The Office of Child Care Licensing (OCCL) received a complaint on January 26, 2023, regarding improper staff-to-child ratio, unqualified staff members alone with children, lack of supervision, staff present that had not been fingerprinted or determined eligible by the Criminal History Unit (CHU), not following requirements for diaper changing, not following requirements for child health exclusions, not notifying parents when a child is sick, and staff members not interacting with children in the classroom. An investigation was conducted on January 31, 2023. The complaint is substantiated because, during the complaint investigation, it was observed all but one of the classrooms had unqualified staff members alone with children. In one classroom, the correct staff-to-child ratio were not being followed. There was one staff member present who was not able to provide verification of fingerprinting receipt for the center and had not been determined eligible by the CHU. Ms. Davis did forward this documentation to OCCL, but the CHU has not received the fingerprinting to determine the eligibility. There is no evidence to substantiate the allegations regarding not following the requirements for diaper changing, not following the requirements for child health exclusions, not notifying the parents when a child is sick, lack of supervision, and staff members not interacting with the children in the classroom. During the complaint investigation, it was determined through observations and interviews these requirements are being followed. Other concerns noted during the complaint investigation are a room had been constructed within Room 4 without prior approval from OCCL and staff members not documenting the combination of the two classrooms correctly on the attendance records.

The Office of Child Care Licensing received a complaint on June 27, 2023, regarding improper discipline and not following policies on videotaping children. An investigation was conducted on July 12, 2023, and July 14, 2023. This complaint is substantiated for not following policies for videotaping children because documentation was provided showing Staff #1 was creating TikTok videos with children in the background and posting them without permission from the parents. There is no evidence to substantiate the allegation of improper discipline because the staff members interviewed denied grabbing or pinching children in care or witnessing other staff members do so. An additional concern noted during this complaint investigation is the center was using indoor space for gross motor activities that had not been measured or approved by OCCL.

On June 20, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding improper diapering, improper discipline, and unqualified staff working alone with infants. An investigation was conducted beginning June 21, 2024, and ending July 1, 2024. This complaint is substantiated for unqualified staff working alone based on observations. Staff #1, who had no DEEDS qualification certificate, was observed alone in the two-year-old classroom on June 21, 2024, and Staff #7, an early childhood intern, was alone in the infant classroom on July 1, 2024. There is no evidence to substantiate this complaint for improper discipline based on staff interviews conducted. All staff interviewed stated they had never witnessed any improper discipline. There is no evidence to substantiate this complaint for improper diapering based on staff interviews. All staff interviewed stated diaper checks are conducted hourly and changed every two hours or when soiled. Additional concerns noted at the visit were inaccurate attendance records for children and staff in multiple classrooms. An additional concern noted was observation of an infant sleeping on the floor wrapped in a blanket. An additional concern noted at this visit was lack of supervision due to a child being found alone in the meeting room. When asked, the owner stated this was one of the staff members children.

On June 7, 2024, the Office of Child Care Licensing (OCCL) received two complaints regarding insufficient staff, unqualified staff, not following the daily schedule, not taking the children outdoors, not engaging in activities with the children or not following lesson plans, overuse of screen time, not allowing parents in classrooms, not receiving injury reports for children, not completing or providing daily logs for infants, and not having adequate lighting in the facility. An investigation was conducted on June 12, 2024. This complaint is substantiated for unqualified staff being alone with children based on observation of the classrooms. Staff #1 was observed alone with the Little Explorer classroom during nap time without a DEEDS Early Learning qualification. This complaint is substantiated for not allowing families to drop off and/or pick up children in the classrooms. The Owner and staff interviewed stated families drop off in the lobby connected to the front room or a staff member walks the children to their classrooms. There is no evidence to substantiate this complaint for insufficient staff based on observations of the classrooms, staff schedules observed, attendance records viewed, and staff interviews. All staff interviewed stated classrooms always follow staff-to-child ratios. There is no evidence to substantiate this complaint for not going outside daily based on staff interviews. All staff interviewed stated they take the children outside daily weather depending. There is no evidence to substantiate this complaint for not engaging in a variety of different activities with the children based on staff interviews. All staff interviewed stated the children are engaged in activities daily. There is no evidence to substantiate this complaint for not following posted lesson plans based on interviews. All staff interviewed stated they follow posted lesson plans. There is no evidence to substantiate this complaint for overuse of screen time based on staff int erviews. All staff interviewed stated that children only receive screen time for less than one hour a day and children under the age of two do not get screen time at all. There is no evidence to substantiate this complaint for not receiving injury reports based on observation of completed children s injury/accident reports on Procare. There is no evidence to substantiate this complaint for not completing or providing daily logs based on observation of all infant daily sheets. There is no evidence to substantiate this complaint for not having adequate lighting in the facility based on observations of lighting in the facility. An additional concern noted at the visit was a staff member was observed on a cell phone while caring for children.

On July 21, 2023, the Office of Child Care Licensing (OCCL) received a complaint regarding improper discipline and not maintaining the correct staff-to-child ratios. An unannounced visit was conducted on July 24, 2023, to investigate this complaint. The complaint is substantiated for not maintaining correct staff-to-child ratios because it was observed during the complaint investigation. The one-year-old classroom had nine children present with two unqualified staff members. This was corrected at the visit when Staff #3 and Staff #5 switched classrooms. The definition of a qualified staff member was explained again during this visit to ensure the understanding was clear. There is no evidence to substantiate the allegation of improper discipline because Owner Barbara Davis and four staff members that were interviewed separately all stated they do not use improper discipline and they have never seen another staff member using improper discipline. During the complaint visit, the concern that the center yet again does not have a qualified Early Childhood Administrator was addressed.
