Summary of Complaint Investigation Visit The visit conducted today included monitoring of the Agency's compliance with Licensing Rules and Regulations. Violations Received: are noted below Violation #1- Observation- On March 1, 2023, LC Clark and LC Rogers conducted an unannounced complaint investigation visit and observed the agency did not have adequate staff for the children present during the early morning hours which resulted in a grouping violation when a 22-month-old child arrived and was grouped with children over 30 months (32 and 34 months). 1240-04-01-.22 SPECIFIC REQUIREMENTS FOR CHILD CARE CENTERS. (1) Required Adult: Child Ratios. (a) Adult: child ratios in this paragraph shall be maintained by the child care agency while the children are on the premises of the child care agency, including outdoors or on the playground. (c) Child Care Ratio and Group Size Charts. 1. Chart 1 – Age Grouping. Reference chart on page 83 of the rules. (d) Assignment of Children to Groups. 1. Each child shall be on roll in a defined group and assigned to that group with a specific educator(s). 5. Children shall be kept with the same group throughout the day. 9. Groups of children may never be mixed as part of the regular routine or operation. Exception: Pre-school and school-age groups may be mixed based upon emergencies, holidays, or low attendance days. 10. Child care agencies shall define grouping for each classroom. Violation #2- Observation- On March 1, 2023, LC Clark and LC Rogers conducted an unannounced complaint investigation visit and observed the agency did not have adequate staff for the children present during the early morning hours. 1240-04-01-.06 STAFF. (1) Responsibility for Staff. (a) Owners, directors, and primary educators shall be responsible for: 2. The supervision, training, and evaluation and performance management of the staff; 3. The efficient operation of the child care agency's program; Violation #3-Observation- On March 1, 2023, LC Clark and LC Rogers conducted an unannounced complaint investigation visit and observed the agency did not have adequate staff for the children present during the early morning hours which resulted in a supervision violation in Toddler/2's class. 1240-04-01-.11 SUPERVISION. (2) Supervision Procedures. (a) To ensure the health and safety of all children enrolled, the management of the child care agency shall maintain a system that enables all children to receive a level of supervision that is appropriate to their age and their developmental, physical and mental status. The child care agency staff shall be within sight and sound of the children in their care at all times, be aware of their activities, and be able to intervene appropriately. Technical Assistance: LC Clark recommends that the agency send a reminder notice to all parents/guardians of the required age groupings and ratios required by Licensure Rules for Child Care Agencies. Notice should include: (c) Child Care Ratio and Group Size Charts. 1. Chart 1 – Age Grouping. 2. Chart 2 – Age Grouping. 3. Chart 3 – Allowable Combined Grouping and Adult:Child Ratio Chart for first/last hour and one-half (½) of each day only. The agency should also include information as to what is required of the parent/guardian if the Agency is at maximum group size, i.e. parents/guardians waiting with their children until another staff member or educator arrives. LC Clark recommends having parents/guardians sign the notice to confirm that parents/guardians understand to prevent another grouping and/or ratio violation in the future. LC Clark suggests that each age group has an educator in the early morning hours to ensure groupings and ratios are maintained. Both educators and management need to be aware of groupings and ratios to maintain compliance. TAM Referral submitted to Child Care Resource and Referral (CCR&R) for targeted technical assistance for Administration and Professional Leadership – Staffing Patterns and Health and Safety Specific – Behavioral Management.
