Observed that educators failed to wash their own hands and the hands of classroom children before and after meals. The Infant classroom child-to-teacher ratio was not in compliance with 1 adult to 5 infants aged between 10 months - 12 months (should be 1:4). The thermostat was set to 66 degrees. However, all agency facilities must be maintained at a temperature between 68 and 78 degrees.

Summary of Complaint Investigation Visit The visit conducted today included monitoring of the agency's compliance with Licensing Rules and Regulations and Complaint Investigation Technical Assistance Provided: 1. Smoking/Vap is not permitted in any indoor area of the childcare agency at any time. 2. All staff must complete Before You Begin and Shaken Baby training before having contact with children. ***Addendum*** Upon responding to a complaint at Tutor Bug Tots on 6/9/2023 LC Vance discovered your agency added a wall creating two rooms instead of what used to be one room. FS Leonard made a follow-up and measured the two new unapproved spaces that were already in use on 6/15/2023. FS Leonard measured the space and obtained a signed floor plan from the provider on 6/15/2023 (see attached). Upon conference with Regional Manager and Legal, FS Leonard contacted the provider via phone and e-mail on 6/16/2023 @ 1:12 p.m. to inform Ms. Martin to close the two classrooms by the close of business 6/16/2023 @ 5:00 p.m. The two classrooms (6 weeks-30 month-old room & 2 1/2 - 5-year-olds) shall not reopen until fire and environmental approvals are received by the department. Per RM approval on 6/16/2023, the provider may combine the 2 /2 – 5-year-old children if the capacity of the approved room in the front of the building is not exceeded (12 capacity). The provider will need to shut down the two classrooms (6 weeks-30 month-old room & 2 1/2 - 3-year-old rooms) until this space has been approved by fire and environmental. A formal request has been made to fire on 6/15/2023 and environmental on 6/16/2023 with a need-by date of June 30th or ASAP. An addendum to visit MNV20023101 on 6/9/2023 will be made with a violation cited for the use of unapproved space. 1240-04-01-.16 PHYSICAL FACILITIES 1. Inspection by the State Fire Marshal's Division of the Tennessee Department of Commerce and Insurance and/or local fire authority; and 2. The General Environmental Division of the Tennessee Department of Health. (b) The physical facilities (indoor and outdoor) present no apparent hazards; and (c) The physical facilities are otherwise deemed appropriate by the Department for the safe care of children. An unannounced visit was conducted today in response to complaint # PCS1002064 as well as follow-up for previous violations. A Safety Plan has been put in place. This visit included monitoring of the agency's compliance with Licensing Rules and Regulations. Visit Summary: Follow-Up Visit. Complaint Investigation #PCS1002064. Safety Plan delivered. Technical Assistance Provided: LC will contact CCR&R to assist with room arrangement in the 6-week-30-month-old room. Ensure the older children in the 6 weeks-30 months room are not using equipment designed for infants. See the manufacturer's instructions for weight limits. Educator's drinks will be placed high out of children's reach. Carpet with non-slip tape can be used to cover the missing tile in the 2 1/2 -5-year-old room. Based on staff interviews and observations the complaint is found to be invalid. Violation: 1240-04-01-22 Specific Requirements for Child Care Centers Children on roll and signed into the preschool 2 ½-5 yr old classroom did not remain with their defined group and were moved to other classrooms rather than remaining with the same group throughout the day. Violation: 1240-04-01-.14 Equipment Several children in the infant/toddler and preschool classrooms were napping on 1 inch mats. Technical Assistance Provided: 1. Discussed and read supervision rules and regulations with Director and by phone with the Owner. 2. Discussed staffing issues, hiring practices and A:C ratios for each classroom that shall be maintained at all times. 3. Discussed developmentally age appropriate nap equipment for all children. 4. Discussed placement of electrical cords to remain out of children's reach at all times. 5. Discussed potential hazardous and harmful items to be kept out of children's reach at all times. 6. Discussed anchoring shelves in the infant and toddler classrooms to ensure children's safety. 7. Discussed flooring in the preschool classroom to be repaired or covered to keep from being a tripping hazard. Equipment for Children 1240-04-01-.14 Children were observed sleeping on 1 in nap mats. The agency will ensure all children have the required developmentally age appropriate nap equipment. 1240-01-01-.22 Specific Requirements for Child Care Centers Following a complaint investigation, and upon observation, it was determined that three children signed into the 2 ½-5 year old classroom were moved to the toddler and preschool 4-5 year old classrooms. Children did not remain with their defined group throughout the day. The agency will ensure all children are signed in and out and remain in their assigned classroom throughout each day.

Summary of Monitoring Visit An unannounced visit was conducted today in response to complaint # PCS1001879, this visit included monitoring the agency's compliance with Licensing Rules and Regulations. Technical Assistance Provided: Building and physical premises safety - A door to the outside was found not to lock in the 3-4-year-old room. The provider made an appointment for repair while LC was onsite. If not enough staff is present for the day, the agency must not take any more children if ratios will exceed compliance. TA was given regarding creating sublists for emergencies. If a child is not signed in, the educators have been instructed to initial for the child's presence, highlight the name, and remind the parent to sign in /our during pick-up. All children must be accounted for at all times. Violations were received and included: 1. Specific Requirements for Child care Centers - Required Adult: Child Ratios 2. Supervision -(e) Sign-in/Sign-Out procedures . A corrective Action Plan (CAP) will be completed. Violation details can be observed below. Upon arrival, one room was observed out of ratio. 2 - 4-year-old room 1:9 ratio. The educator in the 3-4-year-old room was requested by LC to move over to the 2-4-year-old room to correct the violation. The 3-5-year-old room had one child to leave and another older child was moved to the 4-5-year-old room. The ratio in the room was reduced to a 1:13 ratio. Children's daily sign-in and sign-out sheets were not accurate. Upon LC's arrival fifteen (15) children were present in the 3-5-year-old room and eleven (11) children were signed in for the day 1-19-2023. Specific Requirments for Child Care Centers Required Adult: Child Ratios Upon arrival, two rooms were observed out of ratio. 2 - 4-year-old room 1:9 ratio 3-5-year-old room 1:15 ratio Agency Corrected while Licensing Consultant was onsite. The agency will complete a corrective action plan to prevent over ratios from occurring again. Sign-In/Sign-Out Procedures 3-5-year-old room - 11 children were signed in, 15 were present. Child care agencies shall maintain a daily sign-in and sign-out sheet or electronic sign-in or sign-out record that include.
