OCCL s investigation of regulatory non-compliance began after clearance from other agencies was received. On May 22, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding concerns of failing to intervene quickly to ensure safety of children, allowing children to hit each other, and using a cell phone while caring for children. An investigation was conducted on June 23, 2025. Based on interviews and review of documents, this complaint is substantiated for failing to intervene quickly to ensure safety of children and allowing children to hit each other. Documents stated a review of video footage showed Staff #2 disregarded the children that were fighting, and no attempts were made to prevent the altercation. Documents stated Staff #1 instructed Child #1 to get the other child. Based on interviews and a review of documents, this complaint is substantiated for staff using a cell phone while caring for children. Documents stated Staff #1 was on their cell phone while the children were fighting in front of them.

OCCL received a complaint on June 9, 2022, regarding an employee using her phone, when she was supposed to be caring for children resulting in a lack of supervision. This complaint is substantiated for lack of supervision because according to staff members who were interviewed and the information provided by staff members at the park location, teachers have had difficulties keeping the children away from the front gate entrance that is near the street, and have had to stop children who ran away from the field area towards the dock.

On May 17, 2022, a report was made to OCCL in regards to staff yelling at children in care, and expired food being served to children at the center. An investigation began May 20, 2022, and concluded May 25, 2022. All staff interviewed stated they never observed staff at the center yelling at children. This complaint is substantiated for the center serving expired food because expired food was found on the kitchen shelves, in the kitchen cabinet, and in the refrigerator. Additional concerns noted were the kitchen had black mold under the sink and on the floors. The base cabinet under the sink appeared very damp and was filled with clutter. There were multiple damp marks on ceiling tiles and areas of the kitchen floor tiles were broken. The kitchen floors, walls, and storage areas were dirty.
