When staff are supervising children, they shall always ensure their care, protection, and guidance. On 9/12/2025, Staff #1 used their hand to forcefully push Child #1, age 4, to the ground. Witnesses stated that the child was visibly upset during the interaction and said that the push hurt.

There were no physical examinations in the records of child #1, who had been enrolled for three months, child #2 who had been enrolled for over one month, child #7 who had been enrolled for over one month, and child #8 who had been enrolled for three months.
The record of child #2 contained enrollment paperwork that indicated a dietary restriction. The center updated the required list approximately one month after the child's first date of attendance.
Areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition. On 6/11/2025, poison ivy plants were identified along the edge of the fence within a preschool playground.

In interview, staff stated that they were made aware on 6/6/2024 that the child received medical care. 2. The department did not receive notification from the center within the two business days. 3. Administration acknowledged that the required notification to the department's representative was not made.

Evidence: 1. The record of staff #1 (date of employment: 5/17/2023) contained a central registry finding dated 8/4/2023. 2. Administration acknowledged that the finding was not received within the required time frame.
Evidence: The center's discipline policies and procedures were not followed on Wednesday, June 21, 2023, when the following occurred: a. Staff #2 wrapped a weighted blanked around child #1 (age 5 years) holding the blanket together on the child?s right shoulder with the child?s arms down. Child #1 drops to the floor. Staff #2 kneeled over child #1 and continued to hold the weighted blanket restricting child?s #1?s upper body movement. Child #1 screamed. Child #1 reported, ?[Staff #2] held me down and didn?t let me up.? b. Staff #2 tied a face mask around the face and head of child #1 to prevent the child from spitting. It was reported that the mask looked ?entirely too tight?. Child #1 reported the mask was ?really tight?. c. Staff #2 put the hood of a weighted jacket on child #1?s head to prevent the child from spitting. d. The center?s policies and procedures for guidance, protection of and respect for children states that, ?Employees must adhere to all applicable state and local laws governing child guidance or discipline. Employees are required to use positive guidance techniques and to refrain from any unacceptable measures while caring for children on behalf of the Company. Unacceptable measures include: Employees may not use physical actions to punish or humiliate children in any way or to demonstrate to a child what it ?feels like" to be the victim of aggression. Employee may not threaten or imply that physical punishment may occur as the result of a child's behavior. Employee may never physically restrain a child as punishment.? These policies and procedures were not followed by staff #2 on Wednesday, June 21, 2023.

The record of staff #2 ( employment date: 4/24/2023) had documentation of fingerprint based national criminal history search results dated 4/26/2023. 3. The record of staff #3 (employment date: 4/10/2023) did not have documentation of fingerprint based national criminal history search results.
Evidence: The record of Child #1 had documentation of immunizations required by the State Board of Health dated 12/14/22.

Evidence: 1) The Infant B's Child Supervision Record and the Teacher/Staff Attendance record for the Infant B classroom reviewed for 10/17/2022 showed Staff #1 was the only staff member present with nine children between 7:46am and 9:05am when a second staff member arrived. Two additional children were dropped off between 9:07am and 9:08am. A third staff member arrived at 9:29am. 2) Staff interviewed confirmed that on 10/17/2022, the Infant B classroom was out of ratio in the morning due to staff calling out sick. Staff reported the youngest child in the Infant B classroom was under 16 months old. The applicable staff-to-child ratio for children birth up to 16 months of age is one staff member for every four children.
