On April 3, 2024, a complaint was called into the Office of Child Care Licensing (OCCL) regarding improper discipline. OCCL s investigation of regulatory non-compliance began after clearance from other agencies was received. An investigation was conducted by OCCL on June 17, 2024. Based on the results of this investigation this complaint is substantiated for improper discipline because video footage observed showed Staff #1 pushing Child #1 to the ground, pulling Child #1 across the floor, and hitting Child #1 in the leg with a bookshelf. Staff #1 is also observed in the footage forcefully wiping blood from Child #1 s face. Additional concerns include Staff #2 being observed on video footage with an air pod in her ear while working in the classroom.

On November 10, 2023, and November 15, 2023, two complaints were called into the Child Abuse and Neglect Report Line and accepted for investigation by the Institutional Abuse Unit (IAU). The Office of Child Care Licensing (OCCL) received the initial complaint on November 15, 2023, and accepted it for investigation regarding improper discipline. A third complaint was received through the Child Abuse and Neglect Report Line on November 23, 2023. An unannounced visit was conducted by OCCL and IAU on November 16, 2023. OCCL determined on February 20, 2024, that IAU closed their investigation as unsubstantiated so the OCCL investigation could proceed. The complaint is substantiated by OCCL for improper discipline based on video footage reviewed, staff interviews, and documentation collected. Staff #1 brought her concerns to Ms. Hartz and she reviewed video footage on the playground from November 8, 2023. Staff #1 reported the incident regarding Staff #2 hitting Child #1 on the leg to Ms. Hartz. Staff #2 is observed in the video footage walking towards Child #1 and kicking motion towards Child #1. From the camera s angle, it is not clear how hard Staff #2 kicked Child #1, and Child #1 was seen rolling away from Staff #2 when she kicked Child #1 s leg. Staff #2 was terminated from employment for not following the positive guidance policy the center has in place, which directly forbids corporal punishment and physical mishandling of children.

On March 10, 2024, The Office of Child Care Licensing (OCCL) received a complaint regarding concerns of inappropriate care of children. This incident was also self-reported to OCCL on March 8, 2024. This complaint is substantiated because a staff member was holding two infants at one time and attempted to open the classroom door. Child #1 slipped out of Staff #1 s arms and fell, hitting their head on the floor. This resulted in a bruise on the head. The Reporter and Ms. Hartz both stated Child #1 s parents took her to Nemours Children s Health emergency room for evaluation. Ms. Hartz stated Child #1 did not return to the center for care. Ms. Hartz provided LS Brady with the signed accident report, Child #1 s discharge instructions from the Emergency Room, as well as the disciplinary write-up for Staff #1. Non-Compliance: Regulation #28: A licensee shall ensure each staff member has an understanding of and respect for children and their needs. Staff #1 was carrying two infants at the same time while attempting to open the classroom door. As a result of this action, Child #1 fell to the floor and hit their head. This staff member received a disciplinary write-up. Have all staff working with infants and toddlers review this expectation of infant/toddler safety and sign an acknowledgment of understanding to OCCL by April 12, 2024.

Ensure that Infant A and Infant B both have thermometers in the crock pots used for heating up bottles. Thermometers must read 120 or less. (crock pots were on warm mode and the water was tepid but identifying temp was not possible)
Ensure personnel files are complete. Staff o#1 needs a current Health Appraisal and TB results. Send to OCCL when complete. Staff #2 needs CPR, and First Aid. Send certificates to OCCL when complete.
Ensure Child files are complete. Child #3 needs blood lead screening and results. Send to OCCL when complete. Child #7 needs an infant feeding schedule signed monthly by parents. Child #17 needs blood lead screening. Send to OCCL when complete.
Fence is sharp around the perimeter at the bottom in several areas. Please ensure that all fence material is not sharp and is free from hazards. Gate was also locked at all exits. One gate must be left unlocked while children are outside in the playground area. Playground equipment was infested with red bugs. Ensure equipment that children use is always free from infestation of bugs. Window wells should be covered near outside ramp in order to ensure children do not fall and are safe from hazards. Send pictures to OCCL when covered.
Air conditioner needs to be out of classroom area if not in use or installed in the window. Hazards are not to be accessible to children Several areas on the outside playground had tripping hazards. Please ensure that the turf is tucked tightly to ensure children in care will not trip. Send pictures to OCCL when completed. Wooden barrier had sharp objects. Nails were popped out and need to be fixed. Please send pictures to OOCL when fixed.
Wires were hanging in classroom 103. Ensure all hazards are clear of danger. Cleaners should not be accessible to children. Cleaners were observed in classroom 103. Wires were hanging in the school age space. Ensure all wires in the school-age space is free from hazards and hanging wires are not accessible to school-age children.
Paper towels need to be replaced in the bathroom in classroom 103. No paper towels were observed at the measuring visit.
Ensure bathroom vents are clean. Submit pictures to OCCL.
Obtain a child health appraisal and send to OCCL.
