In order to assure that staff and children are familiar with all of the EOP drills, programs shall: (1) Practice evacuation off-site and bomb threats once per year with all child care staff; (2) Practice at least 2 other components of their EOP with all child care staff and children each calendar year; and (3) Review all EOP response actions with all staff at least 4 times each calendar year.

The Center Director and other staff confirmed that Emergency Operations Plan drills are conducted with staff only and not the children. The licensing coordinator's review of Emergency Operations Plan drills revealed that the program did not review the program's Emergency Operations Plan four times in the 2024, and the Center Director confirmed this information. Corrective action: There was a misunderstanding of the rule. The plan had been reviewed annually with teachers during in-service days along with practicing off-site evacuation and other drills. We will now add a brief review to our EOP to each of our in-service days agendas which would result in 3 of the 4 quarters of the year. The 4th quarter the teachers will review independently and sign off that it has been reviewed. These will be added to the director's calendar with other important program dates. The program will also begin using a new eop log that lists required drills per year in one place to ensure all drills are being practices as required. This includes fire drills and two other components with children as required.

Child care staff shall ensure that for each child, upon the child’s first day in attendance in the program, there is a “Child Care Registration and Emergency Information” (April 2022) form or an equivalent form provided by the child care program completed and signed by the parent, on file, which contains: 1) Full legal name of the child; (2) Child’s date of birth; (3) Child’s physical address and mailing address; (4) Child’s home telephone number; (5) Date of enrollment in the program; (6) The name, physical address, and mailing address of the parent(s) responsible for the child, if different from the child’s address; (7) Telephone numbers for the child’s parents and instructions as to how the parents can be contacted during the hours that the child is at the program; (8) Email addresses for the parents, if available; (9) Names and telephone numbers of at least one person who will assume responsibility for the child, if for any reason, the parents cannot be reached immediately in an emergency; (10) Any chronic conditions, allergies, or medications in case of sudden illness or injury; (11) Written parental permission for first aid treatment; (12) Written parental permission for emergency medical transportation and treatment; (13) The name and telephone number of each child’s physician or health care provider; and (14) Names and telephone numbers of any person(s) other than parents who are authorized to remove the child from the program.

Programs shall comply with approved corrective action plans and corrective action plans issued in accordance with (i) and (j) above.

This Statement of Findings includes a repeat citation and failure to comply with the approved Directed Corrective Action Plan for He-C 4002.41(g) as noted herein. The program failed to comply with one approved directed corrective action plan (DCAP) for the December 23, 2022 citation of He-C 4002.41(g) regarding the completion of background record checks for staff. Corrective action: In the future, the program will follow all systems in place from previous CAPS. Previously cited items have been added to a monthly classroom check list, or to an administration checklist, to be conducted each month by administration. The checklist will be a working document to add items as needed or as rules change. Outdated and inaccurate references were and continue to be listed on the unit’s website as reference tools for providers to follow that which not aligned with the current rules. This makes it difficult for programs to go back and reference material if they have questions on rules. Example of Administration checklist provided.

He-C 4002.06(m) · Correction status not published

All center directors, agency administrators, site coordinators, or site directors, and all other child care staff who are responsible for the supervision of children, or who are necessary for the staff to child ratios, shall keep on file documentation of completion of a minimum of 6 hours of professional development, which shall be completed in accordance with the following: (1)  Within 90 days of the first date of employment; (2) Within 2 weeks for programs operating 3 months of the year or less; or (3) By providing documentation of previous completion.

The licensing coordinator's review of seven staff files revealed that one staff completed only eight of the required 18 annual hours of professional development. Corrective action: There was a clear misinterpretation of the rule that was also noticeable to the licensor. The program was following the previous rule of tracking professional development from anniversary dates annually instead of Jan-Jan of each year. The rule states ”shall complete 18 hours of professional development within their first 12 months of hire, and annually thereafter, in accordance with…” The program interpreted “annual thereafter” as annually thereafter their first 12 months (anniversary). Not annually meaning Jan-Jan. Because of this one staff member was short hours. The program will switch back to tracking Jan-Jan in the future.
