OCCL s investigation of regulatory non-compliance began after clearance from other agencies was received. On November 18, 2025, the Office of Child Care Licensing (OCCL) received two complaints regarding failing to use appropriate behavior supports and lack of supervision. An investigation began on November 14, 2025, and concluded on February 3, 2026. After carefully reviewing information available to OCCL from other agencies and information received from center administration, there is no evidence to substantiate this complaint for failing to use appropriate behavior support or lack of supervision.

On December 9, 2025, the Office of Child Care Licensing (OCCL) received two complaints regarding lack of supervision, failing to follow accident and injury procedures, unqualified staff, failing to use appropriate behavior supports, and transportation. An investigation began on December 15, 2025, and concluded on January 13, 2026. This complaint is substantiated for having unqualified staff alone with infants based on staff interviews and documentation received. Documentation showed Staff #1 alone with infants on at least one day and three staff members stated Staff #1 is always alone with infants, despite being qualified as an Early Childhood Intern. There is no evidence to substantiate this complaint for lack of supervision, failing to follow accident and injury procedures, or transportation. Although staff stated they heard a child was bitten, all staff stated they had no direct knowledge and did not witness an incident. There was no direct evidence that Staff #3 is a staff member paid by the center despite another staff member stating they believed Staff #3 is a staff member and provides transportation. Additional concerns noted were staff and child attendance records were incomplete, there were no staff signed into a classroom for one hour, not being truthful with OCCL staff, and not having a staff member present who is qualified as an Early Childhood Teacher and trained in day-to-day operations. There were multiple instances of staff and children not being signed out on attendance records as well as these paper attendance records not matching attendance documentation provided from the ProCare application. On one day, there was no staff signed into a classroom for one hour with four children present, and according to several staff statements, classrooms are often out of ratio. Regarding the alleged biting incident, staff member statements contradicted each other, and it appeared at least one staff member was not being truthful. According to staff statements and attendance documentation, there are no staff present in the mornings who are qualified as at least an Early Childhood Teacher and trained in day-to-day operations.

On November 25, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding not following policies for responding to parent complaints, not following the written children s behavior supports statement, and not consulting with a child s parent or guardian and professionals, if necessary, to design effective positive behavioral supports. An investigation was conducted on December 4, 2025. Based on staff interviews and documentation received, there is no evidence to substantiate this complaint for not following their policies for responding to parent complaints, not following their written children s behavior supports statement, and not consulting with a child s parent and professionals, if necessary, to design effective positive behavioral supports. Staff stated messages from parents are responded to promptly and there is documentation supporting this. Between July 22, 2025, and July 24, 2025, the Office of Child Care Licensing (OCCL) received multiple complaints regarding improper discipline, infant safe sleep violations, safety of infant cribs, not following infant feeding schedules, a staff member arriving to work intoxicated, staff cursing in front of and at children, children going outside when it is over 90 degrees, and the center not cleaning properly. An investigation was conducted on July 28, 2025. According to staff interviews, observations and documentation received, there is no evidence to substantiate any of the allegations. All staff denied using improper discipline with children, cursing in front of or at children, any staff member arriving to work intoxicated, not using safe sleep practices, and children going outside when it is over 90 degrees outside. According to documentation and staff interviews, infant feeding statements were followed within DELACARE Regulations as documentation from a doctor was not received to approve the requests listed in the feeding statement. According to staff interviews, cleaning routines are done in accordance with DELACARE Regulations. According to observations made during the visit, the infant cribs were all in safe condition.

On November 14, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding failure to report suspected child abuse or neglect that occurs while a child is in or out of the center s care, and not having a supply of clean diapers and extra clothing available for children even if a parent or guardian does not provide them when required. An investigation was begun on November 14, 2024, and concluded on November 27, 2024. There is no evidence to substantiate this complaint for failure to report suspected child abuse or neglect as it was verified Staff #1 notified the Child Abuse and Neglect Report Line on November 14, 2024. There is no evidence to substantiate this complaint for not having a supply of clean diapers and extra clothing available because according to staff interviews and facility observations, the center has extra clothes and diapers for a variety of age groups at the center.

On November 21, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding providing unauthorized transportation, not using respectful communication with parents due to not notifying parents a child did not follow their planned transportation method, and not making reasonable accommodations to comply with provisions in an Individualized Education Plan (IEP) to adapt other practices for a child who has a special need or disability. An investigation began on November 27, 2024, and concluded on December 13, 2024. This complaint is substantiated for providing unauthorized transportation based on staff interviews. All staff stated Staff #1 drove Child #1 to school when the center has not been approved by OCCL to provide transportation. There is no evidence to substantiate this complaint for not using respectful communication with parents because according to staff interviews and documentation received, staff did not use disrespectful communication with parents, though staff did not notify parents Child #1 did not ride the bus. There is no evidence to substantiate this complaint for not making reasonable accommodations to comply with provisions in an IEP to adapt other practices because according to staff interviews and a file review, Child #1 does not have an IEP on file.

On July 22, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding lack of supervision, administrator not being present the required hours and functioning in that role, screen time, mixed ages of children combined outside of hours permitted, and staff not reporting a child injury. This complaint is substantiated for staff not reporting a child injury because according to staff interviews and documentation received, the parent was not informed of a serious or potentially serious injury immediately after the injury occurred. There is no evidence to substantiate mixed ages of children are combined outside of hours permitted because according to staff interviews, they only combine for 90 minutes in the morning and combine in the afternoon only when there are less than twelve children total in the center. There is no evidence to substantiate this complaint for lack of supervision because based on staff interviews, there was a staff member in the lobby with the child when they opened the door for a parent, and it was immediately corrected. There is no evidence to substantiate this complaint for the administrator not being present the required hours and functioning in that role because based on staff interviews and documentation received, an administrator is working at least fifty percent of operating hours, and they function in that role. There is no evidence to substantiate excessive use of screen time because based on staff interviews, screen time is only used less than one hour a day.

On July 23, 2024, the Office of Child Care Licensing (OCCL) received a complaint regarding improper discipline and additional concerns regarding incorrect staff-to-child ratios, the administrator not fulfilling job responsibilities, incorrect portion sizes for food and drinks, and not having a menu posted or changes to the menu communicated to parents. An investigation was conducted on August 28, 2024. This complaint is substantiated for improper staff-to-child ratios because according to documentation received, a staff member was alone with five infants for almost seven hours. There is no evidence to substantiate this complaint for improper discipline because according to staff interviews, all staff denied current staff members are using or have used improper discipline with children in the center, including their own. There is no evidence to substantiate this complaint for the administrator not performing duties as required because according to staff interviews and documentation received, administrators at the center are performing duties as required. There is no evidence to substantiate this complaint for improper portion sizes for food and drink because according to staff interviews and observations, children receive the proper portion sizes for food and drinks. There is no evidence to substantiate not having a menu posted or changes communicated to parents because according to staff interviews and documentation received, a menu was posted at the center and all staff stated parents are notified of changes to the menu. An additional concern noted at the visit was inaccurate staff and child attendance records because documentation received did not show children or staff signed out of classrooms accurately and children were signed into multiple tracking sheets at the same time. Another concern noted at the visit was a staff member working before being determined eligible. There was a staff member at the time of the visit who had not been fingerprinted and determine d at least provisionally eligible and on another date, according to documentation received, a staff member was alone with a group of children with only provisional eligibility. An additional concern noted was, based documentation reviewed, there were staff members who had not received the appropriate DEEDS Early Learning qualifications certificate enabling them to be alone with children, but attendance records submitted revealed they are left alone with children on multiple occasions.

On July 29, 2024, The Office of Child Care Licensing (OCCL) received a complaint regarding improper discipline. An investigation was begun on August 6, 2024, and concluded on September 3, 2024. There is no evidence to substantiate this complaint for improper discipline because although two staff members stated an incident occurred, there were inconsistencies regarding the circumstances while staff were recounting the incident. An additional concern noted at the visit was two staff members failed to notify the Child Abuse and Neglect Report Line immediately when it was suspected that child abuse might have occurred at the center.
