OCCL received a complaint on October 7, 2021, regarding staff not modeling respectful communication and staff not having an understanding of a child s needs. An investigation was conducted on October 13, 2021. The complaint is substantiated because the video footage showed one staff member cussing in front of a group of children and one staff member handling a child inappropriately.

An investigation was conducted on October 1, 2025. There is no evidence to substantiate this complaint because the center has a qualified early childhood administrator with both infant/toddler and school-age specialized training, and he/she functions in this role. There is no evidence to substantiate the allegation that an unqualified staff person under the age of 18 is alone with children because both Administrator #1 and Staff #2 denied this allegation. Additionally, attendance records reviewed showed Staff #1 in the classrooms with another qualified staff person. There is no evidence to substantiate the allegation the administration was disrespectful because Administrator #1 denied this allegation. There is no evidence to substantiate the allegation the center is dirty, including the carpets, because LS #1 walked through the center, stepping into several classrooms to check the cleanliness, and all appeared satisfactory. Additionally, Administrator #1 stated Owner #1 has contracted with a company to come into the center at least weekly to clean and buff the tile floors in the hallway and classrooms. Administrator #1 also added he/she closes the center and ensures the classrooms are cleaned appropriately.

On August 8, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding not keeping the center clean and hazard free, not following health exclusions, positive behavior supports, not following meal pattern requirements, food service policy on allergies, not having an administrator on site 50% of the time, improper staff-to-child ratio and group size, not having soap in the bathrooms, and vaping in the center or on the playground. An investigation was conducted on August 13, 2025. There is no evidence to substantiate this complaint because all staff interviewed stated Staff #1 did not dump mop water in the center, the center always has enough food for children, even extra food if needed. Staff interviewed denied having heard the preschool staff yelling at or being nasty to children. Staff interviewed stated they have a list of children with food allergies on their bulletin boards in the classrooms, and it is also very clearly identified in Brightwheel. According to staff interviewed and attendance records observed, only preschool and older children are combined, and they remain in ratio. According to staff interviewed, they have not observed staff vaping in the center or on the playground. LS #1 also observed the picnic tables where staff were alleged to have been vaping. They are separated from the playground area, on the opposite side of the parking lot. Staff interviewed stated soap is always available. LS #1 also observed a large box filled with soap refills in the storage closet. Regarding the administrator not being on site, Owner #1 emailed LS #1 on July 30, 2025, to notify OCCL Administrator #1 would not be on site full time anymore, but will help, as needed, until a new administrator is on site. Owner #1 stated there is a staff person employed, Staff #7, who is believed to have has the qualifications for an administrator and is waiting on a Verification of Experience for DEEDS Early Learning. Owner #1 is hopeful this will occur within the 45-day requirement of replacing an administrator.

On August 6, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding improper discipline and administration of medication. An investigation was conducted on August 6, 2025. This complaint is substantiated for administration of medication because although staff interviewed and Brightwheel documentation showed the inhaler was given, it was not documented as required on Medication Administration Record (MAR) after June 25, 2025. There is no evidence to substantiate the allegation of improper discipline because two staff interviewed stated they reviewed the video footage from the older one s classroom during nap time and did not observe Staff #4 putting their hand over any child s mouth. Staff #4 also denied this allegation.

On May 7, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding improper staff-to-child ratio and the administrator not being present 50 % of the hours of operation and functioning in that role. An investigation began on May 14, 2025, and concluded on May 16, 2025. This complaint is substantiated because according to staff interviewed, Administrator #1 does not sign in or out at the center; therefore, it cannot be determined he/she is there the appropriate amount of time. There is no evidence to substantiate the allegation the three-year-old classroom was not following staff-to-child ratio, because according to video clips submitted to OCCL for the classroom on May 1, 2025, there were at least two staff present with 11 children throughout the entire day. A concern noted was staff not correctly signing into the three-year-old classroom to indicate they were present because attendance records for May 1, 2025, only have one staff member signed in.

On April 17, 2025, center staff emailed Licensing Specialist (LS) #1 to self-report a situation observed on video of a staff person being rough with a child. The center staff emailed the video footage to LS #1, reported the incident as required, and the staff person was immediately terminated from employment at the center. An investigation began on April 17, 2025, when the video was initially reviewed and concluded on April 23, 2025, with a visit to the center. This complaint is substantiated because according to the two videos reviewed, Staff #2 was observed roughly handling Child #1, including pulling him/her off a table by one arm and appearing to push him/her away.

OCCL s investigation of regulatory non-compliance began after clearance from other agencies was received. On March 19, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding accident/injury procedures and lack of supervision. An investigation was conducted on April 9, 2025. This complaint is substantiated because according to documentation reviewed, Brightwheel showed four notifications to the parent/guardian regarding a bite injury, but only two of those were documented on the accident/injury log and signed by a parent/guardian. There is no evidence to substantiate the allegation of lack of supervision because according to staff interviewed, some of the bites were self-inflicted. Staff also stated there are multiple children in the two-year-classroom who bite, and they have recently separated them into two different classrooms and have integrated strategies to prevent future biting incidents. Staff also stated they were not always aware there was a bite injury because Child #1 is non-verbal and does not always cry when injured. Staff also stated there are times when a bite occurs without a precipitating event or behavior making it difficult to intercede.

The Office of Child Care Licensing received a complaint on October 23, 2023, regarding sanitation, lack of supervision, accident/injury procedures, not giving the owner's contact information upon request, allowing the children to fight, and staff communication. An investigation was conducted on November 1, 2023. There is no evidence to substantiate this complaint because Ms. Cooper-Wright and Staff #1 both stated Staff #1 intervened immediately when two children were fighting in the classroom. Ms. Miller and Ms. Cooper-Wright stated the parent became angry when he was not allowed to drop his children off for care after 9:00 am and he proceeded to contact the police. Ms. Cooper-Wright denied speaking aggressively or rudely to parents. There were no accident or injury reports in Brightwheel or on paper for Child #1 or Child #2 and Ms. Miller, Ms. Cooper-Wright, and Staff #1 all stated no injuries occurred to either child. Ms. Miller and Ms. Cooper-Wright stated they gave the parent the owner s email address when he asked for it. During the investigation, no significant cleanliness issues were observed, and no foul odor was detected.

On February 3, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding cell phone use in the classroom, food allergy procedures, staff communication regarding child health information, improper staff-to-child ratios, sanitation, health exclusions, meals and snacks, not providing truthful information by completing training for other staff, providing equipment which is not developmentally appropriate, lack of supervision, and vaping. An investigation was conducted on February 6, 2025. There is no evidence to substantiate the allegation administrative staff use their cell phones in the classrooms, because administrative staff denied using their cell phones while covering in the classrooms but do admit to using them in hallways. There is no evidence to substantiate the allegation the center is not following food allergy procedures. Staff interviewed stated the classroom staff are made aware of a child with an allergy, it is added to the child s Brightwheel profile, and it is posted on a list in the classroom. There is no evidence to substantiate the allegation staff are not aware of children with health concerns in their classrooms. According to staff interviewed, classroom staff were made aware of a child with a medical need and how to handle it. Documents reviewed showed notes from a doctor regarding a child with seizures and the care plan for the child. There is no evidence to substantiate the allegation the center is unsanitary because while conducting walk-throughs and interviews with staff, the classrooms were acceptable in their cleanliness. There is no evidence to substantiate the allegation the center is not following their health exclusions policies and sending sick children home. According to staff interviewed, when a child becomes sick, the administrative staff contacts the parent/guardian immediately to pick up the child. Additionally, messages reviewed on Brightwheel confirm the center sends children home and notifies every enrolled family in the event of a contagious disease in the center. There is no evidence to substantiate the allegation the center runs out of snacks, because every staff interviewed stated they always have the snacks they need. There is no evidence to substantiate the allegation staff are taking other staff s trainings. Administrative staff interviewed stated they have never heard of staff doing this. One staff person stated she had heard of that happening once, but she did not observe it happening and the staff person who was alleged to have done it is no longer employed. There is no evidence to substantiate the allegation the classrooms provide toys that are not developmentally appropriate because during the walk-through and while conducting interviews in classrooms, LEGOs or toys considered to be a choking hazard were not observed. There is no evidence to substantiate the allegation regarding lack of supervision because while present in classrooms, staff were observed playing with the children, sitting on the floor with them, talking with them, and interceding while children were arguing. There is no evidence to substantiate the allegation staff are vaping in the children s bathrooms because staff interviewed stated they have never seen or heard of anyone vaping in the center. There is no evidence to substantiate the allegation regarding improper staff-to child ratio because according to attendance records reviewed, all classrooms were following proper staff-to-child ratio. However, a concern noted is the infant classroom was over maximum group size on January 29, 2025, having nine children with three staff.

On January 13, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding lack of supervision, staff smoking on the playground, health exclusions, suspension and expulsion policy, the administrator not doing administrative duties, sanitation, dirty dishes, staff using cell phones in the classroom, diaper changing, and not following lesson plans. An investigation was conducted on January 16, 2025. This complaint is substantiated for lack of supervision because most staff interviewed stated they have seen Staff #1 s child walk up and down the hallway unsupervised, even going in and out of other classrooms. There is no evidence to substantiate the allegation of a staff person smoking on the playground because all staff interviewed stated they have never seen anyone do it. There is no evidence to substantiate the allegation of not following health exclusion policies, because the child alleged to have had Respiratory Syncytial Virus (RSV) had a doctor s note stating the child could return to the center for care. There is no evidence to substantiate the center did not follow their suspension and expulsion policy because staff interviewed stated Child #1 s enrollment was not terminated due to diagnosed or undiagnosed autism, but rather because of escalated behaviors which threatened Child #1 s own health and safety and aligned with their parent handbook. Staff interviewed also stated the termination of Child #1 s enrollment was recommended by a social service worker who was working with the family. Staff #12 stated Child #1 s parent spoke with Owner #1 and agreed with the termination and has kept Child #1 s siblings enrolled. There is no evidence to substantiate the allegation of the administrator not doing administrative duties because all staff interviewed stated either the administrator or the front office staff are available when needed. There is no evidence to substantiate the allegation the center is unclean because during the walk through and whi le conducting interviews, LS #1 observed the center to be in satisfactory condition. There is no evidence to substantiate the allegation of toys being dirty because all staff interviewed stated they place dirty or mouthed toys in the yuck bucket or sink to be cleaned and sanitized. Additionally, LS #1 observed the yuck buckets in the classrooms. There is insufficient evidence to substantiate the allegation of staff using their cell phones in the classrooms because while some staff stated they have observed front office staff on their cell phones, most said they have not observed this, and some stated they were entering child information into Brightwheel. There is not enough evidence to substantiate the allegation the center does not supply materials for classrooms to complete the activities from their lesson plans daily, because while some staff stated materials were not available every day, others stated they do receive the appropriate materials, and activities are changed if needed. Also, children were observed doing activities, and various child created art projects were displayed in the classrooms. There is no evidence to substantiate the allegation the center did not change diapers as needed because according to the infant daily logs for January 2, 2025, diaper changes were recorded throughout the day in both infant classrooms. A concern noted is while reviewing the daily logs on Brightwheel, a picture of an infant in a walker was observed. This was immediately addressed with Staff #11, Staff #12, and Administrator #1, and the walker was removed from the classroom by Staff #12.

On December 12, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding improper discipline. An investigation was conducted on December 12, 2024. This complaint is substantiated because video footage shows Staff #2 lifting a child by one arm and pulling her to her nap mat. Additional concerns noted include Staff #2 completing diaper changes on four different children and did not utilize a disposable cover, did not clean and sanitize the diaper-changing mat, and did not complete handwashing for herself or the children. On two separate occasions, during the diaper change, Staff #2 walked away while the children were left on the changing table.

On September 13, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding accident/injury reports and lack of supervision. An investigation was conducted on September 19, 2024. This complaint is substantiated because one of the two injuries alleged to have occurred at the center was not documented on the accident/injury log, and a notice was not sent to the parent/guardian. There is no evidence to substantiate the allegation of lack of supervision because video footage shows staff intervening within four seconds of Child #1 and another child fighting. The resulting scratches on Child #1 s face were documented on the accident/injury log; however, Child #1 was disenrolled by the parent/guardian before the center was able to obtain their signature. A concern noted was OCCL was not notified within five business days of the termination of one of the administrators, which occurred on September 3, 2024.

On August 27, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding improper staff-to-child ratio, lack of supervision, and accident/injury report procedures. An investigation was conducted on August 29, 2024. There is no evidence to substantiate this complaint because attendance records reviewed for August 26, 2024 August 29, 2024, showed the one-year-old classroom being in compliance with staff-to-child ratio. Additionally, documentation shows four accident/injury reports from June 2024 August 2024, were signed by the parent. Two of the four reports were for a biting injury. Staff interviewed stated one staff person in the classroom on August 26, 2024, at the time of the most recent bite was changing a diaper and the other staff person was with the children. The staff person who worked in the classroom prior to August is no longer employed.

On July 23, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding cell phone usage and not teaching by example by not being respectful. An investigation was conducted on July 31, 2024. There is no evidence to substantiate the complaint because although Staff #1 admitted to using a cell phone to record videos while children were in care, OCCL is unable to determine when the videos were recorded to determine if there was sufficient staff in the classroom. Additionally, while children can be heard in the background of one video viewed, OCCL cannot confirm that the inappropriate music could be heard by the children.

The Office of Child Care Licensing (OCCL) received a complaint on July 10, 2023, regarding concerns of a custody agreement not being followed. An investigation was conducted on July 27, 2023. There is no evidence to substantiate this complaint because Parent #2 picked Child #1 up from care on Friday, July 7, 2023. According to the custody agreement on file for Child #1, the parent whose week is ending shall drop off the child at daycare on Monday morning, and the parent whose week is beginning shall pick the child up. Therefore, Parent #1 should have been the parent to pick Child #1 up. However, the custody agreement allows for modifications when both parties come to a mutual agreement. The parents of Child #1 made a mutual agreement in writing to modify the agreement for July 7, 2023.

The Office of Child Care Licensing (OCCL) received a complaint on April 4, 2023, regarding improper staff-to-child ratios, diapering procedures, and not notifying when children are exposed to a contagious disease. An investigation was conducted on April 28, 2023. There is no evidence to substantiate for improper staff-to-child ratios because Owner Harrison submitted documentation to Associate Secretary Gleason to show Staff #5 was signed into the building and her name was documenting on Brightwheel information about the Older One s classroom. There is no evidence to substantiate for diapering procedures and parents/guardians not being notified of a contagious disease because staff denied the allegations. A concern noted was staff attendance was not properly documented on five attendance records.

The Office of Child Care Licensing (OCCL) received a complaint on March 9, 2023, regarding not having enough staff to operate, unqualified staff alone with children, and staff-to-child ratios. An investigation was conducted on March 20, 2023. This complaint is substantiated because the attendance record for January 23, 2023, showed an intern alone with four infants from 1:09 pm to 2:30 pm and a second attendance record for January 25, 2023, showed an intern and an aide alone with up to seven infants from 1:30 pm to 2:04 pm. A concern noted was staff attendance was not properly documented during the visit. One staff member was not present in the one-year-old classroom and still signed in and another staff member was present in the classroom, but not signed in.

OCCL received a complaint on October 7, 2022, regarding staff communication, improper discipline, staff engaging in personal activities such as using a cell phone, lack of supervision, and improper diaper changing. There is no evidence to substantiate the allegations because all staff interviewed denied them and LS Kenton observed staff appropriately interacting with children, no cell phone use, and diapers being changed properly.

OCCL received a complaint on April 14, 2022, regarding improper staff-to-child ratios. An investigation was conducted on April 19, 2022. There is no evidence to substantiate the complaint because classrooms were observed following proper staff-to-child ratios and the reviewed attendance records from April 11th and 18th showed ratios were being maintained. Concerns noted were staff and children s attendance were not being documented correctly. Children were signed into multiple classrooms without being signed out. Staff signed into multiple classrooms and not signed out.

OCCL received a complaint on March 29, 2022, regarding improper discipline and improper staff-to-child ratios. An investigation was conducted on March 30, 2022. The complaint is substantiated because video footage showed a staff member improperly discipline a child by grabbing his arm, pushing his head back and then pulling him by his arm away from the sand table. There is no evidence to substantiate the allegation of improper staff-to-child ratios because the reviewed video footage showed the Pre-K classroom was following proper staff-to-child ratios. An additional concern noted was staff attendance was not being properly documented. According to attendance records from March 25, 2022, and March 28, 2022, staff were not signed into the Pre-K classroom.
