R 400.8222(4)(c) Capacity; ratio and group size requirements (4) In each room or well-defined space, the maximum group size and ratio of child care staff members to children, including children related to a staff member or the licensee, must be as shown in Table 1: (c) Preschoolers, 3 years of age until 4 years of age, child care staff member to child ratio of 1 to 1 0, maximum group size of 30.

According to staff interviews and the child and staff attendance records provided, there were 14 children who were present in the Casa 2 Classroom including six 3-year-old children, with one child care staff member on 5/27/2025 from 12:00 p.m. to 2:30 p.m. The child and staff attendance records provided showed that on 5/28/2025, there were 22 children present in the classroom including six 3-year-old children with two child care staff members from 12:00 p.m. until 2:30 p.m. Based on the number and ages of children present the classroom was not in compliance with the required staff to child ratio.

On 12/16/2023, I interviewed Child A's Father by phone. He said he has two children who attended the center. The children attended two days a week on Tuesday and Thursday. Child A has been attending for four years now. On Friday 11/18/2022 Child A was undressing, and Child A's Father noticed a bruise on his shoulder. Child A was asked about the bruise and Child A stated he got hit at school. Child A's parents were surprised because they did not receive any notification from the center. Child A was questioned further, and he said he was hit by another kid on the playground. Child A was not able to provide much more 2 information because, "he's only 4 years old." On Monday 11/21/2022 Child A's parents emailed the center asking about the incident and did not receive a response. On Tuesday 11/22/2022 when Child A was scheduled to attend the center the parents attempted to talk to the owner. The owner however was not available on Tuesday. Child A's parents did not want to discuss the incident with the teacher in case the teacher had caused the bruise. Child A's parents noticed that Child A had become whiny when having to go to the center. They thought it could be due to the teacher and Child A not melding well together. Child A has been with the teacher since the summer of 2022. By Wednesday Child A's parents still had not received a response to their email so they emailed the center again. On Wednesday they received a response from the program director that she would have the teacher contact them and follow up. The family did not want to talk to the teacher first and felt that the program director was very dismissive of their serious issue. Child A's last day attending the center was 11/22/2022. Child A's Father said he understands that anything could have happened; and they aren't assuming a staff member hurt Child A. Child A's parents just felt that the incident should have been handled better and addressed by the person they addressed the issue to. The center normally is very vigilant in reporting everything no matter how small. Prior to this incident Child A's parents have never had any concerns about care or supervision of either of their children. On 12/19/2022, I completed an unannounced inspection at Children's Place Montessori of Brownstown. I interviewed program director and licensee designee Maria Liburdi, CCSMs Aelesia Riddle, Chelise Marsh, and Mara Whisler. Program director and licensee designee, Maria Liburdi stated that she did receive an email from Child A's parents, and she responded instantly and informed the parents that the lead teacher in the room Chelise would follow up. Maria talked to the staff in Child A's room, and they all stated that they did not view or know of anything that could have caused the bruise. The CCSMs Maria spoke to were Chelsie, Mara, and Aelesia. CCSM Aelsia acts as a supervisor at the center. CCSM Chelsie and Mara work in Child A's room and are 100% certain another child did not hit child A and neither did they. Neither of the CCSM's in Child A's room recalled Child A coming to them and complaining that he was hurt or that anything happened to him. If staff observe or are informed of any accidents or incidents, they are to write them up right away. These incidents include when a child hits another child. If they are informed by a child that another child has hit them, they tell the children that they will go and view the cameras to ensure that it happened. The center does this to cut down on children telling stories and it helps when a staff member did not see the incident occur. Aelesia did view the camera footage for the date in question and did not see anything. The camera footage is no longer available. The center takes bullying very seriously which is why they view the camera footage. They have disenrolled children over bullying incidents. 3 CCSM Aelesia Riddle stated that she viewed the camera footage as requested by Maria. Maria called her and informed of the incident. The next

On June 11, 2021, I initiated this investigation via telephone with Child A's father. Child A's father stated that he arrived at the childcare facility on June 3, 2021, and was told that he could not leave with Child A. He stated that Maria Liburdi told him that she'd have to contact Child A's mother before allowing him access to Child A. Child A's father reported that this happened again on June 8, 2021. On June 23, 2021, during an unannounced on-site inspection, I interviewed the program director, Marie Liburdi. Ms. Liburdi reported that on June 3, 2021, when Child A's father arrived, she did call Child A's mother. She stated that she contacted her because she had just spoken to her about 15-20 minutes prior to Child A's Father arriving. During their previous telephone conversation, Child A's mother stated that she was going to arrive for pick-up in 30 minutes. Ms. Liburdi stated that she called Child A's mother, not for permission to release Child A, but to let her know that Child A's father was present so that she wouldn't get to the center and Child A be gone already. Ms. Liburdi stated that she was trying to prevent Child A's mother from make a wasted trip. Ms. Liburdi stated that Child A's father waited outside for approximately 2 minutes. She stated that he did not enter the building due to their COVID 19 protocol, parents are not allowed in the building for pick up and drop off. Ms. Liburdi stated that there is not a custody order in place for this family and she also stated that she is aware of the license rule pertaining to such orders. On June 25, 2021, interviewed Child A's mother via telephone call. Child A's mother stated that she did receive a telephone call from Ms. Liburdi on the date in question. She said that Ms. Liburdi did not ask her for permission to release Child A. She said that Ms. Liburdi was letting her know that Child A's father was there for pick up so she would not come. Child A's mother stated that no parents are allowed in the building during drop off and pick up because of COVID 19. She stated that she feels that Child A's father "overreacted". Child A's mother stated that she does not have any concerns with the care provided at this child care facility.
