Summary of Complaint Investigation Visit The visit conducted today included monitoring of the agency's compliance with Licensing Rules and Regulations and complaint investigation. If any violations were received, details can be observed in the compliance details section of the visit along with corresponding corrective action plans Staff failed to follow incident reporting guidelines according to Department of Human Services licensing rules. Management failed to ensure staff followed disciplinary policy. Staff failed to follow behavior management and guidance guidelines according to Department of Human Services Licensing Rules. Staff failed to report suspected child abuse to Department of Children's Services as required.

Summary of Complaint PCS1002549 Investigation The visit conducted today included monitoring of the Agency's compliance with Licensing Rules and Regulations. Observation: On March 27, 2023, at 11:40a, an expired Epi-Pen (December 2022) was accessible to a child, aged 3 years. An Educator placed an Epi-Pen in her pocket during lunch but did not return the Epi-Pen to its original location upon returning to the classroom. The Educator was sitting and reading a story to the children when a child reached into her pocket and grabbed the Epi-Pen. The Educator did not feel the child's hand in her pocket. At this time, the Educator asked the children to "put their books away." The Educator started messaging a parent/guardian, on ProCare Solutions, about an unrelated incident and heard the child "oww." When the Educator turned around, she saw the Epi-Pen "hanging from the child's finger." The Educator instantly removed the Epi-Pen from the child's finger and requested assistance from the Director. The child was picked up by their Mother. The Mother informed the Director that additional treatment was required in the Emergency Department. Technical Assistance Given: Medications – LC Rogers reviewed 1240-04-01-.12 Health and Safety (12) Medications with Director and Educator. (12) Medications. (a) Receiving Medications. 1. All medications shall be received from the parent/guardian by a designated staff person. 2. The designated staff person(s) shall: (i) Obtain the parent's/guardian's written authorization to administer each medication; (ii) Document that the medicines or drugs are in the original container, are not expired, and are labeled with the child's name; (iii) Document the specific dosage and times the medication is to be administered to the child; and (iv) Document that the parent/guardian has provided the child care agency with instructions on the means and method of administration. (b) Administering Medications. 1. All medications shall be administered by a staff person or persons who have received training in medication administration. Online training is available through the American Academy of Pediatrics at no cost. 2. The following documentation shall be maintained in the child's file and a copy provided to the parent/guardian: (i) Medication was administered according to parent/guardian or health care provider instruction, including times and amounts of medications administered; (ii) Any side effects observed; (iii) Name of staff person administering medication to child; and (iv) Unused medication was returned to the parent/guardian. 3. Medication shall never be administered in bottles or infant feeders unless authorized by a physician. Educators shall ensure that medication administered in this way is not accessible to other children. (c) Accessibility of Medications. 1. Medication shall not be accessible to children unless a physician's authorization for the current school year is on file that allows a school-age child to have self administered medication. 2. All medication shall be stored in a child-proof compartment or container. 3. If medications requiring refrigeration are kept in a refrigerator used for food storage, the medicine shall be put in a leak-proof, child-proof container. 4. Medication requiring emergency administration, as prescribed by a licensed medical professional, e.g. an "Epi-Pen" or asthma inhaler, may be kept in an unlocked container that is inaccessible to children. (d) Diaper cream, ointments, sunscreens and lotions shall be inaccessible to children. Technical Assistance Given: Administering Medication in Child Care Settings – LC Rogers will require all Educators to take the Administering Medication in Child Care Settings training on ProSolutions. Technical Assistance Given: ProCare Solutions – If an Educator is alone in the classroom and needs to contact a parent/guardian immediately, via ProCare Solutions, the Educator should request assistance in the classroom so that all children can continue to be supervised properly. If the message is not urgent, LC Rogers recommends that Educators wait until naptime to complete any messages on ProCare Solutions. Violations Received: 1240-04-01-.06 STAFF. (1) Responsibility for Staff. (a) Owners, directors, and primary educators shall be responsible for: 1. Selecting qualified and capable staff; 2. See Below for Detailed Information Observation: A nine (9) month old was observed asleep in a crib with a blanket over him. 1240-04-01-11 Supervision Corrective action: The educator took the blanket off of the infant. The educator stated that she has been trained in Safe Sleep. A referral will be made to CCR&R for the infant/toddler specialist to come to the child care to re-train her. Observation: A child's file that was needed could not be located. 1240-04-01-08 Record Keeping Corrective Action: The file had not been found by the end of the visit. The director stated that she would try to locate the child's file and will work on organization of these files. Observation: The center is cluttered, unorganized and not clean. Mold was observed in the school age classroom along the baseboard. 1240-04-01-16 Physical Facilities Corrective Action: The director stated that the church is in the process of painting the entire inside of the day care. They are aware of the mold along the baseboard in the school age classroom which will be taken care of. The director is aware of the clutter and disorganization and may need help in correcting it. Observation: An educator did not follow requirements for reporting disclosures of abuse and neglect to ensure child safety. 1240-04-01-10 Duty to Report Child Abuse and Neglect Corrective action: The educator and director will re-take a child abuse class in order to understand reporting. Observation: Management responsibilities 1240-04-01-06 Staff Corrective action: The director was informed of the problems in the center with staff, physical facilities and organization. PE will make a referral to CCR&R to come to the agency to work with her and staff.

Observation: PE asked the director about the pre-k children coming from the elementary school after school regarding which class they are enrolled in. The director stated that they are enrolled in the school age class. The director stated that she thought since they were 5yr. old they were considered school age. 1240-04-01-22 SPECIFIC REQUIREMENTS FOR CHILD CARE CENTER Corrective Action: PE gave TA to the director regarding rules on school age children.The child needs to be enrolled in Kindergarten to be considered a school age child. The director stated that she understood and will place them in the correct classroom. Observation: A 2 1/2 yr. old child was moved to a 3yr.-4yr. class for nap time. 1240-04-01-22 SPECIFIC REQUIREMENTS FOR CHILD CARE CENTERS Corrective Action: PE gave Technical Assistance regarding moving a child to another class for nap time when they are not enrolled in that class. PE did not have her wake the child up, but they understand the rules now. Observation: An incident was reported to the agency and they failed to report the incident to the hotline. 1240-04-01-10 DUTY TO REPORT CHILD ABUSE AND NEGLECT Corrective Action: PE gave Technical assistance on duty to report to both the educator and the director. PE will have them both attend the next Personal Safety Class in April.
