The center did not obtain a court order detailing the release of Child A to a particular parent. Ms. Cheesebro was reminded that verbal communication regarding custody is not sufficient. Written court orders must be obtained in order to prohibit the release of Child A to Child A's father.
On 05/05/2021 I spoke with Child A's Father. He stated that Child A had two allergic reactions at the center that required medical attention. Both incidents occurred between two and three years ago. He asked Ms. Cheesbro for written documentation of both allergic reaction incidents but has not received any assistance from her. He has contacted the center at least four times by email from 02/2021 to 05/2021 to inquire about the incidents but has not received any response. On 10/14/2020, Child A's Father attempted to enter Learning Rainbow Preschool to see if an Epi-pen was available for Child A in the center. He stated he was denied entry by Ms. Cheesbro. A short time later police arrived, and he was told by police that he could not be on the preschool's property. He is concerned that Child A is not safe at the center. He indicated that a court order indicates that he has sole legal custody of Child A. On 5/05/2021 I received a peace police incident report from Child A's Father. The document was from Commerce Police Department and dated 10/14/2020. The report stated that an officer spoke with staff of the child care facility, and it was determined that Child A's Father is not allowed on the preschool's property. On 5/05/2021 I received a peanut allergy action plan and email that detailed communication attempts with the center from Child A's father. The allergy plan provided the following steps. If Child A is showing signs of an allergic reaction, the following steps should be taken: 1. Lay Child A on a flat surface. 2. Administer EpiPen (it will give you prompts). The EpiPen is located in the JPK classroom, in a mailbox above the cubbies labeled "Child A's Meds". 3. Call 911 4. Call family and inform them that he had an allergic reaction, that the EpiPen was administered, and that 911 has been called. 5. Administer Benadryl. On 05/07/2021 I completed an unannounced onsite inspection at Learning Rainbow Preschool. I interviewed Ms. Cheesbro. She stated that Child A had an allergic reaction to peanuts at the center roughly three and half years ago. A second allergic reaction event happened about 9 months after the first event. Ms. Cheesbro said she does not have written documentation of the incident and did not report either incident to the department. She was not able to recall dates and times that the incidents occurred. I reminded Ms. Cheesbro that she is required to report to the department any incident that occurred at the center that required a child to seek medical attention. Ms. Cheesbro was able to recall a timeline of events. Ms. Cheesbro said that when the first incident occurred Child A did not have an Epi-pen because no one was aware he needed one. This was the first time he had an allergic reaction to peanuts. Ms. Cheesbro said that Child A's mouth swelled after he ate a treat that contained peanuts. Ms. Cheesbro called Child A's mother immediately and notified her of Child A's appearance. Child A's mother arrived at the center within minutes and took Child A to the hospital for treatment. Child A's mother notified Ms. Cheesbro that Child A had an allergic reaction to peanuts. A meeting was held a few weeks after the first incident to discuss steps moving forward. Child A's Father, Child A's mother, Ms. Cheesbro and Ms. Van Proyen attended the meeting. During this meeting, Ms. Cheesbro and Ms. Van Proyen adopted a no-outside treat policy. Children are no longer allowed to bring food into the center for birthdays and/or other special events. The second incident occurred nine months after the first incident. Again, Child A's mouth swelled. Ms. VanProyen called Child A's mother who immediately arrived at the center. Ms. Van Proyen gave Child A an Epi-pen injection and Child A's mother took Child A to the hospital. Child A returned to care and is still in attendance. Ms. Cheesbro stated that Child A ate a food containing peanuts that was brought in from an outside food source. She said she thought the reaction may be fr
