The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. The OCDEL Announcement C-25-01, effective 2/1/25, states that an individual may be employed on a provisional basis in a certified child care facility when the following conditions are met, and documentation is maintained on file: Have results of the following, no older than 60 months: 1. PA Child Abuse History Clearance; 2. NSOR verification; 3. Out-of-state clearances (if applicable); 4. Signed Disclosure Statement for Child Care Employment; and 5. Either FBI Criminal History Clearance; or PSP Criminal History Clearance In addition to those obtained, the following clearances must be applied for prior to starting provisional employment: 1. FBI Criminal History Clearance; or 2. PSP Criminal History Clearance
At the time of the inspection, the NSOR on file for staff person #3 was not received until 2/11/26 and not at or before the time of initial service in the facility. Staff person #3 has had direct contact and routine interaction with children (see LIS code sheet for date of hire).
