On 12/2612022, Christina Wilcox, licensee designee and program director of Morningstar Early Learning Center sent me a text message regarding an incident at the center. Ms. Wilcox wrote that over the weekend she was informed that on 12/2212023, a care staff member squeezed the arm of a child in care leaving a bruise. The child's mother is also a child care staff member at the center. Ms. Wilcox terminated the child care staff member's employment with the center on 12/26/2022. On 12/26,2022, I received a text message from Child Care Staff Member 1. In the text message, Child Care Staff Member indicated that "there was another issue with a child that never happened" and she did not know what was going on. She indicated that the child's mother "said I grabbed the kids arm with (sic) I do in the hall ways (sic) to help them walk if they throw fits so the kid tore away from me wich(sic) probably caused a bruise wich(sic) she said their(sic) was one, but the child tore away from me while I had their arm I would never meanly grab a child ever I don't even hurt my own kids in any type of way." Child Care Staff Member 1 was also being investigated for an incident at another child care center and she had my contact information from that investigation. On 12/27/2022, Child Care Staff Member 1 left a telephone message requesting a call back. On 12/2712022, Ms. Wilcox emailed the written incident report. The incident report identified Child A as the child with the bruise and Child Care Staff Member 1 as the person who injured Child A. On 01/03/2023, I returned from leave and reviewed the text messages and emails regarding the incident. I emailed Ms. Wilcox to inform her that I had opened a special investigation. Ms. Wilcox texted that she was out of the center on leave for the day. On 01/03/2023. I made a referral to the onsite inspection was On 01/05/2023, I conducted an onsite inspection at the center with We interviewed Child A's Mother. Child A's Mother explained that on 12/22/2022, she found a bruise on Child A's arm right before putting him down for bed. She asked Child A where the bruise came from, and he said "the teacher" did it. When she asked what teacher, he said the teacher "with the light hair and green shirt." Child CI A's Mother listed some of the teacher's names and when she mentioned Child Care Staff Member 1's name, Child A said yes. Child A's Mother indicated that she had worked with Child Care Staff Member 1 before and although Child Care Staff Member 1 really did not want to do anything while working, she did not notice Child Care Staff member interact inappropriately with children. Child Care Staff Member 2 had told Child A's Mother that Child Care Staff Member 1 did not like being hugged, but other than that she had not heard anything else about Child Care Staff Member 1. Child A's Mother consented to Child A being interviewed. During the onsite inspection, a forensic interview was conducted with Child A. Child A identified Child Care Staff Member 1 by first name and stated she squeezed him and pointed to his arm. When asked why she squeezed him, he stated "cuz." He stated he did not know why she squeezed him and said she did not do it to anyone else. He stated Child Care Staff Member 1 "was mean". We then interviewed Child Care Staff Member 2. On 12/22/2022, she was working with Child Care Staff Member 1 before the room was split into two groups and Child Care Staff Member 2 left with her group. Child A was with Child Care Staff Member 1's group. Child Care Staff Member 2 recalled that Child A did not want to go with Child Care Staff Member 1's group. Child Care Staff Member 2 denied witnessing Child Care Staff Member 1 grab Child A's arm because they had separated into their own rooms by then. Child Care Staff Member 2 had concerns about Child Care Staff Member 1 because she "was after" Child A's Mother for some reason. Child Care Staff Member 2 did not like the way Child Care Staff Member 1 looked at Child A. She

On 11/09/2022, while on leave, I received a text message from Christina Wilcox, licensee designee and program director of Morningstar Early Learning Center regarding an incident at the center. On 11/11/2022, I received an email with an incident report and a written statement regarding children with rash like injuries to their faces possibly due to new cots in the classroom. On 11/14/2022, after reviewing the text messages which included pictures of the children's injuries and the email sent from Ms. Wilcox, I opened a special investigation into the matter. On 11/14/2022, I conducted an unannounced onsite inspection at Morningstar Early Learning Center. I met with Ms. Wilcox who explained that new cots had been purchased and placed in the classroom on 10/20/2022. On Friday, 11/04/2022, Child A (4-year-old male) was leaving for the day, and she observed that his eyes were a little red "like allergies." Ms. Wilcox explained that Child A is related so she called Child A's Mother that evening to see how he was doing. By that evening Child A's eyes were red and by the next morning, 11/05/2022, Child A's eyes were swollen shut. Child A's Mother took Child A to the doctor and was told that he was having a delayed allergic reaction to something, but they did not know from what or where. 3 On Monday morning,11/07/2022, Child B's Mother came into the office and asked about a rash on Child B (3-year-old female). The office assistant, Alana Butt, spoke with Child B's Mother about the rash. Ms. Wilcox found out about Child B's rash on 11/08/2022 when Child C (3-year-old male) and Child D (4-year-old male) also came in with a rash. Child C's Mother reported to Ms. Wilcox that the rash came the night before on 11/07/2022. Child D's Mother did not think Child D's rash came from the center and said Child D had been crying at home when the rash appeared. However, Ms. Wilcox explained to Child D's Mother that something might be going on at the center since Child A, Child B, Child C and now Child D were presenting with rashes. After nap on 11/07/2022, Ms. Butt brought Child E (3-year-old male) and Child F (4- year-old male) into the office, also with redness to their faces. Child E's Mother and Child F's Father were contacted on 11/07/2022 about the rashes. Ms. Wilcox then notified all parents through an email that something was causing a rash and to watch their children for reactions. Ms. Wilcox stated that all parents were notified of the reactions and while they were understanding, they also had mixed responses. Most parents stated they wanted to make sure measures were being taken so it did not happen again. Child B's mother and Child C's Mother were ok with how the incident was being handled, but Child B and Child C are related and their grandmother was very upset. Child B and Child C's grandmother contacted Ms. Wilcox very upset about the injuries. Ms. Wilcox also explained that Child F's Father is a chemist and questioned the use of bleach water as a sanitizer on the cots. Ms. Wilcox explained that all the reactions were occurring in the same classroom. She thought it was because of new cots that were purchased, but the new cots were placed in the classroom on 10/20/2022 and the first possible incident was 11/04/2022 so she was not sure. She contacted the manufacturer of the cots to get the cot composition and to determine if they had received any complaints with the cots. She was advised that no complaints of rashes had been received regarding the cots. During the onsite inspection, I interviewed Ms. Butts. She stated that on 11/07/2022 Child C's Mother asked how Child C got what appeared to be a rug burn like mark on his hairline. The children, including Child C, had been crawling around the floor acting like cats so the child care staff members thought perhaps he had rubbed his head on the carpet while acting like a cat. However, by that afternoon Child E and Child F had marks on their faces. Ms. Butts did not have any idea why the child

On December 16, 20101 received a complaint alleging that Child A was not properly cared for by child care staff members at Morningstar child care ofacn0il it . Child A allegedly had handprint marks on both forearms and missing beads braids with no explanation given on the possible cause. It was documented that Child A's Mother took Child A to a after picking up in the late afternoon from Morningstar. It waMa el ■ that she and the complainant noticed discoloration on Child A's forearms. Child A 1 also complained that ■ arms hurt. Pictures were taken of Child A's arms at the time. On December 16, 2020 1 spoke with Licensing Child Care Consultant Juanita Velasquez. Ms. Velasquez is the assigned consultant for the Morningstar facility. Ms. Velasquez confirmed that owner/Licensee Designee Christina Wilcox had informed Ms. Velasquez of a possible incident/complaint about Child A. Ms. Wilcox outlined the situation to Ms. Velasquez in an email that Ms. Velasquez forwarded to me. (A copy of the email is with the case file.) also received a ecember 17.2020 I was further advised that the case has been assigned to 4 and I scheduled to meet and interview the staff on December 18, 2020 together. On December 18, 2020 I conducted an unannounced inspection at Morningstar child care facility. U n arrival I met with Ms. Wilcox and Program Director Jenniveve Millmine. was unable to attend the inspection. i Ms. Wilcox stated that on December 15, 2020, Ms. Fulgenti came to her about an email that she had received from Child A's Mother. The email stated her concerns to Ms. Fulgenti about and had attached the pictures of Child A's forearms taken the night before. Within minutes of Ms. Fulgenti showing Ms. Wilcox the pictures Child A's Mother called. This all started at about 7:O0AM. Ms. Wilcox stated that Child A's Mother was unhappy with the care that provided. It was brought to Ms. Wilcox's attention on previous occasions that when Child A's Mother had asked about events, response was that she did not know and would have to find out. During that days conversation, Child A's Mother did not believe explanation that Child A's hair beads just "fell out." She told Ms. Wilcox that she had been told by Child A's the night before that the beads had to have been pulled out. Ms. Wilcox stated that she spoke with both and Ms. Fulgenti and looked at the child attendance record. Child A's Mother picked Child A up around " from the center. Child A's Mother told her that after leaving the center she Oo ild A for food. In the car Child A told mother that (Child A) arms hurt. Child A's mother told Ms. Wilcox that she to hild A wou d*beokKa. They arrived at the at 6:00 PM for a_. en the asked Child A to roll up s eeves she saw the finger marks on Child . Child A's mother told Ms. Wilcox that she contacted by text later that night asking if there had been an issue in the classroom, told her that nothing had occurred that day, to her knowledge, that could have caused the marks or losing the beads. Child A's mother was now calling Ms. Wilcox for further information. Ms. Wilcox stated that between the time Child A left the center and arrived at the an hour and a half had passed. After speaking with both Ms. Fulgenti Ran , she does not believe any incident/event occurred at the center that could have caused the marks. I then conducted an interview with stated that she has worked at the facility for years. Currently she is a in the room. Her hours are . At the time of the interview one of her primary care children attends in-person learning and the other two primary care children attend virtually. That leaves the room with 4 children attending in-person. Three of those children, including Child A, are under the primary care of Ms. Fulgenti. On 10/12/2021, I conducted a telephone interview with Complainant. Complainant stated that on Friday, 10/08/2021, the center was informed that there was a flea problem. Children and child care staff members were being bitten. Child care staff members and children returned to the center on Monday, 10/11/2021, and continued to be bitten by fleas. An exterminator was called and the center was sprayed the evening of 10/11/2021. I asked Complainant if she was satisfied with the center's response since the exterminator had been out to address the issue. Complainant indicated that it was possible that due to the pandemic and worker shortage, an exterminator could not come out before 10/11/2021. However, Complainant stated it was still an inappropriate response because parents should have been notified that there were fleas. Children and child care staff members should not have been allowed to come back to the center while there were fleas. I explained to Complainant that I would address the flea situation as a maintenance of premises allegation, but there is no rule requiring parental notification of insects in the building. On 10/12/2021, I conducted an unannounced onsite inspection at Morningstar Early Learning Center. I met with the program director and licensee designee, Christina Wilcox. I informed Ms. Wilcox that a complaint had been received regarding fleas in the center. Ms. Wilcox stated that she rents space in the building from Macomb County and last week, she received a notice from the county that some shared use space including the gym and auditorium were going to be closed for pest management application to address bugs in the building. Ms. Wilcox did not ask for additional information, but did not use the shared use space during this time. On 10/07/2021, a child care staff member, Michelle Garcia, informed Ms. Wilcox that she found a bug on a child in the Early Head Start 2(EHS2) classroom. Ms. Garcia was not sure what type of bug, and the bug was flushed down the toilet. Ms. Wilcox asked Ms. Garcia to save any bugs she found so that the bug could be given to pest control for identification and treatment. On 10/08/2021, child care staff members were working, but there were no children in care. Ms. Garcia and the other child care staff member in the EHS2 classroom, Katina Staple, found additional bugs in the classroom. Ms. Wilcox was not working on 10/08/2021, so Ms. Garcia and Ms. Staple reported the bugs to the assistant program director, Glynis Rumfelt. Ms. Garcia and Ms. Staple were able to save some of the bugs in a bag and it was confirmed the bugs were fleas. Ms. Garcia and Ms. Staple cleaned and vacuumed the classroom on 10/08/2021 while there were no children in care. Ms. Wilcox stated she had already informed the landlord, Macomb County, that there were bugs on her side of the building and pest control was scheduled to come 3 out on 10/11/2021 after closing. Ms. Wilcox tried to get pest control out over the weekend, but the soonest they could come out was on 10/11/2021. Ms. Wilcox indicated she did not receive complaints or any information that the fleas were in any other room beside the EHS2 classroom. She confirmed that pest control treated the entire center for fleas on 10/11/2021 and parents were notified of the fleas and scheduled pest control measures in an email on 10/11/021. Ms. Wilcox denied being aware of any children being bitten by the fleas, but acknowledged that Ms. Rumfelt and possibly Ms. Garcia or Ms. Staple had been bitten while in the classroom. She did not receive any complaints or concerns from parents regarding the fleas. During the onsite inspection, I conducted an interview with Ms. Staple. Ms. Staple explained that on 10/07/2021, she found a bug on a child and told Ms. Wilcox right away. At that time, Ms. Staple was not sure what type of bug it was. On 10/08/2021, there were no children in care and she and Ms. Garcia found more bugs, so they showed Ms. Wilcox the bugs and Ms. Wilcox arr

On 03/17/2021, I conducted an unannounced onsite inspection at Morningstar Early Learning Center. I met with the licensee designee and program director, Christina Wilcox. I explained that a complaint had been received and informed her of the allegations that a child care staff member had lost an edible in the four-year-old classroom and a child care staff member went on break and came back high. Ms. C. Wilcox did not have any knowledge of a lost edible or a child care staff member coming back from break high. Ms. C. Wilcox identified Susan Boyd, Desha Downer, Jackie Whitehouse, and Denise Valle as the child care staff members who work in the four-year-old classroom. Ms. Valle was the only child care staff member not working during the onsite inspection. During the 03/17/2021 onsite inspection, I interviewed Ms. Boyd, Ms. Downer and Ms. Whitehouse. They each denied ever hearing anything about a lost edible and had no knowledge about a child care staff member coming back high from a break. On 03/18/2021, I conducted a follow up inspection after receiving an additional complaint. At that time, I interviewed child care staff members Marianne Schultz, Elaina Fulgenti and Jackie Dobbs. Each denied ever witnessing a child care staff member high or knowing anything about a lost edible. Ms. Dobbs stated she had heard rumors about the lost edible, but that was after I had been out on 03/17/2021. Ms. Fulgenti stated she heard a couple of years ago that child care staff members were coming in high, but she stayed out of the rumor mill and has not heard anything recently. Ms. Fulgenti did not identify which child care staff members were involved or give any specifics. She reiterated that she does not get involved in the rumor mill. She indicated she would inform Ms. C. Wilcox if she had any knowledge of child care staff members under the influence of drugs. On 04/07/2021, I conducted an exit interview with Ms. C. Wilcox. I informed her that I found no evidence that an edible had been lost or that child care staff members were going on break and coming back high. I explained that a violation of the appropriate care and supervision of children rule was not being cited. 3

On 03/15/2021, I conducted an unannounced onsite inspection at Morningstar Early Learning Center. I met with the licensee designee and program director, Christina Wilcox. I explained to Ms. Wilcox that a complaint had been received regarding the maintenance of the premises specifically a leak in the ceiling, water damaged ceiling tiles and a missing radiator cover. Ms. Wilcox and I walked through the building and she pointed out a newly patched spot in the ceiling of the main hallway. She indicated that there had been a leak which was repaired and patched. It began to leak again so it was repaired and patched, again. Ms. Wilcox stated she is uncertain whether the leak has been completely repaired because there may be an issue with a pipe fitting, but it was not currently leaking, and the spot is actively monitored for further problems. Ms. Wilcox stated she was told the leak may be the roof or possibly a pipe. The allegation indicated that the leak was dripping for several days the week of 03/22/2021 which is inaccurate since the complaint was received on 03/11/2021. The complainant could not be contacted for clarification. A previous complaint was received and investigated regarding the leak in the hallway in SIR 2021D 0427001. The special investigation report was dated 03/10/2021. No violations were cited at that time. I asked Ms. Wilcox if there had been an issue with a radiator cover in one of the classrooms. She acknowledged that the cover was missing a screw, but the panel had never fallen on a child and the components were not accessible to children. Ms. Wilcox and I went into the three-year-old classroom where I observed that the radiator cover had been taped on three sides. The tape was flat on the radiator cover, and the cover appeared secure with the tape. Ms. Wilcox and I toured the child care rooms and hallways of the child care center in search of water damaged tiles. There was one water damaged ceiling tile in a toddler classroom that is not currently in use. The classroom has been closed since before the March 2020 pandemic shut down. I also observed one water damaged ceiling tile outside of a school age classroom that is also currently not is use. Ms. Wilcox indicated she would submit a work order to request the tiles be replaced. The water damage to the ceiling tile looked dry and was minimal in size. The damage did not appear to be from an active leak. While touring the building, Ms. Wilcox and I spoke with child care staff member, Bryanna Jaynes, in the hallway. Ms. Jaynes works in the three-year-old classroom. Ms. Jaynes stated that the screw for the radiator cover fell off a few months ago and the panel fell. She said children were in the room, but not near the radiator. She denied that any child had ever been hit by the radiator cover or that the heating elements were exposed to children. She stated a replacement screw was requested and they used tape to secure the cover until the screw came in. Ms. Jaynes stated they remove the cover daily because the knob to control the heat is located inside 3 the cover. Ms. Wilcox stated she would follow through with maintenance on the status of the replacement screw. Within a couple of hours of the onsite inspection on 03/15/2021, Ms. Wilcox sent a picture of the repaired radiator cover. On 03/24/2021, I conducted a follow-up inspection and interviewed child care staff members Marianne Schultz, Jackie Dobbs, and Elaina Fulgenti. They each denied there was an issue with leaky ceilings or water damaged tiles except for the one in the main hallway which was addressed. During the 03/24/2021 follow up inspection, I conducted an exit interview with Ms. Wilcox and informed her that I had not found a violation of the maintenance of premises rules. Ms. Wilcox indicated that the building maintenance has determined that the leak is from a heating and cooling related issue. Ms. Wilcox expressed concerns that the complaint and subsequent complaints were being made in retaliation

R 400.8380 Maintenance of premises. (4) Floors, interior walls, and ceilings must be kept in sound condition, good repair, and maintained in a clean condition.

On December 18, 2020 and January 19, 2021, I conducted unannounced inspections to KidQuest in Mt. Clemens. Upon arrival on both dates, I met with owner/Licensee Designee Christina Wilcox and Program Director Jenniveve Millmine. Ms. Wilcox agreed with the complaint that the kitchen had a flood. She stated that while she was away from the center in early August of 2020, she had received a telephone call from Ms. Millmine that the pipe under the sink drain was overflowing creating a flood in the kitchen. She stated that she contacted Nick Latona from Latona plumbing that same day and had him come out to fix the issue. While searching for a receipt she provided me with the dates of August 5 and 6, 2020 that the issue occurred and was fixed. (Ms. Wilcox could not find an official receipt.) On a tour of the large kitchen, she showed this consultant where the large, white PVC pipe is under the sink that collects water. I have observed the same pipe set up in other child care facilities. The pipe is not connected to another pipe. It is under the sink coming up through the ground with an open top that is under the sink drain. At the time of the inspections, the area was clean, and it did not appear there was any current issue with drainage. Ms. Millmine stated that the sink was not used until Mr. Latona came out to fix the issue. There were no further issues after the sink was fixed. On December 18, 2020 I interviewed child care staff members Kelsey Missinni, Elaina Fugenti and Elise Cyraix individually. When I question them about the kitchen leak they could vaguely recall the issue, but each staff member stated it was cleaned up and fixed quickly. Ms. Missinni and Ms. Cyraix could not recall any further problems. On February 10, 2020 I spoke with plumber Nick Latona and confirmed that he came out to the center on August 5, 2020 to fix an issue in the kitchen. On September 4, 2020 I spoke with Child A's ( 3-year-old female) Mother and on December 21, 2020 I spoke with Child B's (1 year-old male) Mother.
