During a complaint investigation on 5/9/25 based on staff interviews it was determined that that the provider did not submit a report of the incident within 48 hours to the CPS unit which has responsibility for investigating the report.

A facility person may not use any form of physical punishment, including spanking a child.

Video footage provided by the operator, dated 4/25/25, contained the following: Staff person #1 was observed forcefully grabbing Child #1 by their upper arm, pulling the child up onto their feet out of their seat and escorted them to the carpet of "Home Living" space, separating them from the other children. Approximately ten minutes later, Child #2 walked over to Child #1 and the children began interacting. When Staff person #1 noticed, they were then observed to walk over to the children, bend over top of Child #2, grab their right bicep, and yank them away from Child #1. When Staff #1 moved Child #2 away from Child #1, Child #2's knees dragged on the carpet prior to getting onto their feet. Staff person #1 then walks Child #2 across the room while holding their right bicep up and arm above their head. Staff person #1 was then observed forcefully sitting Child #2 down by the arm onto the floor.

The operator shall review the emergency plan at least annually and update the plan as needed. The operator shall document in writing each review and update of the emergency plan and kept on file at the facility.

The last documented review of the facility's emergency plan was dated 10/5/23.

In the Ohio Room two clear plastic toy bins containing toy trucks were observed to each have two cracked corners causing a potential pinch point and not be in good repair. In the California Room a clear plastic toy bin and an orange plastic toy bin were each observed to have cracks on the side and edges causing a potential pinch point and not be in good repair.
