of the preschool classroom the surveyor observed a section of the floor near the children's bathroom that was unclean. A black sticky residue was observed on the floor. During the inspection the surveyor observed a First Steps Agency therapist working with a child present in the two (2) year old classroom. General: Based on Review of Documentation, there was nothing showing that fire drills had been completed in 2015. The staff person in charge said they had done them, but she could not locate the paperwork which showed this.

General: Based on Observation, there was a cabinet in the Toddler Room that was unlocked and contained staples that were accessible to the children. The staff person in charge said that they have contacted maintenance to fix it but they have not done so yet.

General: Based on Interview, and review of documentation, an eight (8) month old infant was fed the wrong bottle on 8/24/15 at approximately 10:30 a.m. According to interviews, the infant was fed a three (3) ounce bottle of breast milk instead of an eight (8) ounce bottle of formula. This occurred as a staff person came into the infant classroom to give another staff person a lunch break. According to the facility's policy, breast milk bottles are identified by using a red label along with the child's name. Staff stated that the red label had come off of the bottle that day. It is important to note that deficiencies were issued for a similiar incident that occurred on 2/18/14. Since this second occurrence, a new bottle feeding procedure has been put into action and staff have been retrained.
General: Based on Interview, it was found that on 6/19/15 an eight (8) month old child was fed another child's formula bottle. The bottles were properly labeled and the staff person working in the classroom at the time had a form signed in her file acknowledging that she had been trained on proper procedures for bottle feeding; however, proper procedures were not followed. The child consumed the entire bottle. The staff person was not aware of the incident until the parent arrived to pick up the child and found a bottle that did not belong to the child in the child's diaper bag.

General: Based on Observation, there was an uncovered electrical outlet in the Pre-K classroom.
General: Based on Review of Documentation, the disaster plan presented at the time of the survey that included the requirements listed in KRS 199.895 had not been updated or submitted to the local Emergency Management office since 2013 as required.
General: Based on Observation, there were several plastic bags, a can of Lysol spray and a bottle of Lysol toilet cleaner in an unlocked cabinet under the sink in the School-age classroom. These items were accessible to the children in care.
General: Based on Review of Documentation, 1. Children enrolled 5/28/14 and 4/10/15 did not have a physician’s name and contact information or the name of a preferred hospital on file in the facility. 2. Child enrolled 5/13/11 did not have the name of a preferred hospital on file in the facility.
General: Based on Observation, 1. There was a fist-size hole in a ceiling panel in the hallway leading to the bathroom in the Pre-K classroom. 2. The bathroom ceiling vent in the Toddler classroom had an accumulation of dust and dirt on the vent slats.
General: Based on Review of Documentation, every staff member signs an applicant certification agreement and release form upon hiring. It states, "I hereby acknowledge that Knowledge Learning Corporation has a zero tolerance policy for abuse and neglect of any kind against a child, intentional or not. Any act or omission, intentional or not, that is abusive to a child will be dealt with immediately and if criminal in nature will be referred to the authorities for action." On 12/14, the Assistant Director witnessed a staff person dragging a three (3) year old child by the arm a short distance and using her foot to assist in shoving the child's body. This was reported to the Director. Per written statement from the Director, on 01/15/15 the Director was giving a tour of the facility for a prospective family when the same staff person began banging on the window of her classroom very hard which scared both the Director and the family. The Director found out that the staff person was trying to get someone's attention to remove a child from her classroom. On 01/29/15 the director was told that this staff person in question can sometimes be harsh with her tones to the children and gets easily frustrated when things do not go her way. On 01/30/15 the Assistant Director witnessed the same teacher standing in her classroom doorway holding up the arm of a three (3) year old child, who was crying, while the child sat on the floor partially in the doorway. He stated that the teacher was hitting the child with the door trying to shut it. He stated that the teacher then drug the child by the arm out of the doorway and used one of her legs against the child's body to move the child into the hallway so she could shut the door. This was reported to the Director. On 02/02/15 the Director overheard the staff person in question screaming at another staff person in the presense of children. On 03/09/15 the Assistant Director witnessed the same teacher drag a three (3) year old child by the arm approximately twenty four (24) feet across the classroom. She drug the child through some stacked chairs and then forced the child to the ground where she then pointed her finger at the child and raised her voice to him in a very negative tone. This was reported to the Director. The Director met with the staff person in question to discuss some of the incidents but she was allowed to remain in the classroom working alone after all of the reported incidents. On 03/10/15 the staff person in question was terminated from her position with the facility.
General: Based on Interview, the Assistant Director stated that on 03/09/15 at 3:45pm he was in his office and overheard a staff member yelling at the children. He stood at a window that looks into the classroom and saw the staff member walk over to a three (3) year old child and grab him forcefully by the left arm and drag him so harshly that the child's feet were dragging for more than half of the distance. He stated that she ran his body into a stack of chairs which was forceful enough that the chairs moved and then pulled him over to the cubby area. The distance from the table to the cubby area is twenty four (24) feet. He stated that once she was at the cubby area she used her strength to force him to the ground and pointed her finger in his face and raised her voice at him in a very negative tone. He stated that she told him, "You do not tell me no. I am the boss in this classroom." He stated that he immediately called his director who told him not to do anythig at this time. He stated that he then took two (2) more children to this same classroom and the teacher said to one (1) of the children, "I'm going to tell you, the first time you mess up in here, you're leaving my room." He stated that he noticed the child who was dragged had calmed down but he did not physically check on the child. He stated that at 4:00pm another center director arrived and was informed of the incident. She decided to stand at the window and observe this teacher for approximately fifteen (15) minutes. She stated that during that time period she observed the teacher using a tone of voice that was inappropriate and she punished a child whose choice she did not like by writing his name on the wall. She stated that she observed the teacher being distant and not interacting with the children. The teacher stayed in the classroom with the children until she left at 5:20pm. The staff person came back to work the following morning at 8:00am and worked until 8:30am in the same classroom. At that time she was brought into the office where her employment was terminated. It also needs to be noted that the parent was not told of the incident until the following evening when she came in to pick up the child. It needs to be noted that the Assitant Director also witnessed this same teacher grab a three (3) year old child over two (2) months ago by the arm and drag her over to the library area. He stated that it was not forceful and that maybe it was an isolated incident. He stated that he would keep an eye on her. He also stated that there was yet another incident involving the same teacher and same three (3) year old child which happened on 01/30/15. He stated that this teacher was standing in the doorway of her classroom holding the child's arm up while the child sat in the doorway on the floor crying. He stated that she told him, "I need you to remove her from my room. She is crying and she can't come back in." He stated that he told her that he needed to finish delivering snack but would be back and when he came back around to that classroom he noticed that the teacher was tryng to shut the door with the child part way in the door frame. He stated that as he noticed her hitting the child's legs with the door, she was still holding onto the child's arm and trying to drag her by the arm out of the door frame. She was using one of her legs against the child's body to assist in moving her away from the door so she could shut the door. He stated that he stopped her and the teacher left the child crying in the hallway and went back into the classroom. He stated that he helped her up and returned her to her classroom and closed the door. He stated that he reported this to the center director. It also needs to be noted that another teacher has expressed concerns that the teacher in question is sometimes harsh with her tones to the children and gets easily frustrated when things do not go her way. There have also been incidents that the director noted where the teacher in question was heard by the director yelling at another staff member with children present and the director witnessed the teacher ignore a child climbing on a shelf. General: Based on Review of Documentation, interview and observation this regulatory requirement was not met. On 7/2/14 it was reported to the DRCC office that a preschool child enrolled at the facility told his parent that another child in his classroom had showed him how to play a game called "butts and penis". Written statements obtained from staff and interviews that were conducted with staff during the investigation revealed that on 7/1/14 at approximatley 11:00AM one (1) staff person (hire date: 4/2/13) was caring for eleven (11) children (four (4) and five (5) year olds) alone in the Pre K classroom when three (3) boys were found playing alone in the bathroom and participating in an inappropriate activity. The staff person working in the Pre K classroom described the situation by stating, "Three (3) boys went into the bathroom as I was helping a child with a project. I did not see them go into the bathroom, however, I heard them and immediately went to tell them to get out. When I entered the bathroom they were trying to hide under the sink and beside the toilet. They were laughing and hiding so I told them to go play and reminded them that only one person was allowed in the bathroom at a time. Later that day while I was covering a break in the PreK room one of the boys told me that the two (2) boys that were in the bathroom with him showed him their penis and butts, but he never said that anyone touched him". The staff person escorted the surveyor on a tour of the Pre K classroom during the investigation and identified where she was standing when the incident occurred. The staff person stated that she was helping children with an art project at the activity table closest to the classroom door when she heard the boys laughing in the bathroom and stated, "I couldn't see the entrance to the children's bathroom from where I was standing so that's why I didn't see them go in there". The staff person that is the lead teacher in the Pre K classroom wrote the following on her written statement, "On 7/1/14 I had to redirect two (2) children from the restroom. They were playing in the restroom together". The staff person identified the names of the two (2) children in her written statement. It is important to note that these two (2) children are the same ones that were identified as being present in the bathroom with the child that reported concerns to his parent. One (1) staff person was working alone in the Pre K classroom at the time of the incident. The activity that the staff person was involved in was not positioned in an area to allow her to adequately supervise the children's activities throughout the classroom and bathroom area. General: Based on Observation, during a tour of the facility it was found that one (1) of the classrooms had been divided into two (2) rooms using shelves and the changing table and gates. The side of the room with the bathroom was the Discovery Preschool Room and had eight (8) childern who were two (2) years old and one (1) staff person. The other side where the door to enter the room is located is the Toddler # 2 and had five (5) children who were twenty-one (21) months old and one (1) staff person. In order to get to the Discovery Preschool side of the room you must enter the door located on the side where the Toddler # 2 children are located and walk through to get to the Discovery Preschool space.
General: Based on Review of Documentation, presented at the time of the survey there was only documentation for one (1) staff meeting for 2013.
General: Based on Observation, it was found that first aid supplies on Bus # 1 did not include a first aid book and liquid soap and Bus # 2 did not have liquid soap.

General: Based on Interview, on 2/18/14 a toddler was fed a breast milk bottle that was not her bottle. The staff member came into the toddler room on 2/18/14 and she was giving another staff member a break and she took a bottle out of the bottle warmer and fed it to a toddler in the class. The staff member indicated in interview that she thought that the child she fed the bottle to was the only breast fed child in the room, but that was not the case. Based on interviews the bottle was labeled with the correct child's name on it.

The staff person in charge stated that a second infant room staff person arrived to work at 8:00AM; therefore, the infant classroom was not in compliance with staff-to-child ratios for approximately ten (10) minutes.

General: Based on observation and review of documentation, it was found that the time of day the fire drill was conducted was not documented for fire drills conducted on 6/26/2020 and 7/10/2020. The time the drill was conducted is required to be documented for each drill. Furthermore, it was found that there was no documentation to verify that a fire drill had been conducted for November and December 2019. A fire drill is required to be conducted and documented monthly including the date, time and names of children who participated.
General: Based on observation at the time of the survey conducted on 8/17/2020, there were eight children ages 3-7 years old in the Preschool Room. An interview with staff found that the child who was seven-years-old is the sibling of another child in the classroom. An interview with the staff person in charge found that the corporate office informed them it was acceptable to have the seven-year-old child in the Preschool Room in order to keep families together in one classrooms due to COVID19. It was further stated through interviews with staff that materials are printed off for the seven-year-old child to complete while in the classroom. The staff person in charge also stated the child was only to be at the facility for two weeks. An observation of materials in the classroom found that they were geared to preschool age children and not school age children. General: Based on Interview, on 03/09/15 the Assistant Director witnessed a staff person using inappropriate discipline with a preschool child. He immediately contacted the Director, who was out of town, asking what he should do and the Director told him not to remove the staff person at this time. A Director from another facility was notified of the incident and came to the facility to offer support to the Assistant Director. DCBS and the licensing surveyor interviewed the Assistant Director on 03/10/15 and he again stated that he reported the incident immediately to the Director and was told not to remove the staff person. Written statements from the Assistant Director stress the need to remove the staff person from the facility. The licensing surveyor conducted a phone interview with the Director from the other facility on 03/12/15 and she never mentioned that the staff person should have been taken out of the classroom. On 03/16/15, DCBS and the licensing surveyor met with the Director and the District Manager and the Director stated that she told the Assistant Director to remove the staff person from the classroom immediately. DCBS and the licensing surveyor contacted the Director from the other facility on 03/16/15 and she then stated that she advised the Assistant Director to remove the staff person from the classroom but he did not remove her. It needs to be noted that statements from the Director have changed since the incident was first reported. It also needs to be noted that verbal and written statements from the Director of the other facility have changed since the incident was first reported. General: Based on Observation, the Assistant Director stated that on 03/09/15 at 3:45pm he was in his office and overheard a staff member yelling at the children. He stood at a window that looks into the classroom and saw the staff member walk over to a child and grab him forcefully by the left arm and drag him so harshly that the child's feet were dragging for more than half of the distance. He stated that she ran his body into a stack of chairs which was forceful enough that the chairs moved and then pulled him over to the cubby area. The distance from the table to the cubby area is twenty four (24) feet. He stated that once she was at the cubby area she used her strength to force him to the ground and pointed her finger in his face and raised her voice at him in a very negative tone. He stated that she told him, "You do not tell me no. I am the boss in this classroom." He stated that he immediately called his director who told him not to do anythig at this time. He stated that he then took two (2) more children to this same classroom and the teacher said to one (1) of the children, "I'm going to tell you, the first time you mess up in here, you're leaving my room." He stated that he noticed the child who had been dragged had calmed down but he did not physically check on the child. He stated that at 4:00pm another center director arrived and was informed of the incident. She decided to stand at the window and observe this teacher for approximately fifteen (15) minutes. She stated that during that time period she observed the teacher using a tone of voice that was inappropriate and she punished a child whose choice she did not like by writing his name on the wall. She stated that she observed the teacher being distant and not interacting with the children. The teacher stayed in the classroom with the children until she left at 5:20pm. The staff person came back to work the following morning at 8:00am and worked until 8:30am in the same classroom. At that time she was brought into the office where she was terminated. It needs to be noted that the Assitant Director also witnessed this same teacher grab a female child over two (2) months ago by the arm and drag her over to the library area. He stated that it was not forceful and that maybe it was an isolated incident. He stated that he would keep an eye on her. He also stated that there was yet another incident involving the same teacher and same female child which happened on 01/30/15. He stated that this teacher was standing in the doorway of her classroom holding the child's arm up while the child sat in the doorway on the floor crying. He stated that she told him, "I need you to remove her from my room. She is crying and she can't come back in." He stated that he told her that he needed to finish delivering snack but would be back and when he came back around to that classroom he noticed that the teacher was tryng to shut the door with the child part way in the door frame. He stated that as he noticed her hitting the child's legs with the door, she was still holding onto the child's arm and trying to drag her by the arm out of the door frame. She was using one of her legs against the child's body to assist in moving her away from the door so she could shut the door. He stated that he stopped her and the teacher left the child crying in the hallway and went back into the classroom. He stated that he helped her up and returned her to her classroom and closed the door. He stated that he reported this to the center director. It also needs to be noted that another teacher has expressed concerns that the teacher in question is sometimes harsh with her tones to the children and gets easily frustrated when things do not go her way. There have also been incidents that the director noted where the teacher in question was heard by the director yelling at another staff member with children present and the director witnessed the teacher ignore a child climbing on a shelf.

General: Based on Review of Documentation, there was one (1) staff person with a hire date of 12/1/92 whose T.B. skin test exceeded the two (2) year requirement. In addition there was one (1) staff person with a hire date of 12/16/13 who did not have the results of a T.B. skin test read until 4/12/14. There was no previous T.B. skin test or a statement from a health professional presented for review to verify that the staff person had obtained the results of a T.B. skin test or statement from a health professional prior to employment.
General: Based on Review of Documentation, the two (2) staff responsible for driving the facility vehicles when transporting children did not have a current driver record history through the state transporation agency that issued the driver's license. Programming
General: Based on Observation, during a tour of the facility it was found that the Toddler 1 room and the School Age room did not have a planned program of activities posted.
General: Based on Observation, during a tour of the bathroom located in the Discovery Preschool room there were three (3) dime size holes in the wall over one (1) of the toilets.
General: Based on Review of Documentation, presented for review at the time of the survey there was no documentation to verify that quarterly earthquake and tornado drills had been conducted for 2013 and 2014. Therefore there was no documentation presented for review that had the date time and names of children who had participated. The staff person in charge indicated that additional documentation was in another binder in her office but she was unable to get into her office at the time to get the binder.

An interview with the staff person in charge indicated that she had them documented somewhere else and that documentation was in her office which she was unable to get into at the time.
