Based on the review of the video footage, CCSM1 did not use physical discipline or any other method of corporal punishment when handling Child A.

On August 22, 2022, I was notified by Program Director/Licensee Designee Maria Bratke that an incident of Child A being left alone by Child Care Staff Members (CCSM) occurred on Monday August 21, 2022. In the incident report it was documented that during the transition time of the children in the early preschool room to go outside Child A was left in the building unattended. On August 25, 2022, I conducted an unannounced inspection to the Tutortime facility. Upon arrival I met with Ms. Bratke. She reiterated her earlier explanation that CCSMs, Jennifer Coombs and Megan Bukowski, left Child A in the building (hallway) 2 when they went outside. It was Assistant Director Samantha Yerian who found Child A and took him outside to rejoin his group. Ms. Bratke stated that Child A's Mother was notified that day. I interviewed Ms. Yerian about the incident. She has been employed at the center for 8 years and is currently working as the assistant director. She stated that around 11AM on Monday (August 21) she was giving a tour for prospective parents when she came across Child A in the hallway near the door to outside. She maneuvered him out the door to the playground while continuing the tour. She did not wait to see if Ms. Coombs or Ms. Bukowski reacted before taking the parent back inside. Ms. Yerian observed that Child A did not appear distressed and was sitting on a bench. She spoke with Ms. Bukowski and Ms. Coombs later that day and both admitted that they had not noticed that she had brought Child A outside. She knew that the early preschool room was set to leave the room for outside at 11AM. She noticed Child A at approximately 11:15AM. The CCSMs told her they did a count and do not know how he remained inside. I then interviewed Jennifer Coombs. Ms. Coombs has been employed with the center for 2 months as a lead teacher in the early preschool room. Ms. Coombs explained that the class was in the Early preschool room when she did a name to face count in the room and had 16 children. The group lined up and left the room with Ms. Coombs being the last one out. When the group arrived at the first exit door to the outside playground Ms. Coombs did a second name to face count with 16 children. When that first door was opened many of the children ran into the vestibule where Ms. Coombs hurried to the second door before the children could get out. Ms. Coombs was holding the second door open with Ms. Bukowski leaving the building at the first door last. Ms. Coombs acknowledges that once her group went out the second door she went with them and did not look behind her thinking Ms. Bukowski was making sure the children were out. Ms. Coombs remembers leaving the building at around 11AM. She admitted that she did not see Ms. Yerian bringing him out. No count was done in the vestibule between the first and second exit door. She is aware that Child A's Mother was told what happened by Ms. Bratke. She has had no previous issues with Child A before. Ms. Coombs had received training when to complete child attendance counts. My last interview was with Megan Bukowski. Ms. Bukowski has worked at the center for 6 months as an assistant CCSM. 3 Ms. Bukowski explained that a little after 11AM on Monday August 21, 2022, she was in the early preschool room with Ms. Coombs getting ready to go outside. She saw Ms. Coombs do a count with a result of 16 children. Ms. Bukowski left the room first and headed to the first exit door. At this point in the explanation Ms. Bukowski's memory becomes "fuzzy." She did not remember a second count and believes it was Ms. Coombs who was the last one out of the second door. She did not remember looking behind her to see if there were any children behind her to come out. She stated that Ms. Coombs could have gotten to the second exit door first, but she (Ms. Bukowski) was first out of the building to the playground. Ms. Coombs held the door open for her to go outside. She stated that she saw Ms. Yerian bringing out Child A
On May 10, 2021, I received a complaint that a Child Care Staff Member (CCSM) had been aggressive with Child A in the toddler room. They wrote that the CCSM had grabbed Child A by the arm and lifted Child A off the cot by her arm. At the time of the original complaint the name of the CCSM was not given. Only a physical description was provided. The complainant did not mention if Child A had been hurt during the alleged incident. Attempts were made to contact the complainant on May 18, 2021, and June 23, 2021, and Child A's Mother on May 18, 2021. As of the report date I have not received a response from either for follow-up information. On May 13, 2021, I conducted an unannounced inspection to Tutortime and met with Program Director Maria Bratke. We discussed the allegations in the complaint. Ms. Bratke stated that she had not received any complaints from parents that day or the next. She provided me with a list of children attending that day in the Toddler room and matched the physical description provided to CCSM Christine Jenuwine. Ms. Jenuwine is the Lead CCSM in the room. On the Monday her assistant was CCSM Virginia Lakauskas. Both staff members are long time employees with no previous reprimands. Ms. Bratke explained that she tells all parents/guardians that if there are any problems and/or issues that they witness over the live feed to call her, and she will address it immediately. There are children who are new to the room whether they are transitioning from infants or new to the center. It is Ms. Bratke's understanding that there has been no behavioral or adjustment issues from Ms. Jenuwine or Ms. Lakauskas that would fall beyond the norm of appropriate development. Neither Ms. Jenuwine nor Ms. Lakauskas came to her on Monday with any issues either. I then interviewed CCSM Christine Jenuwine. Ms. Jenuwine has been a Lead teacher in various rooms in the center for over 18 years. She is a full-time staff member working Monday through Friday. We discussed any events that happened on Monday May 10, 2021. She stated that nothing out of the ordinary had occurred. She opened the building around 6:00AM starting in the infant room. Around 8:15AM she left infants and went to Toddler 1 where she spent the rest of her day. Her assistant, Ms. Lakauskas, came in a short time later. They were always within ratio, but she was not sure of the exact number of children. At no time were there any problems that required her to report to Ms. Bratke. Nothing happened out of the ordinary. I reviewed the allegation with Ms. Jenuwine. She stated that it had been Child A's first day as a new child in the center. Child A is developmentally appropriate with no behavioral issues that would cause Ms. Jenuwine to become frustrated. She added that she does not lift children off cots by grabbing at their arms and lifting. 4 Ms. Lakauskas was then interviewed. She explained that she has been employed with the center for 21 years as an assistant CCSM. As far as Monday May 10, 2021, Ms. Lakauskas remembers she came in around 8:15AM to the Toddler room 1. There was a total of 8 children present that day because both she and Ms. Jenuwine had 4 children each for primary care. She left the building in the late afternoon. Nothing, she said, occurred that has stuck in her memory. She has never witnessed Ms. Jenuwine be aggressive with the children or lose her patience. Ms. Lakauskas does not speak with the parents unless there is a direct question about a child's primary care. She would not have met with a parent to discuss any problems. Prior to leaving the facility I discussed with Ms. Bratke the possibility of reviewing the surveillance footage from May 10, 2021. Ms. Bratke stated she would contact her Area Director, April Cole, for follow-up with the footage. I was also provided with child information cards and child attendance lists for the week. On May 18, 2021, I interviewed Child B's (2-year-old male) Mother over the telephone. She stated that she had
