On August 12, 2022, OCCL received a complaint regarding disrespectful communication between staff. An investigation began on August 17, 2022, and concluded on August 25, 2022. This complaint is substantiated for disrespectful communication between staff because multiple staff, including the staff involved, stated two staff were yelling at each other while children were in care. One of these staff members submitted her resignation date, but was dismissed prior to that date.

On August 15, 2022, OCCL received a complaint regarding a staff member drinking an alcoholic beverage in the classroom. An investigation began on August 17, 2022, and concluded on August 25, 2022. This complaint is substantiated for a staff member drinking while working with children because multiple staff observed the staff drinking the alcoholic beverage, the staff member told others she was drinking, the can was found in the center by the administrator, and video footage was observed of the staff drinking while children were in care. Once this information was brought to the owner s attention, the staff member was immediately fired.

On August 11, 2022, OCCL received a complaint regarding staff vaping while children were in care, staff using their cell phones while caring for children, and lack of supervision. An investigation began on August 17, 2022, and concluded on August 22, 2022. This complaint is substantiated for staff using their cell phones and lack of supervision because staff stated cell phone use has been an ongoing problem while caring for children. This complaint is substantiated for staff vaping because the administrator and other staff members stated they observed staff vaping while on the premises, inside classrooms, and while caring for children. The administrator who was present during these incidents was fired.

On August 9, 2022, OCCL received a complaint regarding the center being too hot, the staff being too young to be alone with children, lack of sanitation, and there not being qualified staff in the center after 3:30 pm. An investigation began on August 10, 2022, and concluded on August 22, 2022. This complaint is substantiated for having unqualified staff working with children because the former administrator assigned an aide to work alone with children on August 1 and August 5 as shown on attendance records. Subsequently, the administrator's employment has been terminated and the staff received her qualifications certificate and may now be left alone with children. There is no evidence to substantiate this complaint for lack of air conditioning when the building is hot because the staff stated the center felt fine, the temperature never rose above 72 degrees, and when the specialist checked the temperature on two separate days the temperature was no higher than 72 degrees in the building. There is no evidence to substantiate not following COVID protocols and proper sanitizing because the staff stated they cleaned and sanitized the classrooms and bathrooms daily. In addition, the center closed the classroom affected by COVID. A concern noted was a fan was in use within children s reach.
