Rule 591-1-1-.26(9) requires the playground to be kept clean, free from litter and free of hazards, such as but not limited to rocks, exposed tree roots and exposed sharp edges of concrete.

During a Monitoring Visit conducted on February 28, 2023 ; It was determined based on observation that the following hazards were present. Center Playground- Concrete on the left side at the end of the sidewalk next to the gate leading to the back playground was not flush, cups and paper were strewn throughout the playground. Back Right Playground- 'PVC' pipe on the back right playground was not connected and around the rubber surfacing for the play equipment that posed a tripping hazard.

Rule 591-1-1-.17(8) requires staff to wash their hands with liquid soap and warm running water upon arrival for the day, when moving from one child care group to another, upon re- entering the child care area after outside play, before and after diapering each child, dispensing medication, applying topical medications, handling and preparing food, eating, drinking, preparing bottles, feeding each child, assisting children with eating and drinking, after toileting or assisting children with toileting, using tobacco products, handling garbage and organic waste, touching animals or pets, handling bodily fluids and after contamination by any means.

Rule 591-1-1-.26(8) requires Resilient Surfacing: Adequately maintained for resiliency beneath and in the fall zones of climbing and swinging equipment

During an Incident Investigation conducted on May 10, 2022, it was determined that on April 21, 2022, the center had an inadequate amount of resilient surfacing underneath the climbing unit measuring at one to two inches. Center staff failed to ensure that the resilient surfacing measured at six inches for the outdoor play equipment. The four-year-old child sustained a fractured left elbow after falling on the inadequately maintained resilient surface.

Rule 591-1-1-.12(1) requires all indoor and outdoor furniture, activity materials, and equipment shall be used: in a safe and appropriate manner by each Employee and child in attendance; and in accordance with the manufacturer’s instructions, recommendations, and intended use. All equipment and furniture shall be used only by the age- appropriate group of children.

During an Incident Investigation conducted on May 10, 2022, it was determined that on April 21, 2022, the staff allowed the children to utilize the outdoor play equipment in an unsafe, inappropriate manner. The children were observed on video footage to rough house play during several times without adult intervention to redirect the children.

Rule 591-1-1-.03(9) requires staff shall not engage in, or allow children or other adults to engage in, activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

During an Incident Investigation conducted on May 10, 2022, it was determined that on April 21, 2022, children were observed to interact inappropriately by participating in rough play during outdoor play. According to evidence obtained through staff statements and video footage, staff observed children playing in a rough manner and staff did not immediately interject and redirect the rough housing while on the playground.
