In a family child care home the maximum number of children that one family child care provider or family child care worker can care for shall be 6 preschool children plus 3 school-age children who are enrolled in and attending a full day school program, provided that: (1) Of the 6 preschool children, no more than 4 children are younger than 36 months of age; and (2) Of the 6 preschool children, no more than 2 children are younger than 24 months of age.

The licensing coordinator observed 16 children and three staff in the program. Of the 16 children none were considered school-aged (enrolled in or attending a full day school program), and 9 children were younger than 36 months. The provider stated that they had misunderstood the provisions of their license capacity and had already started the license revision process. Corrective action: I was in the process of upping my license to 18 to be center based. I thought that because I was licensed for children 6 weeks to 12 years, I was with the license limits. In the future I will reach out for help if I don't understand the explanation.
