Rule 591-1-1-.17(2) requires that Personnel, to the extent possible, keep children clean, dry and comfortable.

During an investigation, it was determined that on September 13, 2021, center staff failed to keep an infant comfortable after an arm injury was observed. Staff observed that one arm was limp and appeared slightly larger than the other and notified the parents of the possible injury. Staff returned the infant to the classroom where they rocked the infant to sleep and placed them in a crib on their stomach with the injured arm raised above their head. Professional medical attention was required and the infant was treated for a broken arm.

Rule 591-1-1-.12(1) requires that all indoor and outdoor furniture, activity materials, and equipment shall be $499.00 used in a safe and appropriate manner by each Employee and child in attendance and in accordance with the manufacturer's instructions, recommendations, and intended use. All equipment and furniture shall be used only by the age-appropriate group of children.

During an investigation, it was determined that on September 13, 2021, center staff failed to follow manufacturer’s guidelines when a seven-month-old infant was placed in a portable floor swing without the full safety harness straps being used. The staff members utilized the safety straps for the waist and did not utilize the shoulder straps. The infant leaned forward out of the swing seat several times and staff had to continually reposition the infant in the seat. The staff continued not to use the full safety harness while the infant was in the swing. The infant then leaned forward reaching for a toy and partially fell from the swing, resulting in a broken arm. The infant received professional medical attention as a result of the incident.
