General: Based on observation, interview, and review of documentation, there was a staff member observed working with authority over six (6) children in the Crawlers classroom, at the time of review. The staff member's employment status on the National Background Check Program database, Kentucky Applicant Registry and Employment Screening (KARES) report dated 12/09/24 revealed the staff member’s employment eligibility was in process, so the center did not complete the appropriate eligibility determination process for the staff member (DOH: 12/09/24). The staff in charge stated that fingerprinting had been completed and that she would log on to KARES and complete the process. Per review of KARES, this person did not submit their fingerprints until 12/10/24, after the inspection date. Therefore, she was working without a determination of eligibility.

Interview with program director revealed a CAN for both staff members was submitted to the cabinet within regulatory timeframes; however, the program director failed to present proof of the submissions at the time of survey. Continued review of staff files revealed the center failed to have a Criminal Records Check (CRC) on file for a staff member hired 4/16/15. Interview with program director revealed a CRC was completed for this staff member; however, the program director revealed she could not locate the CRC at the time of survey. Further review of staff files revealed a staff member hired 2/5/15 listed a Maryland address on her CAN indicating she lived in Maryland within the last five (5) years. Continued review of staff files revealed the center did not have a Maryland CRC on file for this staff member at the time of survey.
