Boone Trail Early Learning Center self-reported suspected child abuse that occurred on May 13, 2024. The agency failed to report the incident to the child's parent/guardian or authorized representative on the date of occurrence. Child's parents were notified two (2) days after the incident occured. The agency failed to report the suspected child abuse to the Department of Children's Services immediately as required by Tennessee Law and Licensing Rules & Regulations. Management failed to prepare staff properly to report child abuse. Management also failed to report suspected child abuse one it was brought to their attention. Boone Trail Early Learning Center self-reported suspected child abuse that occurred on May 13, 2024. The agency failed to report the suspected child abuse to the Department of Children's Services immediately as required by Tennessee Law and Licensing Rules & Regulations.

Unannounced Complaint Investigation - The visit conducted today included monitoring the agency's compliance with Licensing Rules and Regulations. LC monitored the following areas – Supervision, High Risk and Incident Reporting, and Record Keeping. Monitoring / Observations: LC conducted interviews with Director and agency staff. LC obtained a copy of the termination letter for one staff member, the disciplinary forms, and the child's incident report. LC determined that this complaint was valid and a violation was cited - see below and safety plans were served on two educators. Technical Assistance: LC discussed playground supervision and roll call with each educator in the classrooms. LC discussed the licensing rules of the minimum four times per playground visit that roll call must be completed and LC suggested that the agency add more roll calls to be completed at each doorway or transition area since this lapse occurred in one of those areas. LC discussed that epi-pens must be stored inaccessible to the children at all times. The epi-pen was moved to a higher location in the classroom. The following VIOLATIONS were cited: Violation #1 - 1240-04-01-.11 SUPERVISION. (2) Supervision Procedures. (a) To ensure the health and safety of all children enrolled, the management of the child care agency shall maintain a system that enables all children to receive a level of supervision that is appropriate to their age and their developmental, physical and mental status. The child care agency staff shall be within sight and sound of the children in their care at all times, be aware of their activities and be able to intervene appropriately. (c) If any child is left unattended at any time, the child care agency is subject to legal enforcement action. A child left unattended includes, but is not limited to a child: 1. Walking out of a child care agency without the knowledge of staff; 2. Being left in a classroom or any other area of the facility; 3. Being left on the playground; 4. Being left at a field trip location; or 5. Being left on a vehicle. Observations: On August 7, 2023 Agency Director self-reported that a 20-month-old child was left unattended in the hallway for about 45 seconds as the children transitioned from the playground back to the classroom. LC served two educators' supervision safety plans. LC discussed the supervision log with the Director and the requirements of the safety plans. Summary of Unannounced Monitoring Visit The visit conducted today included monitoring of the agency's compliance with Licensing Rules and Regulations and Serve Notice of Probation. Technical Assistance Provided: Probation was hand delivered and served to the agency. A copy of the Probation was given to the Director and new Lead Pastor. Parent Notification letter and Parent Signature sheet were also given to the Director. LC instructed the Director that the Probation Notice Orange sign and the notice of probation must be posted immediately in an area easily visible to the parents. Both were posted on the bulletin board near the entrance doors of the childcare agency. These notices must be posted immediately due to the wording in the law that says parents should be notified when a legal order is issued. LC stated that instructions are in the Probation notice and for the agency to follow the steps given in the document if the agency wishes to appeal. Rule Sections Monitored: High-Risk Areas Visit: Order of Civil Penalty Served I, Jennifer L. Phillips, declare that I served an Order for Civil Penalties regarding Boone Trail Early Learning Center, by personal service to the Director, an authorized representative of Boone Trail Early Learning Center on April 24, 2023, at 10:20 AM. Unless appealed in writing to the Commissioner of the Department of Human Services, this Civil Penalty shall become final ten (10) calendar days after the date the order of assessment is served. Technical Assistance: LC discussed the Kindergarten law form and emailed the form to Director. LC also discussed with Director about changing the ratio grouping to 5-12-year-olds when all children are five years old or older by the end of May and there is currently a six-year-old child in the classroom. LC monitored the following areas – Supervision, High Risk and Incident Reporting, and Record Keeping. Monitoring / Observations: LC conducted interviews with Assistant Director and agency staff. LC reviewed agency staff files. LC reviewed the children's files. LC determined that this complaint was valid and violations were cited - see below and safety plans were served to the agency and seven educators. Technical Assistance: Groups of toddlers were discussed and LC will wait for the Regional Manager's response on citing that violation and this could occur during the next visit. However, LC did discuss that toddler groups can not be combined at any time. LC discussed that the agency must notify Department when the agency or classrooms are going to be closed. Three and Four-year-old classrooms are closed on March 23 and March 24 due to sickness. LC discussed that the agency must notify the department when serious incidents occur at the agency and complete incident reports to notify the parents. The following VIOLATIONS were cited: 1240-04-01-.06 STAFF. (1) Responsibility for Staff. (a) Owners, directors, and primary educators shall be responsible for: 1. Selecting qualified and capable staff; 2. The supervision, training, and evaluation and performance management of the staff; 3. The efficient operation of the child care agency's program; and 4. Providing written policy to staff that includes job functions, qualifications, lines of authority, staff performance evaluations, and disciplinary process. Observations: Management Staff did not notify the department of the lapses in supervision at the agency. Management did not ensure a stable system of supervision or provide parent notification of serious incidents involving their children. 1240-04-01-.08 RECORD KEEPING. (1) General Record Requirements. (a) All records required by this chapter shall be maintained in an organized manner onsite, in a centralized location, or available electronically, and made readily available upon Department request. Observations: Agency staff disciplinary actions were not on-site at the agency. The Director had the disciplinary action records at her home. Staff disciplinary actions were not available for the Department to review in the staff files. 1240-04-01-.11 SUPERVISION. (2) Supervision Procedures. (d) Incidents, accidents, injuries, and signs of serious illness to children shall be documented immediately with the following information: 1. Child's name and date of birth; 2. Name of the person writing the report; 3. Date and time; 4. Date and time of completion of incident report; 5. Description of incident and circumstances; and 6. Action(s) taken by the child care agency. (e) The documentation shall be provided to the parent/guardian the same day of the incident, and filed in the child's record. (f) The child care agency shall notify the Department of all serious incidents the same day of the incident, by emailing or calling the Complaint Hotline or making the submission through the provider portal. Serious incidents include but are not limited to the following: 1. Any injury that requires medical treatment beyond on-site first aid; 2. Reports made to the Department of Children's Services, law enforcement, or anytime it is necessary to call 911; 3. Any incident that may result in staff exclusion from child care as a result of an excludable offense (see background check requirements); 4. Transportation accidents and moving violations that occur when children are in the vehicle; and 5. Any child or adult fatality at the child care agency. (15) Falsification of any information or documentation is prohibited. Observations: On March 23, 2023, in the process of beginning the investigation of this complaint, LC Phillips questioned the Assistant Director, who was in charge during the absence of the Director, if the agency has had any supervision lapses. Assistant Director stated no and informed LC Phillips that she was calling Director. Once Director was on the phone LC was informed by Director that the agency had not received any complaints from parents, teachers, or anyone. Both the Assistant Director and Director informed LC Phillips that neither was aware of any lapses in supervision. Disciplinary reports that were provided to LC Phillips reflected that both the Director and the Assistant Director had knowledge of the supervision lapses as indicated by their signatures on all of the disciplinary action forms. LC served seven educators' supervision safety plans. LC also served the agency with an agency training safety plan. LC discussed the supervision log with the Assistant Director and the requirements of the safety plans. Assistant Director will obtain the signatures on the safety plans of all other staff members upon their return to the agency. LC will email all safety plans and check sheet to the agency. Revisions were made to the check sheet and revisions were discussed with Director during the visit on 03/27/2023. Another violation was added to the check sheet and Regional Manager discussed this violation with the Director via telephone call and email on 03/31/2023. The check sheet was emailed to obtain signatures for the second revision.

Observations: On March 23, 2023, in the process of beginning the investigation of this complaint, LC Phillips questioned the Assistant Director, who was in charge during the absence of the Director, if the agency has had any supervision lapses. Assistant Director stated no and informed LC Phillips that she was calling Director. Once Director was on the phone LC was informed by Director that the agency had not received any complaints from parents, teachers, or anyone. Both the Assistant Director and Director informed LC Phillips that neither was aware of any lapses in supervision. Disciplinary reports that were provided to LC Phillips reflected that both the Director and the Assistant Director had knowledge of the supervision lapses as indicated by their signatures on all of the disciplinary action forms. LC served seven educators' supervision safety plans. LC also served the agency with an agency training safety plan. LC discussed the supervision log with the Assistant Director and the requirements of the safety plans. Assistant Director will obtain the signatures on the safety plans of all other staff members upon their return to the agency. LC will email all safety plans and check sheet to the agency. Revisions were made to the check sheet and revisions were discussed with Director during the visit on 03/27/2023. Another violation was added to the check sheet and Regional Manager discussed this violation with the Director via telephone call and email on 03/31/2023.
