The center director, site director, family child care provider, and all staff used to meet staff to child ratios shall: (1) Be certified in pediatric cardiopulmonary resuscitation (CPR) and first aid within 90 days of the first date of employment; (2) Obtain certification in (m)(1) above by the American Red Cross, American Heart Association, Emergency Care and Safety Institute, National Safety Council, or other nationally recognized organization; and (3) Maintain current certifications required in (m)(1) above.

The licensing coordinator’s review of five staff files revealed that the CPR and First Aid certifications of one staff, who is utilized to meet staff-to-child ratios, were expired. Corrective action: We realized at our visit the staff members cpr/first aid had recently expired. Since the visit, we have double checked all staff files. We have also had that staff member take a cpr/first aid course. We are scheduling one for the near future as well for all staff to attend, so we are on the same schedule and there is no confusion! We will ensure that staff CPR/1st AID certifications stay current.

Programs shall comply with approved corrective action plans and corrective action plans issued in accordance with (i) and (j) above.

This Statement of Findings includes a repeat citation for He-C 4002.08(b), which constitutes one repeat citation and failure to comply with one approved corrective action plan, as noted herein. Corrective action: With this being our first repeat citation, we are taking it extremely serious and will make sure this is addressed from this point forward. In the future, we will review the corrective plan with staff after each licensing visit so we are able to all remind each other to avoid future repeat violations.

The program shall maintain daily child attendance records, in either paper or electronic format, including the child’s full name, date of birth, and their arrival and departure times in the program and each room or group throughout the day, as applicable, recorded in real time by staff or parents.

REPEAT CITATION PREVIOUSLY CITED ON MAY 13, 2022. The licensing coordinator's review of the daily staff attendance records revealed that staff do not sign into or out of the classroom for scheduled breaks. Staff confirmed that they do not sign in or sign out of the classroom for scheduled breaks. Corrective action: After the original citation in 2022, we had staff signing in and out for breaks. At somepoint, from our last visit in 2023 and now, staff had stopped and it somehow went unnoticed by management. We will be keeping a closer eye on attendances and will remind staff to sign in and out every time they leave the classroom. We have posted a reminder next to our punch in clock as well that reads "Reminder! Please log on the attendances for breaks!". We also have added a reminder to our monthly staff meeting reminders list that reads "Reminder! It is very important that all staff are signing in and out for their shifts as well as for their breaks on the attendances!"

The licensee shall have a written job description for each direct child care staff position, including the scope of responsibility, required tasks, and the position to whom they report, with documentation of review on file in accordance in He-C 4002.09(a)(6).

The licensing coordinator's review of five staff files revealed there was no job description on file for one staff. Corrective action: We reviewed all staff files and made sure everyone had a job description. We also created a new staff binder with job descriptions in it along with other needed paperwork! When new staff are hired, we will follow the checklist from the binder which includes a form with their job descriptions on it to ensure everyones files are complete in the future.

He-C 4002.16(e) · Correction status not published

A written record of a health screening for all child care staff, household members and other individuals who have 5 or more hours per week of contact with children shall: (1) Be on file at the program and available for review by the department for all child care staff within 60 days of the date of hire or the date the household member or individual begins having daily contact with children; and (2) Include, at a minimum, the information on the “Child Care Personnel Health Form” (11/2017) provided by the department, or its equivalent.

The licensing coordinator's review of five staff files revealed that one staff member's health screening did not include a statement from the health care provider that indicates the individual has no apparent health conditions that would prohibit or inhibit his or her ability to care for children. Corrective action: The health form we received from our employee was printed from thier physician we left some room for error because it didnt include the section that they can work with children. In the future, We will be giving staff the health form from the DHHS website in the future to make sure this section is completed!

He-C 4002.09(b) · Correction status not published

For children 24 months through 5 years, during naptime, a center-based program may have one less staff person in a classroom than required to meet ratios in accordance with He-C 4002.36 through He-C 4002.38 provided that: (1) The total number of child care staff required to maintain all ratios are on the premises of the program; (2) The ratio of awake children to staff in the classroom shall be no more than half the number of children as stated in He-C 4002.36 through He-C 4002.38; (3) Rooms in which staff is reduced shall be equipped with a two-way communication system to allow for immediate contact with other staff for assistance and response; and (4) There is a safety plan on file for review by the department, child care staff, and parents which includes plans or procedures for: a. Evacuation; b. Supervision; c. Environment; d. Schedule; e. Naptime policy; and f. Staff training and support; (5) The program provides parents with written notice of the reduction of staff; and (6) Documentation of the written notice in (5) above, in the form of a posted document, a policy statement that is signed by each parent, or other method of documentation is kept in the child’s record for review by department staff during visits.

The statement by staff that in the Preschool 1 classroom, they reduce by one staff during rest time when half the children are asleep, and they are not sure if parents are notified of this practice in the Welcome Packet. A review of the Welcome Packet revealed that parents are not notified of the reduction of staff during rest time. Staff A confirmed that parents are not aware of this practice. Corrective action: We have added a section to our welcome packet, which states "For classrooms with children 24 months through 5 years, during naptime, we may have one less staff person in a classroom at times than required to meet ratios in accordance with He-C 4002.36 through He-C 4002.38 when more than half the children are sleeping. The staff in that classroom will be equipped with a 2 way communication method and staff will be on site to assist with any help needed. All KidLogic staff will have training on the saftey plan, which will be posted in all rooms that may have the ability to reduce ratios during rest time". Families will sign off on this policy, which will be included in our handbook that is updated yearly!

Child care staff shall ensure that for each child, upon the child’s first day in attendance in the program, there is a “Child Care Registration and Emergency Information” (April 2022) form or an equivalent form provided by the child care program completed and signed by the parent, on file, which contains: 1) Full legal name of the child; (2) Child’s date of birth; (3) Child’s physical address and mailing address; (4) Child’s home telephone number; (5) Date of enrollment in the program; (6) The name, physical address, and mailing address of the parent(s) responsible for the child, if different from the child’s address; (7) Telephone numbers for the child’s parents and instructions as to how the parents can be contacted during the hours that the child is at the program; (8) Email addresses for the parents, if available; (9) Names and telephone numbers of at least one person who will assume responsibility for the child, if for any reason, the parents cannot be reached immediately in an emergency; (10) Any chronic conditions, allergies, or medications in case of sudden illness or injury; (11) Written parental permission for first aid treatment; (12) Written parental permission for emergency medical transportation and treatment; (13) The name and telephone number of each child’s physician or health care provider; and (14) Names and telephone numbers of any person(s) other than parents who are authorized to remove the child from the program.

The licensing coordinator's review of 10 children's records revealed there was no emergency contact listed on the Child Care Registration and Emergency Information form for two children. Corrective action: We had the parent update their children's file to include emergency contacts for both children. We also made a check list for new enrollment and included a section that states all children need to have emergency contacts on their registration form to ensure in the future we do not miss this.
