Safe Use Zones For all play equipment that is thirty (30) inches or higher from the ground, including climbing equipment, slides, swings and other similar equipment, the licensee shall ensure that the surface under and around the equipment, including recommended use zones, is of approved resilient material that protects children if they fall. * Materials in the use zone shall consist of wood chips, pea stone, mulch, engineered wood fibers, sand, safety-tested shredded or rubber like material or rubber mats designed for protective cushioning; * Materials used in the use zone shall follow the recommendations listed in the most recent publication of U.S. Consumer Product Safety Commission's Public Playground Safety Handbook regarding critical depth of tested materials determined by the height of the highest climbing surface of the equipment; * Materials used in the use zone shall be installed and maintained according to the manufacturer's instructions; * If the loose material such as sand, mulch, or shredded rubber is used in use zones, the licensee shall ensure that the material is raked regularly and replenished to maintain depth and resilience; and * If the resilient material in use zones freezes, staff shall ensure that children will not play on the equipment until the resilient material has thawed and is once again resilient.

During the visit, it was observed that several children were allowed to climb and play on the large playground structure which allows children to reach a height of 30 inches or higher. The outside temperature during the visit was approximately 26 degrees F. The cushioning material under and around the structure was unable to be moved or measured due to being frozen and covered with snow. Therefore the cushioning material was no longer resilient.

General Health Examinations: Within forty-five (45) days of enrollment, the licensee shall obtain documentation of the child's age appropriate well care exam from the parent. Documentation shall include information regarding any health conditions and medications that may impact the care of the child.

Staffing Schedule: A licensee shall maintain a written record of the daily schedule for at least 365 days of all staff including exact days and hours worked and the group of children to whom they are assigned.

Staff A was not able to identify a staffing schedule or staffing attendance system which would meet the intent of this rule. Staff A stated that currently the preschool staff are aware of which rooms they are assigned to and when, but could not recall a time when there had been a system for documenting the details of staffing as required by this rule.

A total of seven (7) child files were reviewed. Files for Child A, B, C and D did not contain signed General Health Exam documents. Child A, B, C and D had been enrolled for more then 45 days.

The licensee shall ensure that evacuation drills are conducted at least once a month, and children and staff are evacuated in under three (3) minutes.

When asked to see the record of monthly evacuation drills, a document was shown which reflected one evacuation drill having been practiced this school year on 9/16/2019. For the months of Oct and Nov 2019, it reflected practicing Lock Down and Clear the Halls respectively which are not evacuation drills.
