102417(g)(5)(A) · (A) Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Today, Licensee stated that she would remedy the deficiency by placing a rod iron gate along side where the car port is. Per licensee, there was a gate there before but it was removed at some point. Licensee will also ensure that all areas of the pool fence are the required height of 5 ft and no more than 4 inches of opening from the cement floor. Based on observtion, licensee did not meet the requirement stated above. It was observed that there were multiple areas where the height of the pool gate was lower than 5 ft and that one pool section of fencing was missing as well one gate that swung inward instead of away from the pool as required. This poses a potential risk to the health, safety and or personal rights risks of children in care. The pool gate door near the master bedroom will be reconfigured to ensure it meets the requirement of swining away from the pool, be self closing and the pool latch will be placed no more than 6 inches from the top. A return inspection will be completed to ensure the deficiency is corrected. SUPERVISOR'S NAME Susie Fanning
