Child care staff shall supervise every child in care at all times.
The department received an anonymous complaint that Staff C is leaving children alone in the classroom. Staff A reported that Staff C will leave the classroom to speak with the center director and leave the classroom unsupervised. Staff B stated that Staff C has been spoken to previously about stepping out of the classroom and leaving children unattended. Corrective action: Staff c asks the director to go to her room if she needs to talk to her now. She does not leave the kids unattended she will even line them up and bring them out of the classroom if they need anything.

Programs shall staff group child care centers in accordance with the following: (1) For children ages 36 to 47 months, the maximum group size shall be 24 with the following minimum staffing levels: a. One associate teacher with up to 8 children; b. One associate teacher and one assistant teacher with 9 to 16 children; and c. One lead teacher and 2 assistant teachers with 17 to 24 children; (2) For children ages 48 to 59 months, the maximum group size shall be 24 with the following minimum staffing levels: a. One associate teacher with up to 12 children; and b. One associate teacher and one assistant teacher with 13 to 24 children; and (3) For children ages 60 months and over, the maximum group size shall be 30 with the following minimum staffing levels: a. One associate teacher with up to 15 children; and b. One associate teacher and one assistant teacher with 16 to 30 children.
The department received an anonymous complaint stating that the program was operating out of ratio during morning operating hours. The licensing coordinator reviewed attendance records for various dates in April and May 2025. The review revealed that on April 22, 2025, Staff D was the only staff member signed into the program from 6:11 AM until 7:35 AM. At 7:15 AM, there were 11 children with an average age of 65 months present in the program, which requires a second staff member to be present in the building. On April 23, 2025, Staff D was the only staff member signed into the program from 6:12 AM until 7:33 AM. At 7:15 AM, there were 11 children with an average age of 69 months present in the program, which requires a second staff member to be present in the building. On May 7th, 2025, Staff D was the only staff member signed into the program from 6:15 AM until 7:45 AM. At 7:36 AM, there were 11 children with an average age of 71 months present in the program, which requires a second staff member to be present in the building. On May 14, 2025, Staff D was the only staff member signed into the program from 6:15 AM until 7:50 AM. At 7:15 AM, there were 11 children with an average age of 69 months present in the program, which requires a second staff member to be present in the building. At 7:35 AM, there were 17 children with an average age of 69 months signed into the program, which requires a minimum staffing ratio of one associate teacher and one assistant teacher. On May 19, 2025, Staff D was the only staff member signed into the program from 6:15 AM until 7:50 AM. At 7:20 AM, there were 11 children with an average age of 71 months present in the program, which requires a second staff member to be present in the building. At 7:42 AM, there were 18 children with an average age of 64 months in the program with one staff member, which requires a minimum staffing ratio of one associate teacher and one assistant teacher. In each instance as described, the program was operating without a second staff member when a second staff member was required. Corrective action: I have adjusted the hour for a couple employee, so we are not out of ratio in the morning. My second person is coming in early. I am also waiting for some background checks to clear, so I have extra staff, so this doesn't happen. I have been trying to over staff because you never know when you will lose someone or if something happens. Added pursuant to email on 7/2/2025: Now and in the future the program will be compliant with ratio requirements.
