Observation in the preshool room revealed a three year old child was accompanied by a Oldham County High School student walking out of the classroom down the hall to the bathroom alone with no other qualifed staff member. Interview with the director revealed the Oldham County High School student is a volunteer in the child care center, and no background checks were avaialble for review. Review of records for a staff with a hire date of 08/01/13 and ECE-TRIS records revealed no documented evidence of Pediatric Abusive Head Trauma (PAHT) training completed within the last five (5) years. Exit interview with the child care center director revealed acknowledgement of deficient practice. 345 - Driver Requirements Not Applicable 922 KAR 2:120. Section 12. Transportation. (18) A driver of a vehicle transporting a child for a center shall: (a) Be at least twenty-one (21) years old; (b) Complete: 1. The background checks as described in 922 KAR 2:110; and 2. An annual check of the: a. Kentucky driver history records in accordance with KRS 186.018; or b. Driver history records through the state transportation agency that issued the driver’s license; (c) Hold a current driver’s license which has not been suspended or revoked during the last five (5) years; and (d) Not caused an accident which resulted in the death of a person. General: Based on observation, the personal information relating to the development of the infants was not kept confidential as the individual development of each infant was posted in the infant classroom with the children's names.
General: Based on observation, a plunger was stored in the children's restroom.
General: Based on observation, a container of Clorox Disinfectant Wipes was stored on a low shelf in an unlocked cabinet in the Two-Year-Old classroom. Review of the label on the container revealed the warning: "Hazards to humans and domestic animals". Also, multiple containers of sunscreen and lotions were stored on the shelves and in the unlocked drawers located in the restroom. The containers were accessible to children and many of the containers had a warning label that stated, "Keep Out of Reach of Children".
General: Based on observation, the toddler's indoor space was not separate from the space used by older children and away from the general traffic pattern of the center as the children, staff, volunteers, and parents that entered the Three and Four-Year-Old Classroom had to walk through the Toddler classroom. Signs posted on the doors directed parents to "walk through Ms. Shirley's room".
Infants: Based on observation, the child care center failed to follow the most current recommendations of the American Academy of Pediatrics in regards to sleep placement as two infants were observed sleeping in cribs with toys in the cribs. One infant was sleeping with a bib around his neck and a linking toy extended above the sleeping infant and sagging down within reach of the infant. Another infant was observed sleeping in a crib with a loose fleece blanket stored at the infant's feet and was not used for the infant, there were also two stuffed animals in the crib with the loose blanket.

Observation of the playground revealed a wood post under the shaded area that was wrapped in a foam pool noodle, the foam had several pieces broken off and peeling away from it.
