Ms. Washington observed Ms. Dereczyk grab a child by the arm and yank him back into line. Ms. Wahl watched Ms. Dereczyk walk over to Child A and put her left hand on Child A's shoulder and with her right-hand spank Child A once on the butt. Ms. Wahl observed Ms. Dereczyk hit Child B on the head with a hardcover book.
According to the name-to-face sheets provided by Ms. Viola and acknowledged by Ms. Viola and Ms. Davison, the center did not maintain the required 1:12 child care staff member to child ratio in the Pre-K classroom on: 08/17/2021F rom 9:07 am — 4:51 pm there were thirteen to twenty children present during this timeframe with one child care staff member. An additional staff member was required. 08/19/2021 From 4:32- 4:55 pm there were nineteen children present with one child care staff member. An additional staff member was required. 08/20/2021F rom 8:43 am-9:12 am there were thirteen to seventeen children present during this timeframe with one child care staff member. An additional staff member was required. From 9:17 am — 3:56 pm there were thirteen to fifteen children present during this timeframe with one child care staff member. On 08/24/2021 The complainant stated that there are twenty- three children in the pre-k classroom with one child care staff member daily and they are stressed and overwhelmed because they are working alone with too many children. On 09/01/2021 Ms. Viola stated that the last few weeks the center was short staffed because they had a child care staff member become ill, and another child care staff member resigned. When the center was not able to maintain ratio in the classrooms the decision was made by her and District Manager Ms. Barr to close the preschool 1 classroom effective 08/30/2021. The Pre-K classrooms will be closed next week 09/04/2021, and the classrooms will rotate weeks until additional child care staff members can be hired. She is not enrolling any new families. On 09/01/2021 the Pre-K classroom was in ratio with thirteen children and three child care staff members. On 10/05/2021 Ms. Davison stated that in August there were frequently more than twelve children with one child care staff member; she was not sure of the exact number. She informed Ms. Viola. The ratio issue occurred because child care staff members left the center, and the center was still enrolling children. The situation has gotten better over the past three or four weeks because they have closed the infant and toddler classrooms on different weeks. On 10/14/2021 I reviewed the name-to-face sheets for the Pre-K classroom. The infant and toddler classrooms have more than twelve children daily. On 09/01/2021 Ms. Viola stated that the last few weeks the center was short staffed causing ratio issues, and if the classes were combined, they would be over the allowed group size. This occurred because they had a child care staff member become ill, and another child care staff member resigned on 08/27/2021. When the center was not able to maintain ratio in the classrooms, the decision was made by her and district manager Ms. Barr to close the three-toddler classrooms effective 08/30/2021. The infant classrooms will be closed next week 09/04/2021, and the classrooms will remain closed rotating weeks until additional child care staff members can be hired. She is not enrolling any new families. On 09/01/2021 the toddler classrooms were closed, and the infant classrooms were in ratio. The infant 1 classroom had five children with two child care staff members. The infant 2 classroom had twelve children with three child care staff members. On 09/30/2021 Ms. Viola emailed the name to face sheets for the weeks of 08/11/2021, 08/16/2021, and 08/23/2021 for review. On 10/05/2021 Ms. Davison stated that in August of 2021 she observed one child care staff member with six or seven children alone in the toddler classroom and two child care staff members with sixteen children in the infant classroom. She informed Ms. Viola. The ratio issues occurred because child care staff members left the center, and the center was still enrolling children. The situation has gotten better over the past three or four weeks because they have closed the infant and toddler classrooms on different weeks. On 10/05/2021 and 10/07/2021 I left voicemail messages for Ms. Pint and Ms. Will, and I did not receive a return phone call.
