I interviewed Ms. Mader, program director. Ms. Mader stated the center provides meals for the children at the center unless the parents want their child to have specific food items. On 01/18/2022, I made an unannounced onsite investigation at the center. I observed in the infant room that Child A's baby food jar had not been labeled with her name. I interviewed Ms. Fischer. Ms. Fischer stated the Child A's food was just brought in that morning and she would label the food as required. Children bottles were labeled in the refrigerator with children's name and date. I observed in the toddler room the children's containers were labeled as required. There was no outside food items provided by parents in the room on the day of inspection. On 06/07/2022, I sent an email with the findings to Ms. Carly Comparoni, licensee designee. I informed her once the special investigation was approved she would receive a copy.

R 400.8176 Sleeping equipment. (16) All sleeping equipment and bedding must be washed, rinsed, and sanitized when soiled, between uses by different children, and at least once a week regardless of use by different children.

On 01/18/2022, I interviewed program director Ms. Ashley Mader, training specialist Paige Prudhomme, child care staff member Abby McGee, child care staff member Jen Fischer, child care staff member Lexi Hill, and child care staff member Morgan Tessmer. Ms. Mader stated she was unaware of any of the staff in the children classrooms not cleaning and sanitizing the children cots. Cots used in the room are stackable cots. I interviewed Ms. Prudhomme in the Pre-k classroom. She stated the children cots are sanitized after each use and the bedding is kept in the closet. I observed that the children's cots were stacked appropriately in the room however the children's 4 bedding was in close contact stacked on top of each other. I informed Ms. Prudhomme children's bedding could not be touching or in close contact with one another. She would have the bedding placed in plastic bags to avoid them touching. I interviewed Ms. McGee. Ms. McGee stated she currently works in the Pre-k classroom. She been working in the center since September 2021. The children's cots are washed, cleaned, and sanitize and the children take their bedding home if soiled or at the end of the week to be cleaned. I interviewed Ms. Fischer in the infant room. Ms. Fischer stated bedding (crib sheets) are typically supplied by the center however some parents will provide their own sheets. Crib sheets are sent home by the end of the week if bought by parents to be washed and cleaned. Sheets provided by the center is cleaned if soiled right away. I did not observe any of the bedding in contact with each other in the infant room. Ms. Lexi Hill currently works in the preschool room. I interviewed Ms. Hill. Ms. Hill stated every day after nap time, the cots are cleaned and sanitized. Children bedding is sent home at the end of the week unless soiled prior to that time. I observe in the preschool room that the children's bedding was stacked on top of each other touching. I interviewed Ms. Tessmer. Ms. Tessmer stated all of the children's bedding is individually bagged in plastic bags. Children's bedding do not touch each other. I observed the bedding was protected by plastic bags.

R 400.8137 Diapering; toileting. (1) Except as provided in subrule (2) of this rule, diapering must occur in a designated diapering area that complies with all of the following: (f) Is washed, rinsed, and sanitized after each use.

On 01/18/2022, I interviewed Ms. Ashley Mader, program director Jen Fischer, and Morgan Tessmer, child care staff members Ms. Mader stated she was unaware of any child care staff members not following the guidelines when they finish a diapering of a child. She did not have any concerns about the diaper pads not washed, rinsed, and sanitized. The infant and toddler rooms are the only rooms in the center that use diapering pads is the infant room and toddler room. I interviewed Ms. Fischer. Ms. Fischer stated in the infant room the diaper pad is always cleaned after use. The diaper pad is always washed, rinsed, and sanitized after usage. She was not aware of any of the child care staff members in the room not following the rule. I walked into the toddler room at approximately 11:52 a.m. and observed Ms. Ryann Ramirez complete a diapering; she then washed, rinsed, and sanitized the diapering pad after using. I interviewed Ms. Hill. Ms. Hill stated there has never been an issue with the child care staff members following guidelines for diapering in the toddler room. On 01/11/2022, I attempted to contact the Complainant by email, as there was no other means for contact. Complainant emailed me back on 01/16/2022, stating they would contact me; however, no contact was ever made.

1 R 400.8170 Outdoor play area. (10) An outdoor play area and any equipment located on the center's premises must be maintained in a safe condition and inspected daily before use to ensure that no hazards are present.

I interviewed Ms. Ashley Mader, program director. Ms. Mader stated she was aware the fencing in that area was not in good condition. The center would be moving soon to a new location. I informed Ms. Mader the center still needed to maintain the premises until they moved. I observed the fencing to be in disrepair with broken/missing wooden slates for the play area located on the east side of the building.

On 10/07/2021, I received a telephone call from Ms. Jacquelyn Voss, owner. Ms. Voss stated there been an incident at the center on 10/06/2021 that needs to be addressed. Currently Ms. Christina Cook, program director is off work while they are 3 investigating what happened. There is an audio tape of a child screening but the video is dark and not very clear. Only Ms. Cook and Ms. Taylor DeLage were in the room together. Ms. DeLage is no longer working at the center as she had previously put her notice in resigning. Reportedly Ms. Cook is holding Child A down while trying to get him to sleep. She would send over an incident report and I also questioned whether a complaint had been made to the Department of Health and Human Services and if not, one needed to make a complaint as soon as possible. She would make both the complaint and send over all of the information she had to me at this time. On 10/07/2021, I received a copy of the incident report from Ms. Voss. The incident report stated the following: "Chrissy was sitting next to Child A during nap, he was crying and kicking her. In her words she did a gentle lean over him to stop it. The other teacher says it wasn't necessary and took a video but it's just sound and child crying." On 10/07/2021, I interviewed Child A's Mother by telephone. Child A's Mother stated on 10/06/2021, Child A's Father picked Child A up from the center and Ms. DeLage, requested for Child A's Father to step outside to talk. She told him over the last few months Ms. Cook was holding Child A down at nap time. She had audio and would send the audio to them. She received the audio/video clips and contacted Ms. DeLage herself to speak with her. She was unaware that Child A was having problems at the center. She was only made aware approximately two weeks ago that Child A had one incident of a "rough nap time" she was asked to pick him up. There was no other indication that Child A was having any problems especially at nap time. When she spoke with Ms. DeLage, she was informed by her that she had concerns previously about how Ms. Cook was interacting and handling Child A during nap time she told Meggen Green, assistant program director of her concerns. Ms. DeLage last day of working at Little Learners Childcare would be 10/08/2021. Approximately a month ago Child A told her he did not want to go to "school" where he previously loved going to the center. Child A's Mother called to a sister center to speak with Ms. Carly Comparoni, regional manager. She informed her of her concerns about Ms. Cook. She was told that they would look into this matter and she would be contacted once it was investigated. On 10/07/2021, I received a copy of the video from Child A's Mother. I received four videos. Video 1: There is no clear picture of Child A or Ms. Cook, video is very dark. It is audio. Child A is crying that his hands are stuck and Ms. Cook is heard saying pipe down. 4 Video 2: There is no clear picture of Child A or Ms. Cook, video is very dark. It is audio. Child A is screaming but words are unclear a voice is telling Child A is to pipe down. Video 3: There is no clear picture of Child A or Ms. Cook, video is very dark. It is audio. Child A is crying asking for "mommy" saying "no" and my hands. There are no words heard from any adult. Video 4: There is no clear picture of Child A or Ms. Cook, video is very dark. It is audio. Child A is crying and Ms. Cook is telling Child A to pipe down and eyes close. In this video there are two very quick scenes of light but unable to discern context. On 10/14/2021, I interviewed Ms. Jaclyn Voss, Ms. Sandra Marshall, Ms. Meggen Green, and Ms. Anne Wall at the center. Ms. Voss and Ms. Marshall stated they were unaware there were almost daily issues with Child A, especially during naptime. If a child is having difficulties to that extent, it is expected that child care staff members along with the program director document their concerns and observations. Documentation of Child

On 10/14/2021, I completed an unannounced onsite investigation at the center. I interviewed Ms. Voss and Ms. Marshall. Ms. Marshall stated she and Ms. Voss was made aware by Ms. Cook and other child care staff members that Child A was taken out of the preschool classroom and brought to the office when he was having behavior problems. Child A would remain in the office until he calmed down. Unknown the amount of time he would spend in the office. I informed Ms. Marshall and Ms. Voss that the office was not approved child care space and that unless the space/room is approved could not be used. Ms. Marshall did not know why Child A was not given the option for quiet activities during nap times to avoid loud outbursts. I discussed with Ms. Marshall and Ms. Voss that children were not required to sleep during nap time and quiet activities or options should be provided to children who don't sleep. Child A returned to the center on 10/11/2021. His parents brought a "quiet box" which have different activities he can use while lying on his cot during nap time. On 10/14/2021, I interviewed Ms. Cook by telephone. Ms. Cook stated Child A often did not like to sleep during naptime. She often went into the preschool classroom to assist as some of the children in the room do not settle down quickly. Child A wanted to get up from the cot. When Child A is up, he will run around the room, jump on cots, and kick cots to wake others in the room. I questioned why on 10/06/2021, Child A was not given quiet activities, to do during nap time as he is not required to sleep. She was attempting to keep Child A's behavior from escalating as they become more pronounced when he does not sleep. On 12/06/2021, I completed the Exit Conference by telephone with Ms. Jacquelyn Voss, owner. I informed her of the violations being cited in the investigation and that she would receive a copy of the report, once approved. On 12/28/2021, email sent to Ms. Marshall requesting contact. On 12/29/2021, I spoke with Ms. Marshall by telephone. I informed Ms. Marshall that Ms. Voss was not in the system as the licensee designee. She would need to be identified as the licensee designee and connected in the Child Care Background Check system under this center's license. Ms. Marshall knew that Ms. Voss was connected to one of the other centers they owned. I relayed that I would need to complete the exit conference with Ms. Comparoni instead as the identified licensee designee. On 12/29/2021, I received a telephone call from Ms. Comparoni, licensee designee. I informed Ms. Comparoni of the violations being cited in the investigation.
