The staff person in charge also stated she was unaware of this regulation and that the fish have always been in the cafeteria as long as she has worked for the program.

A staff person hired 8/12/15 had a criminal records check dated 9/2/15. A staff person hired 8/11/15 had a criminal records check dated 9/2/15. Finally, there were three (3) staff whose child abuse and neglect checks were signed and submitted more that five (5) days after their hire dates. General: Based on Review of Documentation, observation and interview the following was found: 1. Two (2) staff files (8/2014 and 7/18/01) did not contain evidence or results of a child abuse/neglect check (CAN). The staff person in charge stated during interview, "I have the forms ready to mail for processing, but have not done this yet". The surveyor observed these two (2) staff working together with the younger school age children (kindergarten, first and second graders) in the computer lab from approximately 3:45PM - 4:55PM. At approximately 3:55PM the staff person with a 7/18/01 hire date brought two (2) children into the cafeteria, where the surveyor was sitting to review paperwork, to sweep up some popcorn that was spilled on the floor and then returned back to the computer lab a couple minutes later with the two (2) children. During this time frame the staff person with a 8/2014 hire date was left alone with the rest of the group. The staff person in charge asked these two (2) staff how many children they had in their group when they initially went into the computer lab at 3:45PM and they replied by stating, "approximately forty (40)". 2. One (1) staff file (hire date: 8/2014) did not contain evidence or results of a child abuse/neglect check (CAN) or a criminal records check (CRC). The staff person in charge stated during interview, "A CRC was probably processed when this staff person was originally hired (8/2014), but it wasn't sent to me when he transferred to this location in December 2014".
