(a) To ensure the health and safety of all children enrolled, the management of the child care agency shall maintain a system that enables all children to receive a level of supervision that is appropriate to their age and their developmental, physical and mental status. The child care agency staff shall know where children in their care are at all times, be aware of their activities, and be able to intervene appropriately. (c) If any child is left unattended at any time, the child care agency is subject to summary suspension, denial or revocation of the license. This includes, but is not limited to a child: 2. Being left in a classroom or any other area of the facility; A child was left unattended in a classroom while the educator and the other children transitioned to the playground. The child was found by a parent, who immediately informed the educator in the classroom next door and placed the child in her care.

See Below for Detailed Information 1240-04-01-.11 SUPERVISION (3) Playground Supervision. (b) Child care agencies shall develop and follow a written playground supervision plan that includes: 6. Roll call before leaving classroom and upon arrival at playground and prior to leaving playground and upon arrival in classroom. The educator failed to do roll call upon leaving the playground, arriving back to the classroom, and leaving the classroom again to transition the children to their closing classroom. . 1240-04-01-.11 SUPERVISION (1) Supervision Procedures. (a) To ensure the health and safety of all children enrolled, the management of the child care agency shall maintain a system that enables all children to receive a level of supervision that is appropriate to their age and their developmental, physical and mental status. The child care agency staff shall know where children in their care are at all times, be aware of their activities, and be able to intervene appropriately. (c) If any child is left unattended at any time, the child care agency is subject to summary suspension, denial or revocation of the license. This includes, but is not limited to a child: 3. Being left on the playground; A child was left unattended for an undetermined amount of time on the outdoor playground while the educator and the other children transitioned back to the classroom on February 28, 2022. The child was found by a parent, who immediately informed the educator that the child was outdoors alone. The educator retrieved the child and returned her to the classroom. 1240-04-01-.09 INCIDENT REPORTING (1) Reports of Incidents, Illnesses, Accidents, Injuries, and Fatalities. (a) Incidents, accidents, injuries, and signs of illness shall be reported to the parent/guardian no later than the child’s release to the parent/guardian or authorized representative on the date of occurrence. (d) Incidents, accidents, injuries, and signs of serious illness to children shall be documented immediately with the following information: 1. Child’s name and date of birth; 2. Name of the person writing the report; 3. Date and time; 4. Date and time of completion of incident report; 5. Description of incident and circumstances; and 6. Action(s) taken by the child care agency. (e) The documentation shall be provided to the parent/guardian the same day of the incident, and filed in the child’s record. The agency failed to notify the parent immediately or upon pick up of their child being left on the playground, and also failed to notify them of an accident/injury that the same child had earlier in the day. Although an accident report was immediately completed after the child bit her tongue, the documentation was not provided to the parent on the same day of the incident. A report was not completed for the incident of the child being left unsupervised on the playground.
