A lead teacher in a center-based program shall have a high school diploma or equivalent, including but not limited to General Equivalency Diploma (GED), a High School Equivalency Test (HiSet), or a Test Assessing Secondary Completion (TASC), be at least 18 years old, and have one of the following: (1) A minimum of 18 credits in related coursework, including at least 3 credits in child or human growth and development, plus a minimum of 1000 hours experience working with children in a licensed child care program or public or private elementary school; (2) A minimum of 12 credits in related coursework, plus 3000 hours experience working with children in licensed child care program or public or private elementary school; (3) Documentation of a non-expired child development associates (CDA) in center-based programs awarded by the council for professional recognition; (4) A credential from a teacher preparation program accredited by MACTE; (5) Five years as a licensed family child care provider with no enforcement actions imposed by the department; (6) Successful completion of the New Hampshire Early Childhood Apprenticeship Program; (7) A minimum of 1000 hours of supervised child care experience in a licensed child care program, documentation of successful completion of a 2-year vocational course in career and technical education with an additional 9 credits in related coursework; or (8) Documentation from or on file with the department that she or he was qualified for and employed in the position of lead teacher on or before November 6, 2017.
A complaint was received regarding the staffing of two classrooms, which reportedly did not have a lead teacher. The licensing coordinator reviewed attendance records and found that on May 5, 2025, Staff A, designated as an assistant teacher, was the only staff member signed into the Governor's 2 classroom, and on May 6, 2025, Staff A was again the only staff member signed in to the Governor's 2 classroom. Between April 28, 2025 and May 7, 2025, Staff C, also qualified as an assistant teacher, was the only staff member signed in to the Leroy classroom on three occasions for between 30 minutes to 1.5 hours, and Staff C and Staff D, both qualified as assistant teachers, were the only staff members signed in to the Leroy classroom on two occasions for between 30 minutes to 1.5 hours. Corrective action: The assistant teacher in the Governor classroom worked in the classroom with the Director. At that time, the Director was consistently present but was not clocking in or out of the classroom. Additionally, all children went outside to play from 3:15 p.m. until the end of the day. During this period, The Academy was not transferring children to the playground through the app. The corrective action plan is as follows: when the Director is in a classroom, she will ensure that she clocks into that classroom. Furthermore, when children are combined for afternoon outdoor time or moved to another room, all children and staff will be transferred using the app to accurately reflect their location. To support this process, the Director has purchased and mounted tablets in every classroom, ensuring that all children and staff can quickly and easily sign in and transfer between locations. Regarding the Leroy classroom, there was improper documentation due to staff not correctly signing in on the paper forms used when transferring classrooms. Although I am unable to provide proof that we were never out of ratio, I want to emphasize that The Academy takes the child-to-teacher ratio very seriously and never allows classrooms to operate out of ratio. This issue has since been corrected through the installation of iPads in each classroom, allowing staff to clock in and out and accurately transfer children to new rooms using the app. As a licensed early childhood program, we are required by NH Child Care Licensing regulations to: Maintain the correct child-to-qualified-staff ratio at all times Ensure that unqualified staff (such as new hires, trainees, volunteers and Assistants) are never left alone with children To fulfill this requirement: Every employee is issued a staff badge, which must be worn daily and visibly displayed. Each badge clearly states the employee's name and job title (e.g., Lead Teacher, Assistant Teacher, Aide, Floater). The Director will assure that all staff qualify for their positions and that only qualified staff will work alone with children.
